Pleading: John Camvile states that on 20 May 1456, at Westminster, before John Forthowe, auditor, Richard Hok accounted for various sums of money of JC received by RH on account before that time, and on this account was found to be in arrears to JC in £4. Also, on 13 July 1457, also at Westminster, RH borrowed a further £6 from him, payable on request. However, RH has not paid either debt, to a total of £10, to his damage of 100s.

Pleading: RH states that JC ought not maintain his action, as after the said 13 July, namely on 20 August 1457, at Hatfield Broad Oak, there was an agreement between himself and JC concerning this £10 and all other debts and contracts outstanding between them. The agreement was that RH should pay JC £4 10s 6d in full satisfaction of this £10 and all other outstanding debts, and he paid this immediately, and JC received it.

Term: Michaelmas 1466
County: Hertfordshire
Writ type: Trespass (force and arms)
Damages claimed: £40
Case type: Breach of Statute; Real action / rents / damage to real estate

Pleading: Thomas Arblaster and his wife Alice, citing the statute of 5 Richard II against unlawful entry into property (Stat Realm, 5 Ric II, c. 7), state that on 20 September 1465, Richard Wyncote and Joan Vycary entered into their messuage, 30 acres of land and 2 acres of wood in Redbourn, into which entry had not been given, in contempt of the king, against the form of the statute and to their damage of £40.

Pleading: RW and JV state that the plaintiffs ought not have their writ, since before the supposed entry, and before TA and AA had anything in this property, a certain John Vycary was seised of this property in his demesne as of fee, and thus seised he died, after which it descended to Thomas Vycary, as his son and heir, who entered and was seised. Thus seised, TV enfeoffed the property to John Baldewyn, William Huddesfeld and Thomas Spekyngton and their heirs in perpetuity, by virtue of which they were seised in their demesne as of fee. They, by a certain sealed deed which RW and Joan V show in court, dated at Redbourn on 15 November 1465, in fulfilment of the last will of Thomas V, demised and delivered the property to Joan V, as mother of Thomas V, for her life, being all the property of the feoffees in the parish of Redbourn, which they had of Thomas V, and which he had inherited from his father John V. After the death of Joan V, they granted that the property should remain to Richard W and his heirs, to hold of the chief lord of the fee by the customary service. By virtue of this grant, Joan V was seised in her demesne as of free tenement, and TA and AA, claiming the property by virtue of a demise made to them for life by John V when in fact none of this property should have passed to them by virtue of that demise, entered into the property upon the tenure, and thus Joan V, and RW as servant of Joan V, peacefully re-entered the property, as seemed right.

Pleading: TA and AA state that they were seised of the property in their demesne as of fee, by right of AA, until RW and Joan V entered the property without their permission. John V did not die seised of the property as RW and Joan V have claimed.

Pleading: RW and Joan V state that John V died seised of the said property as claimed. Parties on country, jury here at octave of Hilary.

Term: Michaelmas 1466
County: Buckinghamshire
Writ type: Debt (bond)
Damages claimed: £100
Damages awarded: 10m
Costs: 5m
Case type: Arbitration; Bond; Contract (marriage); Real action / rents / damage to real estate

Pleading: William Garnon amerced for many defaults. Robert Ingleton states that on 22 January 1466, at Aylesbury, William Garnon made a bond with him in 1000m, payable at the Purification then next, but has not paid, to his damage of £100. He shows the bond in court.

Pleading: WG asks to hear the bond and the endorsement, and these are read in court. The endorsement states that the condition of this bond is such that if WG should stand in the arbitration of Thomas Billyng and William Laken, justices of king's bench, John Walter and William Neweman, arbiters, or three or two of them, concerning title and possession of the manor of Thornton in Buckinghamshire, and all other lands contained in a certain fine between Rose, widow of Richard Chastilon, plaintiff, and Hugh, son of Richard C, deforciant, levied in 8 Edward I, as well concerning all actions outstanding between them, and WG should abide by and implement the terms of the arbitration, provided that the arbitration is sealed by the arbiters and the parties by the octave of the said Purification, then the bond shall have no effect. Having heard this, WG states that RI ought not have his action since, protesting that the arbiters made no judgement concerning the matters between them, he states that no arbitration was made concerning the issues between them before the said octave of the Purification.

