Grant to dispense eight persons in England of illegitimate birth, the sons of an unmarried man and an unmarried woman, even if some be the sons of priests or married [persons] or be in any other wise illegitimately born, to be promoted to all, even holy orders, and hold a benefice with cure, and also those who have been already dispensed by papal authority on account of the said defect to be thus promoted and hold a benefice, to hold two benefices with or without cure, incompatible with one another, even if one of them be a canonry and prebend in a collegiate church, and to resign them, simply or for exchange, as often as they please. Faculty (seeing that Eugenius IV granted various faculties to Cornelius, bishop of Emly, to the end that the moneys which should be forthcoming from the said island should be distributed to certain pious uses and the repair of the church of St. Peter, and that the said bishop is said to have received very many sums of money from the said faculties, which he has not restored, and of which he has given no account to the papal camera nor to any other on its behalf) to compel the said bishop, by imprisonment, if necessary, and sequestration of his moveable goods and of the said moneys, to render an account of the said receipts, and, if he cannot do so, to give sufficient sureties for his appearance before the officers (gentibus) of the said camera, etc. Cum felicis recordacionis. To Patrick Yhonge, archdeacon of Whiteherne, M.A.Motu proprio reservation, for collation to him, who is of noble birth and has been sent by James, king of Scots, as ambassador to the pope, of the deanery of Dunkeld, a major dignity with cure. value not exceeding 40l. sterling, to become void by the pope's promotion of John, elect of Dunkeld, to that church, and by his consecration, which is to take place. He is hereby dispensed to hold it for life with his archdeaconry of Whiteherne, a non-major, non-elective dignity with cure, of the same value. Grant, as follows, for the province of Rouen, at the petition of Henry, king of England, set forth by his orator John, bishop of Coutances:—
(i) As to collations of benefices by way of expectation. Immediately after his accession the pope resolved to observe the ordinance made in the Council of Constance, namely that six months shall belong to [papal] expectants and six months to the ordinaries, with the addition that one of the months of the expectants and a month of the ordinaries shall be reserved to universities, lest students, whose increase the pope very greatly desires, be deprived of the hope of the reward of their studies and abandon them. The months of January, March. July, September and November shall belong to expectants, the other months [April, May, June, October and December] to the ordinaries, those of February (fn. 2) and August being left to the universities.
(ii) As to the mode of making provision. The students in the university of Caen shall draw up their roll and send it to the pope, who will give them letters according to the order given by them, so that the way to litigation shall be closed, and with the nullifying decree (fn. 3), so that none other but they shall be admitted to benefices which become void in the said two months, in virtue of any other provision. The pope will also take care that they shall not be burdened with costs (fn. 4) (iii) As to reservations of benefices At the beginning of his pontificate the pope decreed the reservations hitherto made by his predecessors, undertaking to use such moderation (fn. 5) in future that there shall be no ground for complaint, etc. (e.g. about annates etc.) Ad fut.rei mem.
