To the priors and brethren of the realm of Englland of the Carthusian order. Indult, at their recent petition (containing that in times past there were wont to be celebrated in their houses the feasts of SS. Edward, Edmund and Oswald, Kings [and Martyrs], the Translation of St. Thomas the Martyr, SS. Hugh [and] W[o]lstan, Bishops and Confessors, and Edward, King and Confessor, natives of the said realm and inscribed in the catalogue of saints, of the Visitation of the Virgin Mary and its octave, and St. George the Martyr, and also on every Saturday, when other feasts did not prevent, a special commemoration of the said Virgin, with singing; but that divers visitors coming from parts in which perhaps the said feasts are not celebrated, and wishing to assimilate the ordinances, ceremonies and observances of feasts in the said houses to their own rites, have caused the offices and histories which the said priors and brethren were wont to use on the said feasts to be deleted from their books and breviaries, and have inhibited them to perform the said office of Our Lady on Saturdays, wherefore the devotion of the faithful daily waxes cold and manifold scandals have arisen; and adding that it would be very becoming that they should not differ from other religious of the realm in celebrations of feasts etc.) that, the ceremonies and rites of the order being observed, they too may celebrate the feasts of the said saints at the times when other religious of the realm do so, etc. as above, they and their houses being hereby restored to the state in which they were before the said deletion and inhibition. To the abbots of St. John the Evangelist's, Tuam, and St. Mary's, Knockmoy (Collis victorie), in the diocese of Tuam, and the archdeacon of Tuam. Mandate—the pope having learned that the rectory of Burges Keara alias Newtown (Villanova) in the diocese of Tuam alias Mayo, has been so long void, because David de Angulo held it for more than a year without being ordained priest and without dispensation, that its collation lapsed to the apostolic see, although he has unduly detained possession for about fifteen years since the said lapse without any right; and seeing that, as the recent petition of the abbot and convent of the Augustinian monastery of Holy Trinity, Ballintober (Sancte Trinitatis Ville Fontis Sancti Patricii), in the said diocese contained, the fruits etc. of the said monastery, on account of frequent attacks of depraved men and divers other sinister events in those parts, are very much diminished, and that Philip de Standona, captain of the nation of Standon, gave to them the patronage of the said rectory (which gift was confirmed by authority of the ordinary), value not exceeding 10 marks sterling, that of the said monastery not exceeding 20—to summon the said David and others concerned, and if they find the facts to be as stated, to approve and confirm by papal authority the said gift, and, if the captain of the said nation for the time being consent, to appropriate in perpetuity the said rectory, whether void as above or in any other way, to the said monastery, removing the said David and any other unlawful detainer. The recent petition of the priest of the chapel of Menethesloyn and of the parishioners of the chapel of Bedwellte in the diocese of Llandaff, which chapels depend on the parish church of Basleg in the said diocese, contained that (on its being set forth on their behalf to the late John, bishop of Llandaff, that although the said parishioners [of Bedwellte] were wont to hear masses and other divine offices in the chapel of Menethesloyn and receive the sacraments and sacramentals from its chaplain, they could not, on account of the great distance between the said places [of Bedwellte and Menethesloyn], of floods and the breaking of bridges, and of other hindrances, especially in winter, go to the said chapel of Menethesloyn, nor the chaplain of Menethesloyn go to them) the said bishop granted to them, with consent of the dean and chapter of Llandaff, that they might choose a priest or chaplain, resident within the bounds of Bedwellte, to celebrate divine offices in the chapel of that place and administer to them sacraments and sacramentals, and that such chaplain should agree with the bishop's proctors or farmers for his keep and stipend etc. from the fruits etc., belonging to the episcopal mensa, of the said chapel of Bedwellte, which fruits etc. the same bishop gave, assigned and granted thenceforth in perpetuity, in accordance with the said agreement, to the said chaplain and his successors [the chaplains] of the said chapel of Bedwellte. Perpetual exemption—at the recent petition of Henry, king of England, the patron, setting forth the injury to the Cluniac priory of St. John the Apostle and Evangelist, Pontefract, in the diocese of York, of its subjection, dating from its foundation, to the priory or monastery of la Charité-sur-Loire (Caritaten.) in the diocese of Auxerre and the prior thereof, by reason of the excessive distance, and the fact that foreigners have at times been appointed to govern it—of the said