Pleading: RI states that the arbiters made their judgment on 4 February 1466, in the parish of St Bride, London, as contained in a certain document, of which RI shows in court the part sealed by TB, WL and JW, arbiters [recited in full, in English]. The award states that whereas WG has a writ of formedon pending in Common Pleas against William Hasylden, Thomas Eston, John Pulter and John Ingram, feoffees there to the use of RI, where an issue is joined to be tried by the country between WG and Hasylden, it is ordained that WG should suffer the writ to be sued in his name, and should abide by the verdict. Also, before 12 February next, WG should release all claim to the manor to RI or others appointed, with a clause of warranty for him and his heirs against George, abbot of Westminster and his successors, and for this deed to be enrolled in the king's chancery. WG shall also, before Easter three weeks next, cause his mother to release for herself and her heirs all her right in the manor to RI, with warranty against the abbot of Westminster. They also ordain that with half a year of these being done, RI should cause a sufficient estate in tail male to be made to him and the heirs of his body, with remainder to the right heirs of RI. Also, John, son and heir of WG, should marry Jaquetta, daughter of RI, within a quarter of a year after she becomes 7 years of age, for which RI should pay WG 200m, which WG should use to buy property for John and Jaquetta, to their use. Also, on the marriage, WG should make an estate in Glanfield in Oxfordshire to a value of £12, for John and Jaquetta, the heirs of their bodies, and to Jaket for life. All other disputes between them are to be quit. Sealed. RI, protesting that WG did not implement the judgment as recited, states that the arbitration was delivered in time as recited, namely one part to RI in London on 4 February, and another to WG at Aylesbury on 6 February. Further, RI says that on 7 February 1466, named himself, George, archbishop of Canterbury and John, earl of Northumberland, as the people to whom WG was to quitclaim all his rights in the said manor. However, WG did not do so.

Pleading: WG states that the judgment was not delivered to him before the said octave of the Purification, as claimed. Parties on country, jury here at morrow of All Souls.

Postea text: Jury in respite to octave of Hilary 1467. RI comes in person, WG by attorney, jury say that the arbitration was delivered to WG by the octave of the Purification, as claimed by RI. Damages assigned to RI at 10m, costs at 5m. Order that RI recover debt, and damages of £10. WG amerced.

Postea text: RI acknowledged satisfaction of debt and damages, WG quit.

Case notes: Evidently part of long case concerning rights to this manor - see VCH Bucks.

Pleading: John Johnson junior, administrator of the goods formerly of John Johnson, senior, deceased, states that on Sunday 10 February 1454, in the parish of St Leonard, Tower ward [sic] in London, Henry Bradfeld and a certain William Serle, now deceased, by a certain sealed bill which JJ junior presents in court, warranted JJ senior for certain victuals delivered and taken for the use of the household of John, duke of Norfolk on Thursday 7 February 1454, namely for 3 cattle worth 60s, 19 sheep worth 2s each, 6 pigs worth 3s 4d each, and one lamb worth 12d. HB also warranted JJ senior for goods delivered to the same household on the said Sunday, namely 3 cattle worth 60s, 12 sheep worth 24s, 4 pigs worth 13s 4d, and 4 lambs worth 4s. If Master Thomas Northdon, treasurer of the duke's household, were to find sufficient surety for JJ for these sums before 11 February following, then HB and WS were to be exonerated, otherwise HB and WS obliged themselves to pay, at Easter then next, the sums contracted on the said Thursday, amounting to 119s, and HB obliged to pay the sums contracted on the Sunday, amounting to 101s 4d. JJ junior states that RN did not find any security for these sums by the said 11 February, but neither HB and WS before WS's death, or HB afterwards, have paid any of these sums, either to JJ senior or JJ junior, to his damage of 10m. He shows in court the letters of Thomas, archbishop of Canterbury, by which he is administrator of JJ senior.

