MEMORANDA OF THE KING'S PARLIAMENT AT WESTMINSTER AT THE OCTAVE OF THE NATIVITY OF THE BLESSED MARY AT THE END OF THE THIRTY-THIRD YEAR.

Dominus rex mandavit breve suum [Johanni] de Kyrkeby, clerico, in hec verba: [Arrangements for the reception of petitions].
The lord king sent his writ to John of Kirkby, clerk, in these words:
'Edwardus Dei gracia etc. dilecto clerico suo Johanni de Kyrkeby salutem. Quia ordinavimus quod vos et dilecti clerici nostri Gilbertus de Roubr', magister Johannes de Cadomo, et magister Johannes Boussh' recipiatis omnes peticiones quas liberari continget in instanti parliamento nostro quod incipiet apud Westm' in octabis Nativitatis Beate Marie Virginis proximo jam venturis, vobis mandamus, firmiter injungentes, quod, omnibus aliis pretermissis, London' cum omni celeritate qua poteritis personaliter accedatis, et una cum clericis nostris predictis peticiones hujusmodi recipiatis ibidem exnunc de die in diem usque ad certum diem post festum Sancti Michaelis futurum proximo, et non ultra. Et hoc nullatenus omittatis. Teste me ipso apud Laufard [sic: read 'Laufar'] , .iiij. die Semtembris [sic: read 'Septembris'] , anno regni nostri tricesimo tercio. 'Edward by the grace of God etc. to his beloved clerk John of Kirkby, greetings. Because we have ordained that you and our beloved clerks Gilbert of Rothbury, master John de Caen, and master John Bush are to receive all petitions which may be delivered in our approaching parliament which will begin at Westminster at the octave of the Nativity of the Blessed Virgin Mary next, we command you, firmly enjoining you that, putting aside all other things, you are to come to London in person with all possible speed, and together with our aforesaid clerks receive these petitions there henceforth every day until a certain day after the feast of Michaelmas next, and not afterwards. And you are not to neglect to do this in any way. Witness myself at Laver, 4 September, in the thirty-third year of our reign.

Postea die lune proximo ante festum Sancti Michaelis facta fuit quedam proclamacio in civitate London' per preceptum regis in hec verba: Afterwards on the Monday before the feast of Michaelmas a certain proclamation was made in the city of London, at the king's command, in these words:

'Nous vous feisons a savoir de par nostre seignur le roi qil ad volu et comaundez qe totes manere de gentz qi ount peticions a bailler a cest parlement livrent lour peticions a sir Gilberd de Robir', a mestre Johan de Cam, a sir Johan de Kirkeby et a mestre Johan Boussh', ou a aucun de eux, entre ci ele [sic: read 'e le'] diemeigne procheyn apres cest Seint Michel, a houre de solail resconsaunt, car apres cel houre ad il defendu qe peticioun ne soit resceu de nuli.' Ceste crie fust fait en Loundres le lundi proschein avaunt la Seint Michel. 'We make it known to you, on behalf of our lord the king, that he has willed and commanded that all manner of people who have petitions to deliver at this parliament submit their petitions to lord Gilbert of Rothbury, to master John de Caen, to lord John of Kirkby and to master John Bush, or to any one of them, between now and the Sunday following this Michaelmas, at sunset, because after that time he has forbidden any petition to be received from anyone.' This proclamation was made in London on the Monday before Michaelmas.

Milites Templarii. [Petition of the Templars relating to the payment of a rent out of the county farm of Cornwall and the transfer of a market from Rothley to Gaddesby].