priory and its prior and monks etc. from all superiority, jurisdiction etc. of the said priory of la Charité and its prior; with decree that on voidance the convent may freely and lawful elect or postulate a new prior, that such election or postulation shall be confirmed etc. by the apostolic see, and that the prior may admit and receive professions of the said order, and confer its habit, etc. Ad. fut. rei mem. Mandate—the pope having been informed by David Yoi (i.e. Joy), an Augustinian canon of St. John the Evangelist's, Tuam, that formerly Emundus Butiler, priest, of the diocese of Tuam, simoniacally bargained with John Mccabarrid, then rector of the ecclesiastical lands of Inismeoayn alias of Portmiean in the said diocese, that John should resign to him the said rectory, which is of the patronage of laymen, and that Emundus should pay him a sum of money; that John resigned to the late John, archbishop of Tuam, who admitted the resignation, and that Malachy Oconchubayt (rectius Oconchubayr), the patron, presented Emundus to the said archbishop, who instituted him, unabsolved, under pretext of which presentation and institution Emundus obtained the rectory and has detained it for about six years without any right and canonical title—if David will accuse Emundus before them, etc., as usual, to summon Emundus, and if they find the above to be true, to declare the said presentation and institution null, and in that event to grant the said rectory, which has cure and whose collation has lawfully lapsed to the apostolic see, value not exceeding 5 marks sterling, to David in commendam for life. To Thomas, abbot of the Augustinian monastery of Holy Trinity, Ballintober (Sancte Trinitatis Ville Fontis Sancti Patricii), in the diocese of Tuam alias Mayo. Decree as below. Lately, on the above monastery becoming void (because provision had been made to Cornelius, then abbot of Holy Trinity, of the Cistercian monastery of St. Mary, Knockmoy (Collis victorie), in the diocese of Tuam, by vigour of letters of the present pope containing the condition that as soon as he obtained by vigour thereof possession of the administration of St. Mary's he should resign Holy Trinity), and the provision thereof being reserved to the pope, the pope by other letters (in which it was stated that the said Cornelius had, by vigour of the said provision, obtained possession of the administration of St. Mary's) ordered the bishop of Valva and two colleagues (if they found fit the above Thomas, who was a priest, had already made his profession of the said order of St. Augustine and was of illegitimate birth, being the son of a priest, professed of the said order of St. Augustine, and an unmarried woman) to make provision to him of Holy Trinity, the pope at the same time dispensing him on account of the said defect. At Thomas's recent petition (containing that Bartholomew, bishop of Valva, proceeding alone, made provision to him of Holy Trinity, and committed to him its administration; and adding that the said Cornelius at the time of the said mandate had not obtained the administration of St. Mary's, and that it (illud [monasterium Sancte Trinitatis]) became really void by the said prior provision) the pope hereby decrees that the said mandate and dispensation and the said posterior provision [by the bishop of Valva] and their consequences shall hold good from the present date, and that Thomas can and shall obtain possession of Holy Trinity by vigour thereof, even if it, whose yearly value does not exceed 40 marks sterling, be void by the said prior provision or in any other way, as if the said condition had not been mentioned in the said prior letters, and as if the said obtaining by Cornelius had not been mentioned in the said mandate. Decree as below. Lately the pope made provision to Laurence, [now] abbot of the Cistercian monastery of Culros in the diocese of Dunblane, of that monastery, void by the death without the Roman court of John, previous to which the provision had been reserved to the pope [Cal. Lett. VIII, p. 613]. Seeing that, as the pope has learned, Robert Wedale, a monk of the said monastery, intruding himself into the administration by lay power, opposing the said provision, obstinately sustaining a sentence of excommunication promulgated against him as a consequence of the said letters and published in the churches, and, finally adhering to the council of Basel after its transfer by the pope to Ferrara, has impetrated from that council letters under pretext of which he has continued to detain unlawful possession and prevent the said provision from taking effect, the pope (at the recent petition of the said abbot Laurence, who is a papal minor pentitentiary and a papal chaplain, containing that he fears lest in virtue of the faculty lately granted by the pope to James, bishop of St. Andrews, to absolve and rehabilitate etc. schismatics in Scotland desirous of returning to the pope's obedience, the said bishop, perhaps in ignorance of the said provision or by inadvertence, may to abbot Laurence's prejudice have absolved etc. the said Robert or may