To the abbot of St. Mary's, Cong (de Cunga), in the diocese of Tuam, and Dermit Omyachayn and Thomas Oruayn, canons of Tuam. Mandate, as below. Pope Eugenius IV (upon being informed by Richard de Burgo, clerk, of the diocese of Clonfert, that William Oco[r]grayn, priest, then rector of Athnaryg in the diocese of Tuam, of the patronage of laymen, had publicly kept with him a certain woman as a concubine, alienated and dilapidated many goods belonging to the said rectory, and by his own authority made a division of the said rectory and its fruits between himself and Maurice Occallayd, priest, sometime rector thereof) ordered Matthew Osyriden, a canon of Tuam, if and after Richard accused William before him etc., to summon William and, if he found the above to be true, to deprive and remove William, and in that event to collate and assign the said rectory to Richard. Subsequently, as the recent petition of Thady Occeallayd, clerk, of the diocese of Clonfert, contained, the said Richard duly made the accusation etc., and the said Matthew promulgated a definitive sentence in favour of Richard and against William, which became a res judicata. Seeing however that, as the said petition added, upon the voidance of the deanery and the archdeaconry of Clonfert, major and non-major dignities respectively, and of the rectory of Woranmor in the diocese of Annadown, which are [sic] also of the patronage of laymen, the said Thady (under pretext of certain letters of the said pope ordering provision to be made to him of one or two benefices in certain specified gifts, even if such one or one of such two had cure or were a canonry and prebend, dignity etc. in a cathedral, even metropolitan or a collegiate church, provided that such dignity were not major or principal respectively) got provision made to him, first of the said deanery, and afterwards, upon his resigning it, provision of the said rectory of Woranmor, believing them to be comprised in the said grant, and subsequently, upon his resigning the said rectory of Woranmor, provision of the said archdeaconry, then detained by another, detaining the three in succession for some time, and taking fruits, from the deanery none, from the said rectory of Woranmor about 6d. of the money current in those parts, and from the archdeaconry (which he also afterwards resigned) none. Seeing that, as the pope has been informed by Thady, the said William and Richard have committed simony in regard to the said rectory of Athnaryg, and have dilapidated the goods and fruits thereof, they holding possession of it in common, the pope, hereby rehabilitating Thady on account of any irregularity contracted in consequence of the foregoing, orders the above three, if and after Thady (who is illegitimate, being the son of a bishop in priest's orders and an unmarried woman,) accuses William and Richard before them etc., to make inquiry, and if they find the above to be true, to deprive both of them of the said rectory of Athnaryg and all right therein or thereto, and to remove them, and in that event to collate and assign the said rectory of Athnaryg, with cure and value not exceeding 30 marks sterling, to Thady, provided that the patrons consent. Mandate (the pope having been informed by Dermit Ohiki, priest, of the diocese of Limerick. that Dermit [son] of Maurice Yhiki, perpetual vicar of Athdare in the said diocese, of the patronage of laymen, has publicly kept a certain woman as his concubine, dilapidated the goods of the said vicarage, and committed many other crimes [not here specified]) to dispense the said Dermit Ohiki—who was lately dispensed by papal authority, notwithstanding his illegitimacy as the son of a priest and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even if with cure; who, being chaplain of the earl of Desmond (to whom an indult was granted by the apostolic see to have a portable altar, and to have [masses] celebrated in fit and honest places by his own or other priest in the presence of himself and the members of his household [below. Reg. Lat. CCCCXXXV, f. 280d.]) has often. in ignorance of the law, celebrated masses in a profane place, in the presence of the said members but in absence of the said carl, not in contempt of the Keys; and who has followed the said earl in battles and conflicts, in which homicides, rapines, burnings etc. were perpetrated, but did so only for the celebration of divine offices and masses, and without in any way assisting the earl in the perpetrating of the aforesaid—on account of irregularity contracted by thus celebrating or following the said earl, and to rehabilitate him, enjoining penance etc.; and, after so doing, and if and after the said Dermit Ohiki accuses the said Dermit Mauricii before them etc., to summon the latter, and if they find the above to be true, to deprive and remove him, and in that event to collate and assign the said vicarage, value not exceeding 16 marks sterling, provided that the patrons consent, to the said Dermit Ohiki. The pope has been informed by Donatus Okailti, clerk, of the diocese of Derry (Deren.), that Richard Macguillarenan (rectius Macguillarenan), perpetual vicar of Antrim (Entroia) in the diocese of Connor, a public fornicator, has committed perjury and, being excommunicate and publicly proclaimed excommunicate, has celebrated masses and other divine offices and taken part therein, incurring irregularity. The pope therefore orders the above (seeing that, as Donatus alleges, there are no competent judges in the city and diocese of Connor to whom these presents can be directed), if and after Donatus (who was lately dispensed by papal authority, as the son of a priest and an unmarried woman, to be promoted to all, even holy orders, and hold a benefice even with cure) accuses Richard before them etc., to summon Richard, and if they find the above to be true, to deprive and remove him, and in that event to collate and assign the said vicarage, value not exceeding 4 marks sterling, to Donatus. Mandate to collate and assign the perpetual vicarage of Lochriach in the diocese of Clonfert, so long void by the resignation of David Ychallanagyn to the late Thomas, bishop of Clonfert, that its collation by the Lateran statutes lapsed to the apostolic see, to William Omuregrayd(h), clerk, of the said diocese, who states that he lately, notwithstanding his illegitimacy as the son of a priest and an unmarried woman, caused himself to be made a clerk, that he has in his right eye a slight spot, but without any deformity, on account of which he suffers a defect of sight, although only in small matters, (fn. 5) and that Roderick Ohegayd, priest, of the said diocese, who was formerly deprived and removed by the ordinary has, without having acquired any fresh canonical title, unduly detained possession for more than five but less than six years of the said vicarage, which was formerly governed by canons of the Augustinian monastery of Clonfert (de Portu puro) in the said diocese and depended on that monastery, but which the abbot and convent exchanged with the bishop of Clonfert for certain other benefices, which has since, for more than 30 years, been governed by secular clerks, and whose value does not exceed 8 marks sterling; notwithstanding the said defects of birth and sight, on account of which he is hereby dispensed to be promoted to all, even holy orders and minister therein, and hold the said vicarage or any other benefice with or without cure.