Ad peticionem magistri et fratrum Milicie Templi, petencium quod thesaurarius et barones de scaccario regis habeant breve de cancellaria ad scrutandum rotulos de scaccario, si una marca, quam predecessores regis nunc de comitatu Cornubie eisdem magistro et fratribus concesserunt in perpetuam elemosinam, sit super aliquem compotum vicecomiti allocata, et ad faciendum ulterius inde quod de jure fuerit faciendum, et eciam petencium quod, cum rex eis per cartam suam concesserit mercatum in manerio suo de Rotelegh', et pro eo [quod] idem mercatum eis utile non fuit, alias supplicarunt regi quod idem mercatum de gracia sua mutaret usque Gaddesby infra procinctum dicte ville de Rothelegh', quod rex eis concessit, et pro magno feodo sigilli carta de concessione non dum fuit prosecuta, unde petunt nunc cartam regis de concessione predicta, ita responsum est ad primam peticionem: habeant breve de cancellaria thesaurario et baronibus de scaccario quod, scrutatis rotulo [sic: read 'rotulis'] et memorandis scaccarii, [col. b] si compertum sit quod predicta marca debeatur, et quod eam hactenus singulis annis receperunt, tunc inde certificent regem etc. Ad secundam: videatur [editorial note: Altered from 'provideatur'] concessio alias eis per regem facta de mercato mutando [editorial note: The last letter of this word has been altered] , et si inveniatur illa peticio < sic > indossata, tunc habeant cartam de hujusmodi mercato secundum concessionem prius inde factam. Knights Templar. To the petition of the master and brothers of the Order of the Temple, requesting that the treasurer and barons of the king's exchequer might have a writ of chancery to search the rolls of the exchequer to find if a mark, which the predecessors of the present king granted from the county of Cornwall to the same master and brothers in perpetual alms, is allowed to the sheriff in any account, and to do further on the matter what is rightly to be done, and also requesting that, whereas the king has granted them by his charter a market in their manor of Rothley, and because the same market was not useful to them, they previously requested the king to change the same market, of his grace, to Gaddesby within the boundaries of the said township of Rothley, which the king granted to them, and because of the great fee of the seal the charter of grant has not yet been sued out, for which reason they now request the king's charter of the aforesaid grant, this answer is given to the first petition: they are to have a writ of chancery to the treasurer and barons of the exchequer that, when they have searched the rolls and memoranda of the exchequer, [col. b] if it is found that the aforesaid mark is owed, and that they have hitherto received it every year, then the king is to be informed of this etc. To the second: the grant previously made to them by the king about moving the market is to be examined, and if that petition is found to be endorsed in this way, then they are to have a charter for this market in accordance with the grant previously made on the matter.
Morteyn. [Petition of Roger de Morteyn and his wife Isabel for a fairer apportionment of responsibility for the debts of William of Louth, late bishop of Ely, between Isabel and Roger and Isabel's coheir, William Tuchet].