do so) hereby decrees that such absolutions etc., to be granted to Robert in virtue of the said faculty, shall not in the matter of the said monastery or its administration bring any prejudice to abbot Laurence nor any right to Robert, and that as far as otherwise concerns Robert and his state, they shall be without effect until he desists from his intrusion and possession, resigns possession of the administration, and restores to abbot Laurence the fruits which he has received, or at least makes an agreement with him about them, etc. Ad fut. rei mem. To the abbots of Kynlos, Cupar and Balmorinach, in the dioceses of Moray and St. Andrews. Mandate as below. Lately ... reserved to the pope, as in the preceding; and upon abbot Laurence setting forth that he feared to be hindered from obtaining peaceable possession of the administration etc, the pope ordered the above two abbots of Cupar and Balmorinach and another colleague [not here named] (fn. 8) to induct abbot Laurence or his proctor into corporal possession of the said administration etc. [Cal. Lett. VIII, p. 639.] Subsequently, as abbot Laurence's recent petition contained, the pope committed the cause which he proposed to bring against Robert Wedel (sic), a monk of the said monastery, who had intruded himself etc. and was unduly detaining possession, to Dominic, cardinal deacon of St. Mary's in Via Lata, who decreed that a citation should be executed against Robert in those parts, whilst William, abbot of Cupar and Richard, abbot of Balmorinach, proceeding to the execution of the said mandate, made divers processes by which they, inter alia, admonished Robert to resign the said monastery and the administration etc., under pain of excommunication etc. Seeing that, as the said petition added, Robert appealed to the council of Basel, after the pope had transferred it to Ferrara, and for three years after the execution of the said citation and of the said processes has not appeared in the Roman court to show his title, if any, the pope hereby calls up to himself the cause committed to the said cardinal and, extinguishing the suit, orders the above three abbots to proceed to the complete execution of the above mandate. Mandate (the pope having been informed by Patrick Omeagra, an Augustinian canon of Saegir Querayn in the diocese of Ossory, that Henry Olachmy, warden of the Augustinian monastery of Thomdonyn in the diocese of Killaloe, neglects to celebrate masses and other divine offices and otherwise live and behave decently; has publicly kept divers concubines by whom he has begotten offspring still alive; has nourished them and the said offspring from the goods of the said monastery, and in many other ways consumes the said goods; has simoniacally exacted and received things and goods for the reception of a person as a canon of the said monastery; and has committed other greater excesses and crimes [not here mentioned]) to summon Henry and others concerned, and after Patrick (who without mention of his illegitimacy, as the son of a deacon, professed of the said order and an unmarried woman, had himself tonsured) has accused him, and if they find true the above expressed, or at least such other greater excesses and crimes, or some of them, to deprive Henry, and in that event to collate and assign the said wardenship, conventual, dependent on no monastery or regular place, and value not exceeding 12 marks sterling, to Patrick, if found fit, transferring him from Saegir Querayn to Thomdonyn, and causing him to be received as a canon thereof. The pope hereby dispenses him, notwithstanding the said defect, to act as a clerk and be promoted to all, even holy orders and receive and retain the said wardenship. Mandate, at the recent petition of the abbot and convent of the Augustinian monastery of St. James by Nor[t]ham[p]ton in the diocese of Lincoln, to confirm the letters of dimission which Thomas, archbishop of Canterbury formerly granted to them, upon proof made before him of their titles and rights, in respect of the parish churches of Wotforde, Sprouton, Dirston (rectius Duston) with the chapel of St. Margaret the Virgin, Horton. Retheresthorp, Wekele, Guetsdon and Rosegate (rectius Bosegate), two parts of the church of Rode and the chapel of Hertroell (rectius Hertwell), yearly pensions, namely two marks from the vicarage of Wotforde, 40s. from the vicarage of Duston and the chapel of St. Margaret, and 20s. from the church of Lichebeulbe (rectius Licheberwe). (fn. 9) Mandate to absolve from excommunication incurred, imposing penance, and to rehabilitate John Styllynflete, a Hospitaller, seeing that, although in the statutes of the Hospital it is prescribed that no Hospitaller shall eat flesh on Wednesdays and milkmeats on Fridays, he, to whom the eating of fish is harmful [in itself and] also on account of the business which he has to transact in favour of the said order, has not observed, or has transgressed the said and other statutes of the order. They are moreover to dispense him from observing such of the statutes as the transaction of the said arduous business of the order makes