Abstract

Kyrle complained that Wellington had given him the lie. Process was granted on 16 October 1637, and the cause appeared before Lord Maltravers and the earl of Bath on 31 October and 18 November; but no further proceedings survive.

Initial proceedings

3/134, Petition to Arundel

'The petitioner hath bene much abused by many evill and base words given against him by one John Wellington of Much Markley yeoman, Wellington without any provocation saying amongst other base speeches in a very opprobrious manner that the petitioner did lye.'

Petitioned that Wellington be brought to answer.

Having already obtained permission from Maltravers, Duck desired Dethick to grant process, 16 October 1637.

16 October 1637

Bound to appear 'in the Court in the painted Chamber within the Pallace of Westminster'.

Signed by John Kyrle.

Sealed, subscribed and delivered in the presence of Humphrey Terrick.

Summary of proceedings

The cause appeared before Lord Maltravers and the earl of Bath on 31 October and 18 November 1637, with Dr Duck as counsel.

Notes

Sir John Kyrle of Much Marcle, co. Hereford, bart, married Sibell, daughter of Philip Scudamore. He was created baronet on 17 May 1627, and died in 1650. Effigies of him and his wife were sculpted at an altar tomb at Much Marcle.