Cammell seeks judgment, since he states that TC, in the parish of St Michael, Dowgate ward in London, appointed both Elizabeth C and a certain William Canynges, his brother, as his executors, and after the death of TC, William Canynges and Elizabeth both administered TC's goods as his executor; this William Canynges is still alive, and thus Cammell seeks judgment on the writ. JY and JC state that WS ought not maintain his action, as JY, protesting that he was never executor of Elizabeth, states that before the day of WS's original writ he had administered all the goods formerly of Thomas C, and had none left in his hands then or afterwards by which the debt could be satisfied. John Canynges states that after the making of the bond, and after the death of Thomas Canynges, namely 27 August 1463, in London, in the parish of St Katherine Cree in Aldgate ward, WS, released and quitclaimed to Elizabeth, as executor of TC, all actions and suits outstanding between them.

Pleading: WS states that his plea should continue, as against the plea of Cammell, protesting that TC did not make William Canynges his executor, states that William Canynges did not administer any goods formerly of TC after his death. Enquiry by country. Concerning the plea of JY, WS states that on the day of his original writ, 20 May 1466, JY had various goods formerly of TC at Warminster in Wiltshire, still in his hands and not administered, by which he could have been satisfied of the said debt. Enquiry by country. And concerning the release, he states that this release is not of his making. Enquiry by country. Concerning the issues between the plaintiff and JC and Cammell, sheriff of London to have jury here at octave of Trinity. On the other, sheriff of Wiltshire to have jury here at same term.

Postea text: [on CP 40/821, rot 447] Further licence to imparl, to quindene of Easter 1467.

Postea text: [on CP 40/823, rot 397] Sheriff of London did not send writ, to octave of Martinmas 1467.

Postea text: Process continued, jury in respite to octave of the Purification 1469, nisi prius they come before Robert Danby, CJCP, at St Martin le Grand on 30 January 1469. On this day came WS and JC and WC by attorneys, RD sent record that on that day, before RD and Thomas Danby, parties came, some jurors came, some did not come, triers state that the jurors who appeared do not have sufficient in the said ward, nor do they live in the same ward. Jury in respite to quindene of Easter. Sheriff decem tales.

Pleading: John Bredhill, rector of the church of St Nicholas in Calais, diocese of Therouanne ('Morinensis'), states that on 30 November 1463, in London, William Mathewe made a bond with him in £40, payable at Easter then next, but has not paid, to his damage of £20 [40m in later continuation]. He shows the bond in court.

Pleading: WM granted licence to imparl to octave of Hilary.

Pleading: [continued at Easter 1467, rot 382] WM asks to hear the bond and the endorsement, and these are read in court. The condition of the bond is such that if [Ralph] should make to JB or his attorney a true and faithful account of all receipts and payments to the church of St Nicholas, Calais at Easter and Michaelmas, at the church of All Hallows the Great ('ad Fenum') in London, for three years after the date of this bond, and if he should pay all the surpluses in accordance with an agreement made between them, then the bond shall be cancelled. Having heard this, WM offers in court the other part of the indenture made between Ralph and JB specified in the endorsement, sealed with the seal of JB [recited in full, in Latin]. This indenture states that JB makes Ralph, chaplain of Calais, his proctor to administer the church of St Nicholas, Calais, and to receive all tithes etc pertaining to the church, according to letters of appointment, and it is also agreed that RH may occupy the said church for three years after the date of this agreement, rendering account to the rector or his attorney at Easter and Michaelmas each year at All Hallows the Great in London, and paying any surpluses, and for this JB agrees to pay Ralph 5m per year for his services, providing always that Ralph grant to JB by the present letters that he shall do his best to get the said rector inducted into this church before Easter then next. For this, JB promises to pay Ralph 10m for his labour immediately after he is inducted into the said church, and if Ralph is not able to get JB inducted into that church by the said Easter, then RH shall have and occupy the church in the manner specified above for the whole three years. Sealed on 30 November ('St Andrew') 1463. WM states that JB ought not have his action, since at the said feast of Easter 1464, in the church of All Hallows the Great in Dowgate ward, London, Ralph offered JB a faithful account of all receipts and payments according to the agreement, and paid to him 20s, this being the surplus for the period from the said 30 November to the said Easter, and he was prepared to do this as agreed for the next two years, but neither JB nor his attorney appeared to hear the account on this day or any others.