it difficult for him to observe, provided that they be not a fundamental part of the rule. To the abbot of Knockmoy (Collis victorie) in the diocese of Tuam. Mandate as below. The recent petition of David and John, called Ymulcaeryll, brothers of the third order of St. Francis called [the order] of Penitence, priests, of the diocese of Clonfert, contained that the late Thomas, bishop of Clonfert, with consent of the dean, archdeacon and chapter of Clonfert, and licence of the perpetual vicar, gave in perpetual alms to them and other friars of the said order living conventually with them, present and future, the temple of the parish church of Cluacaen Caeryll in the said diocese, with chapels and cemetery etc., together with the third part of all the ecclesiastical land round about the said church, defined by the high road which goes eastward to the farm called Gortragairit Beg and returns southwards and northwards, mention being made of the points which define the parcel, namely Cros Colin, Guirti Nacrarit, Gortny trapuill, Acayada, Guirtti Mcneill, Mileoc Macanma, Caelognacroisi, Patt Beg with all meadows marshes and appurtenances as far as Ampuem, and reservation being made, by way of canonical portion, of the fourth part only of the funeral dues arising from outside parishes; that the said bishop gave them licence and authority to rebuild and convert the said temple into a monastery for the propagation of religion and the increase of divine worship, pro- vided that the vicar for the time being should be free to celebrate divine offices and administer the sacraments to the parishioners and, when absent, to entrust the same to a secular or regular priest; and that he forbade all the clergy and laity of the diocese and the parishioners of the said church to molest the said friars; and that subsequently John, the present bishop, made like gift etc. The pope therefore orders the above abbot, if he find the above gifts etc. lawful, to approve and confirm them (fn. 12). To the bishop of Valva. Mandate, as below. Lately the pope (upon being informed by John Ocany, [now] prior of the Augustinian priory of St. Mary, Inismorlocgawna, in the diocese of Ardagh, that Nemeas Offergail, sometime prior thereof, was a notorious fornicator and concubinary, having offspring alive, had alienated many of the said monastery's goods, was leading a very dissolute life, and had committed divers other excesses and crimes [not here named]) ordered the prior of SS. Taurin and Feighin's, Fore (Sanctorum Taurini et Fekini de Fauoria), in the diocese of Meath and two colleagues [not here named], if the said John would accuse Nemeas before them etc. as usual, to summon Nemeas etc., and if they found the above to be true, to deprive Nemeas, and in that event to collate and assign the said priory, which is conventual, to John, the pope's letters stating that the said priory does not depend on any monastery or other regular place. Afterwards, as John's recent petition contained, Thomas Yonge, prior of St. Mary's, Molynger, in the diocese of Meath, to whom William Croys, prior of SS. Taurin and Feighin's (after the said John had made before him the said accusation etc.) had given commission to act in his stead, proceeding to execution of the said letters, found the above statements true, and therefore by a definitive sentence deprived and removed Nemeas and made collation and provision to John. At the said petition (adding that Nemeas has objected to John, in the prosecution of the said cause, that John himself had been a notorious fornicator, gamester (fn. 13) and perjurer, and that John fears lest the said letters may be held surreptitious because the said priory depends on the monastery of Louth (Luua) of the said order in the diocese of Armagh, and is wont to be governed by canons thereof) the pope orders the above bishop to absolve John from his said crimes of concubinage and perjury and others, enjoining penance, and grants to John, in the event of such absolution, that the said letters and their consequences shall hold good from the date of these presents, as if they had stated that the said priory depends on Louth and is wont to be governed by canons thereof. After a first attempt at correction by changing 'Sancti' to 'Sanctorum.' the words 'hospitalis fratrum Sanctorum Johannis Euangeliste' are cancelled and over-written A[ntoniu]s, and in the margin is substituted 'domus siue hospitalis Sanctorum Johannis Baptiste et Johannis Euangeliste' with the note: Cassatum et correctum de mandato domini C[hristophori Garatoni] Ariminen. [episcopi], locumtenentis, An. de Adria. For insertion between 'Bathoniensis' and 'diocesis' are also written in the margin the words 'et Wellensis,' with the note: Correctum, ut supra, An. The corrected address thus stands: Hugom Grobham fratri domus siue hospitalis Sanctorum Johannis Baptiste et Johannis Euangeliste de Brygewater sub regula Sancti Augustini degentium, Bathoniensis et Wellensis diocesis, the omission of the word 'fratrum' giving a result more complimentary to the rule of St. Augustine than Antonius de Adria intended.