Ad peticionem Rogeri de Morteyn et Isabelle uxoris [editorial note: Altered from 'uxori' by a later hand] sue, unius heredum Willelmi de Luda nuper Eliensis episcopi defuncti, petencium remedium super eo quod, ubi non teneant quartem [sic: read 'quartam'] partem terrarum que dictus episcopus adquisivit in vita sua, pro eo quod Willelmus Tuchet, alter heredum ipsius episcopi, conjunctim feoffatus fuit cum eodem episcopo de majori parte terre quam idem episcopus adquisivit etc., idem Willelmus Tuchet [memb. 118, verso] nuper veniens ad scaccarium dedit intelligi thesaurario et baronibus ibidem quod idem Rogerus et Isabella equaliter tenent medietatem terrarum que fuerunt predicti defuncti, per quam quidem suggestionem iidem Rogerus et Isabella onerantur ad dictam [sic: read 'dictum'] scaccarium de medietate omnium debitorum que dictus defunctus regi debuit die quo obiit, ac si medietatem terrarum predictarum tenerent, quod omnes terre, < que per mortem dicti episcopi tam eis quam dicto Willelmo [Touchet] descenderunt, tam videlicet terre ille > unde dictus Willelmus Tuchet conjunctim feoffatus existit quam alie terre, extendantur, et unusquisque oneretur de debitis predictis secundum porcionem quam tenet, et dicti Rogerus et Isabella petunt quod interim habeant respectum de .cxxviij.li. .iiij. s. .v. d. obolo, que per summonicionem de scaccario et brevia exiguntur, quousque terre predicte extendantur et debita predicta aporcionata etc., ita responsum est: mandetur per breve de cancellaria thesaurario et baronibus de scaccario quod inquirant de omnibus terris et tenementis que magister Willelmus de Luda nuper Eliensis episcopus tenuit in feodo die quo obiit, in quorumcumque manibus devenerint, et ea extendi faciant, et singulos tenentes de terris predictis onerari faciant de debitis que idem regi debent secundum porcionem quam inde tenent etc. Et interim Rogerus et Isabella uxor ejus, qui tenent partem terrarum predictarum, habeant respectum etc. Morteyn. To the petition of Roger de Morteyn and Isabel his wife, one of the heirs of William of Louth, formerly bishop of Ely, deceased, requesting a remedy for the fact that, whereas they do not hold a quarter of the lands which the said bishop acquired in his life, because William Tuchet, the other heir of the same bishop, was enfeoffed jointly with the same bishop with the greater part of the land which the same bishop acquired etc., the same William Tuchet, [memb. 118, verso] recently appearing at the exchequer, gave the treasure and barons there to understand that the same Roger and Isabel in equal measure hold half the lands that belonged to the aforesaid deceased, through which information the same Roger and Isabel are burdened at the said exchequer with half of all the debts which the said deceased owed the king on the day on which he died, as if they held half the aforesaid lands: that all the lands which descended both to them and to the said William Touchet through the death of the said bishop, that is both those lands with which the said William Tuchet was jointly enfeoffed and the other lands, might be valued, and each party burdened with the aforesaid debts according to the share which he holds, and the said Roger and Isabel request that in the meantime they might enjoy a respite from the £128 4s. 5d. halfpenny which are demanded from them through a summons from the exchequer and through writs, until the aforesaid lands are valued and the aforesaid debts apportioned etc., this answer is given: the treasurer and barons of the exchequer are to be ordered by a writ of chancery to enquire into all the lands and tenements which master William of Louth, formerly bishop of Ely, held in fee on the day on which he died, into whomsoever's hands they have come, and to have them valued, and to have each of the tenants of the aforesaid lands burdened with the debts which they owe the king, according to the share which they hold of them etc. And in the meantime Roger and Isabel his wife, who hold part of the aforesaid lands, are to have a respite etc.

Mortimer, Vivon', Beauchaump. [Petition of Agatha de Mortimer, Joan de Vivonia and Cecily de Beauchamp claiming shares in county Kildare and the associated revenues].