Pleading: JB, protesting that Ralph received £20 from the income of the church between 30 November 1463 and Easter 1464 for which he did not account, states that Ralph received various sums of money from the oblations etc of the said church in the parish of St Nicholas [Shambles], Farringdon Within ward in London, namely 4d from the hand of James Dayvell and 4d from the hand of Richard Rovet, for which Ralph never made any account.

Pleading: WM states that Ralph fully accounted with JB at the said feast of Easter in the church of All Hallows the Great concerning these sums and others according to the terms of the agreement. Enquiry by country, jury here at quindene of Trinity.

Writ type: Trespass (force and arms)
Damages claimed: £20
Damages awarded: 100s
Case type: Housebreaking

Pleading: John Norton states that on 12 August 1466, Emma Wodecote forcibly broke his close and house at Porters in the parish of Barking, Essex, against the peace and to his damage of £20.

Pleading: EW granted licence to imparl to octave of Hilary, with assent of plaintiff. Pledges named for defendant.

Pleading: [continued at Hilary 1468, rot 347] EW denies force and arms; parties on country. Concerning the breaking of the close and house, EW states that JN ought not have his action, as this close and house are a messuage and adjacent garden in Porters of which a certain Solomon ['Salamon'] Porter was seised in his demesne as of fee long before the alleged trespass. Thus seised, he gave it to his daughter Isabel and the heirs of her body, by virtue of which grant she was seised in her demesne as of fee tail. Isabel then died, and the property descended to EW, as kinswoman and heir of Isabel, namely daughter of Robert, son of John, son of Isabel, and she was then seised. JN, claiming the property by virtue of a deed of enfeoffment made to him and his heirs by Solomon Porter before the gift to Isabel, when in fact none of this property ought to relate to that enfeoffment, entered the tenements upon the possession of Emma. Emma then re-entered, this being the alleged trespass, and she seeks judgment.

Pleading: JN, protesting that Emma is not kinswoman and heir of Isabel, and not acknowledging anything said by Emma, states that, concerning the messuage, long after the supposed gift a certain Richard Norton, his grandfather, was seised of this messuage in his demesne as of fee, and he died thus seised, and it passed to JN, as son of Richard, son of the said RN. JN thus entered, and was seised in his demesne as of fee until Emma entered as claimed. He seeks judgment. Concerning the garden, JN states that the garden contains one acre of land, and that his grandfather RN was seised in his demesne as of fee, and died thus seised, and JN was again seised until Emma entered. Salamon did not give the property to his daughter Isabel as claimed by EW.

Pleading: EW, not acknowledging anything said by JN, states that long before the death of RN, grandfather of JN, at Barking, she married a certain John Porter, and then RN died, and she was in the coverture of her husband JP, then still living. JP then died, and she, as kinswoman and heir of Solomon, entered the messuage. Concerning the garden, she states that Solomon gave the garden to Isabel and her heirs, as she has stated. Parties on country. Concerning the trespass in the messuage, JN states that at the time of his grandfather's death Emma was a single woman and not under the coverture of JP as she claims. Enquiry by country, jury here at quindene of Easter.

Postea text: 4 further licences to imparl, to octave of Hilary 1468.

Postea text: [on CP 40/826, rot 347] Process continued, jury in respite to octave of St John the Baptist 1468.

Postea text: On this day, JN came by attorney, Emma did not come, in default. Since sureties, present elsewhere in this court, were to have Emma here at the octave of Hilary 1467, as appears on the roll for Michaelmas 1466 rot 525, and so on until judgment, pledges are to be taken. Jury came, said that Solomon did not give the garden to Isabel, and that at the time of the death of RN the grandfather Emma was not married and not under the coverture of any man. Damages assigned at 100s. Order that JN recover damages, Emma to be taken.

Pleading: RL states that he ought not owe these debts, as he made, sealed and delivered this bond to Thomas Hilles to be delivered to JA only on condition that John JA make to Katherine, daughter of the wife of RL, sufficient enfeoffment or estate for the term of her life before the said Easter in lands and tenements in Bury St Edmunds and 'Stotefeld' to an annual value of 20m, and not otherwise. RL states that JA did not make this enfeoffment, but TH nevertheless delivered the bond to JA. Therefore this bond, delivered without the enfeoffment being made, is not of his making. Parties on country, jury here at octave of Hilary. Bond in custody of John Fogge.

