Feb. 4.
Westminster.
To William Thirnynge and Robert Tirwhyt justices of assize in Lincolnshire. Order, upon petition of the dean and chapter of St. Mary Lincoln, to proceed to rendering of judgment in an assize of novel disseisin concerning 10l. of rent in Torkesey by them arraigned against Roger prior of Torkesey, the king's former writ and the allegation of the defendant notwithstanding; as upon their petition, shewing that the plaintiffs appeared by John Yerdeburgh their attorney, that the defendant in person said that the tenements whereof they suggest that the rent arises are the site of his house, 498 acres of land and fifty tofts in Torkesey, and in his answer as tenant thereof further said that by letters patent, dated Westminster 20 October 1 Henry IV, the king viewed and confirmed a charter of 30 September 21 Henry [III], whereby that king gave in almoin to the then prior of Torkesey and the canons and to their heirs the said site, land and tofts, for which they used to render to that king 4l. 9s. a year, rendering 10l. a year by the hands of the keeper of the king's demesnes for the time being for all service, custom and demand save the tallage of their men so often as the king and his heirs should raise it of his men of that manor, even as the now prior and convent and their predecessors did heretofore hold the same, craving judgment whether the justices would proceed without advising the king, and craving his aid, the king commanded the justices to proceed to take that assize the allegation aforesaid notwithstanding, so that they should not proceed to rendering of judgment without advising him; and now it is shewn the king that it was found by the assize so taken that the defendant did unlawfully and without a judgment disseise the plaintiffs of the said rent, but that because of the express words of the writ aforesaid the justices have deferred to render judgment.

Order under a pain of 400l., for particular causes laid before the king and council, to leave all else and, ceasing every excuse, to be in person before the king and council in the quinzaine of Easter next to answer touching what shall be laid against him on behalf of the king and of Michael de Mane merchant of Pemounde. By C.

Order under a pain of 400l. to be before the king and council (as above), in order to shew cause wherefore he ought not to answer to the king for a pain of 300l., and to answer touching what shall be laid against him (as above); as on the king's behalf the said John was lately by John Michell serjeant at arms directed under a pain of 300l. to be before the king and council at a day past in order to answer as aforesaid, as John [Michell] has borne witness before the king and council, and took no heed to come at that day. To Walter Stokes, Simon de Beltoft, William Scorburgh, John Proktour of Barton, William 'of the Well of Killyngham,' Simon de Grymesby of Grymesby, William Bretoun, John de Gonby and William Leveryke and to the sheriff of Lincoln, lately appointed with Roger Flete of Gaynesburgh collectors in the parts of Lyndesey of two fifteenths granted to the king by the lords, great men and commons of the realm, and two tenths by the citizens and burgesses thereof, and of a subsidy to him granted for defence of the realm by the lords temporal in the parliament last holden at Coventre. Order to levy and answer for the same not awaiting the presence of the said Roger; as for particular causes the king has discharged him of the office of levying one fifteenth and tenth which is in arrear and the said subsidy.