Ad peticionem Agathe de Mortuo Mari, Johanne de Vivon, et Cecilie de Bello Campo, petencium quod thesaurarius et barones de scaccario eis reddant propartes suas de comitatu de Kyldare secundum recordum et processum eis missum per breve regis etc., et eciam petencium quod, quia quando propars facta fuit inter heredes comitis Marescalli in Anglia, Vallia, et Hibernia, tunc fuerunt proficua comitatus de Kyldare, ut de sigillo cancellare [sic: read 'cancellarie'] , justiciarie in itinere placitorum et [p. i-183][col. a] perquisitorum et omnes alii exitus partiti inter heredes ad certum valorem, unde ipse heredes pacifice seisite fuerunt, videlicet quelibet de proparte sua, quousque Willelmus de Vescy, filius et heres Agnetis de Vescy, una heredum etc., injuste ejecit suos participes [editorial note: Altered from 'proparticipes'] de propartibus suis, et in continuando injuriam suam feoffavit regem de parte sua et de aliis propartibus quas injuste occupaverat, et licet videtur consilio regis quod sit ad commodum ipsius regis quod dictum sigillum amoveatur, et justiciaria et alia adnectentur comitatui, alie participes tamen que injuste expulse sunt non debent exheredari desicut ipse [editorial note: altered from 'ipsi' by a later hand] non forisfacerent jus suum etc. velit rex eis inde satisfacere in racionabili valore etc. cum ipse accionem suam haberent versus dictum Willelmum, si superstes esset etc., ita responsum est ad istas duas peticiones: sequantur coram Rogero le Brakanson [sic: read 'Brabanson'] et sociis suis, et illi faciant quod justum fuerit, per consilium thesaurarii et cancellarii et aliorum de consilio, si neccesse fuerit. Mortimer, Vivonia, Beauchaump. To the petition of Agatha de Mortimer, Joan de Vivonia, and Cecily de Beauchamp, requesting that the treasurer and barons of the exchequer hand over to them their shares of the county of Kildare, in accordance with the record and process sent to them by a writ of the king etc., and also requesting that whereas, when the division was made among the heirs of the earl Marshal in England, Wales and Ireland, the profits at that time from the county of Kildare, such as from the seal of the chancery, from the office of justice in Eyre and [p. i-183][col. a] from perquisites and all other issues, were divided among the heirs at a certain valuation, of which the same heirs were in peaceful seisin, that is, each one of her share, until William de Vescy, the son and heir of Agnes de Vescy one of the heirs etc. unjustly expelled his co-parceners from their shares, and continuing his wrong enfeoffed the king with his share and with the other shares which he had unjustly accroached, and although it seems to the king's council that it is to the advantage of the same king that the said seal be removed, and the office of justice and other things annexed to the county, the other parceners who were unjustly expelled ought not to be disinherited, inasmuch as they did not forfeit their right etc. the king might be pleased to give them satisfaction for this at a reasonable value etc. since they would have their action against the said William, if he were still alive etc., this answer is given to these two petitions: they are to sue before Roger le Brabanson and his colleagues, and they are to do what is just, with the advice of the treasurer and chancellor and other members of the council, if it is necessary.
Brewose. [Petition of William de Braose asking permission to pay his debts to the king by instalments].
Ad peticionem Willelmi de Brewouse, petentis quod quia multum gravatus extitit in servicio < regis, quod > rex velit atterminare debita sua, unde summa est .ccc. marcarum, ut asserit, [col. b] ita responsum est: atterminetur juxta discrecionem thesaurarii et baronum. Braose. To the petition of William de Braose, requesting that because he is much burdened in the king's service, the king might be pleased to set terms for the payment of his debts, the sum of which is 300 marks, as he claims, [col. b] this answer is given: he is to be given terms according to the discretion of the treasurer and barons.

The ordinance concerning conspirators. Conspirators are those who make alliances among themselves by oath, agreement, or through some other bond, that each will help and support what the other undertakes in falsely and maliciously indicting or causing to be indicted, or falsely acquitting, people, or falsely initiating or supporting pleas, and also those who have children under age appeal people of felonies, through which they are imprisoned and greatly harmed, and those who retain men of their area by robes or payments, to support their evil undertakings and to suppress the truth, both those who take and those who give, and stewards and bailiffs of great lords who through lordship, office or power undertake to maintain or uphold pleas or disputes for parties, other that those which concern the estate of their [memb. 119] lords or themselves.
Ista ordinacio et finalis diffinicio conspiratorum facta fuit et finaliter concordata per regem et consilium suum in hoc parliamento etc. Et ordinatum est quod justiciarii assignati ad diversas transgressiones et felonias in singulis comitatibus Anglie audiendas et terminandas [editorial note: Altered from 'terminendas' by a later hand] habeant inde transcriptum etc. This ordinance and final definition of conspirators was made and definitively agreed by the king and his council in this parliament etc. And it is ordained that the justices appointed to hear and determine various trespasses and felonies in each county of England are to have a transcript of it etc.
