George Smith of Henlow, co. Bedford, gent v Edward Kent the elder of the same, gent

June 1637 - November 1638

Abstract

The origin and result of Smith's complaint against Kent remain unknown. Smith's bond was given on 29 June 1637 and his libel was presented by Dr Eden on 12 February 1638. The case was still being heard on 6 November 1638, but no further proceedings survive.

Sealed, subscribed and delivered in the presence of Humphrey Terrick.

Summary of proceedings

Dr Eden acted as counsel for Smyth and Dr Duck for Kent. On 12 February 1638 Kent was required to appear in accordance with his bond but Dr Duck appeared on his behalf. Dr Eden presented the libel. On 20 October 1638 Dr Eden had to prove the libel and send it to the commissioners. On 6 November the court was to hear the verdict upon the taxation of the cause at the petition of Dr Duck.

Notes

George Smyth of Henlow, co. Bedford, was the son of Thomas Smyth of Biggleswade, co. Bedford, esq, and Mary, daughter of Thomas Parratt of Shillington, co. Bedford. He married Margaret, daughter of Richard Balthrop of London. Edward Kent of Henlow, co. Bedford, was the son of John Kent of Aston, co. Hertford, and Mary, daughter of Thomas Saunders of co. Buckingham. He married Jane, daughter of John Fareclough of Weston, co. Hertford. Their eldest son was also named Edward Kent.
