716 WILLOUGHBY V NOBLE

Thomas Willoughby of Warminster, co. Wiltshire, gent v William Noble of Deverill, co. Wiltshire

November 1638 - February 1639

Abstract

Dr Duck presented the libel on Willoughby's behalf in November 1638 and in February 1639 sought a commission to hear witnesses; however, the cause and result of Willoughby's complaint against Noble remain unknown.

Summary of proceedings

Dr Duck acted as counsel for Willoughby and Dr Eden for Noble. On 6 November Noble was warned to appear in person. Dr Duck was to give the libel and Dr Eden was to respond at the next sitting. Noble was to give bond to the King. On 20 November Dr Eden had to respond to the libel. On 28 January and 9 February 1639 Duck moved to prove the libel and sought a commission for examining witnesses.

Notes

There were several Thomas Willoughbies entered in the Visitation of Wiltshire in 1623: G. D. Squibb (ed.), Wiltshire Visitation Pedigrees, 1623 (Publications of the Harleian Society, 105 and 106, 1954), pp. 217, 218, 239.

Deverill was either Brixton Deverill, Hill Deverill, Kingston Deverill, Longbridge Deverill, or Monkton Deverill, a closely clustered group of parishes just south of Warminster.