Postea text: Sheriff did not send writ, to quindene of Easter 1467.

Case notes: Similar, possibly same case on CP 40/820, rot 369d. Date of bond probably incorrectly cited, as payment dates 10 years earlier, and payment dates match those appearing on earlier enrolment.

Case type: Loan; Taking of goods

Pleading: Ralph Haywode and Richard Haywode state that on 1 June 1463, at Kingston upon Thames, Thomas Defford and John Somur, together with John Defford and Richard Lamvale, forcibly took and carried away five tuns of red wine called 'coleridrose', two tuns of red wine called 'claretwyn', and two tuns of white wine belonging to them worth £40, against the peace and to their damage of 100m.

Pleading: TD and JS deny force and arms, and acting against the peace. Parties on country. Concerning the rest, they say that the plaintiffs ought not maintain their action, since long before the alleged trespass, Richard Haywode, in the parish of St Leonard Eastcheap, Bridge ward in London, borrowed £18 from TD, and for security for payment of this £18 he pledged this wine to TD, and thus TD was in possession of the wine until, before the time of the alleged trespass, the plaintiffs took and carried the wine away out of TD's possession in the said parish in London and took it to Kingston upon Thames. They were then in possession until TD and JS, with TD's servants, took the wine back into TD's possessions, as the debt had not been paid, as seemed right, this being the alleged trespass.

Pleading: The plaintiffs, protesting that Richard H did not borrow this £18 from TD or any money as claimed, and did not pledge the wine to TD as surety, state that before the alleged trespass TD was in possession of the wine, and after the alleged pledge TD, by his servant Patrick Faunt, at Kingston, delivered the wine to the plaintiffs as their own wine, and they were thus in possession until the defendants forcibly took it away, as claimed.

Pleading: The defendants repeat that Richard H pledged the wine to TD as security for a loan of £18, by virtue of which TD was in possession as claimed. He did not deliver it to the plaintiffs as they have claimed.

Pleading: The plaintiffs state that TD, after the pledge, delivered the wine to them as claimed. Enquiry by country, sheriff of Surrey to have jury here at octave of Hilary.

Pleading: AC denies force and arms and acting against the peace. Parties on country. Concerning the rest, he states that JH ought not maintain his action, since before the alleged trespass, at Salisbury, JH owed AC six pieces of 'crestcloth', and thus on the day of the alleged trespass JH delivered to AC the said 5 cloths as a pledge for these six pieces of 'crestcloth', on the condition that if he delivered the 'crestcloth' to AC within 8 days, or pay him £11 for them, then AC would return the five pieces of cloth; otherwise AC would retain them as his own property. Consequently, AC took and carried off this cloth, as seemed right. He states that JH never delivered the six pieces of 'crestcloth' to him, nor did he pay the £11 according to the form of the condition.

Pleading: JH, not acknowledging anything said by AC, states that on the said day AC forcibly took the cloth away as alleged.

Pleading: The prior of St Mary Overy [Southwark] states that a certain Henry Werkworth, formerly prior of St Mary Overy, predecessor of the plaintiff, was seised in right of his church of an annual rent of 24s from the hands of a certain William Grace, then parson of the church of Holy Trinity the Less in London, predecessor of the defendant, as all previous priors had been from all previous parsons since time immemorial, payable at Easter, St John the Baptist, Michaelmas and Christmas in equal portions in the parish of Holy Trinity the Less, Queenhithe ward. The former prior held this until 25 years [sic] before the plaintiff's original writ, namely 4 January 1466, when the present parson withdrew the rent from the present prior [sic], to his damage of £40.

Pleading: RW states that Henry, prior of St Mary Overy, is the patron of his church of Holy Trinity the Less, and Thomas, bishop of London, is ordinary of the church. He states that he is parson of the church, inducted by the bishop at the presentation of the prior, and that when he was appointed he found the church discharged of this annual rent. He states that he is unable to burden or unburden his church of this annual rent without the patron and ordinary. He therefore seeks their assistance, and they are summoned to be here at the octave of Hilary.
