To the bishops of Ossory and Leighlin, and the abbot of Leix (de Lege dei) in the diocese of Leighlin. Mandate, as below. The recent petition of the abbot and convent of the Cistercian monastery of St. Mary, Graiguenamanagh (de Valle Sancti Salvatoris de Dewysk, rectius Dowysk), in the diocese of Ossory, contained that James, earl of Ormonde (Ormonie), Edmund and Robert his brothers, and Donatus Macmurchw, Donald Ouan (or Orian), Thady Magillapadraich and Donald Kemanach, and certain other clerks and laymen, of the dioceses of Ossory and Leighlin, more cruel than Pharaoh who, although he had not knowledge of the law, nevertheless left the priests and their possessions in their pristine liberty, do not fear to subjugate the said monastery to their jurisdiction and temporal rule as if it were their own patrimony, [compel] the abbot and convent and monastery to give and pay to them feudal dues, stipends, tallages, commons, private subsidies, collections, protection money, compel the men and subjects thereof [to go] to wars at their own expense, and to give and pay fines and many other (or ‘and other penalties’) exactions and servitudes which they have been wont to exact and receive from their own lay subjects, and to undergo all other lay burdens, and otherwise fear not to afflict the said monastery and its subjects with divers vexations, and to impose the same upon them (fn. 2), thereby incurring sentences etc.; by reason of which things all the buildings of the monastery are threatened with ruin. The pope therefore orders the above bishops and abbot to summon the said earl and the said others, and all others concerned, and if they find the above to be true, to monish and require the said James, Edmund, Donald, Donatus, Thady, and all the others above named, and their accomplices and abettors utterly to desist from the foregoing and from all other grievances, allow the said abbot, convent, monastery and subjects freely to enjoy their liberty and all their privileges, wholly restore to the abbot, convent and monastery within a certain term all things which contrary to ecclesiastical liberty and the privileges of the said monastery they have extorted, and make a settlement thereabout and thereon with the abbot and convent, under pain of aggravation of excommunication, and also under pain of pecuniary and other penalties which they shall the more fear (fn. 3); and if they neglect to obey the said monitions etc. to declare those who do not obey to have fallen under the said sentences etc., aggravating the processes as often as expedient, and invoking if necessary the aid of the secular arm. If they find that such processes and monitions and the needful citations cannot be safely published to the earl and others aforesaid, they shall as often as necessary publish them by public edict affixed in public places near those parts, in such wise that they may probably come to the knowledge of the said earl and others etc., which processes, monitions and citations shall be as binding as if served in person. Mandate to collate and assign to William Bassinden, a canon of the Augustinian monastery of Inchaffray (Insula Missarum) in the diocese of Dunkeld, the perpetual vicarage of the parish church of Lyff, of the said order (fn. 4), in the diocese of St. Andrews, which depends on the monastery of Scone, of the said order and diocese, and has been wont to be governed by canons thereof, value not exceeding 4l. sterling, void by the death of Thomas Gardener, translating the said William, as soon as he obtains possession of the vicarage, from Inchaffray to Scone, and causing him to be received as a canon thereof. To the bishop of Glasgow. Mandate, as below. The recent petition of George Gardenar, an Augustinian canon professed of St. Michael's, Scone, in the diocese of St. Andrews, contained that formerly, after he had been canonically elected abbot of the said monastery, then void, by the convent thereof and had been confirmed by authority of the ordinary, and in virtue of the election and confirmation had obtained possession of the rule and administration of the monastery, and had governed it laudably for some time, James, bishop [now] of St. Andrews, then of Dunkeld (who had obtained a grant in commendam by Eugenius IV, or by authority of his letters, of the said monastery, as being still void as above), in virtue of the letters of commenda ejected George from the monastery and from possession of its rule and administration, intruded himself and retained it for several years; that afterwards when George, with support of the royal and otherwise of the secular arm, seizing an opportunity (fn. 5), had recovered the said possession and had remained in possession for some time and was remaining therein, as true abbot, the said bishop, alleging himself to have therefore been and to be despoiled by George of the said commenda and monastery, excommunicated him by his ordinary authority, and under pretext of the said letters of commenda and of the processes taken in the matter thereof, caused him to be excommunicated and otherwise declared to have fallen under the sentences, censures and pains contained in the said letters and processes, and caused him to be publicly proclaimed excommunicate; that George, believing it was lawful for him to do so, and that he had a good right in the monastery, sustained in defence of the said right, although not with a hardened heart, the said sentence of excommunication and other sentences and censures for more than a year; that afterwards he and the bishop, at the intervention of common friends, made an amicable agreement whereby George utterly released and gave up to the bishop possession of the monastery, and the bishop with consent of the convent assigned to George for life a yearly pension of 17l. sterling or thereabouts on the fruits etc. of the monastery, whose value does not exceed 200l. sterling, to be paid by the said bishop and his successors, abbots of the said monastery, at the same time ordering and causing George to be absolved from the said sentence of excommunication and other sentences and censures. At George's said petition and that of the university of St. Andrews, of which he is a suppôt (fn. 6), the pope hereby orders the above bishop of Glasgow to summon the said bishop and others concerned, and if he find the facts to be as stated, to absolve George from the said sentence of excommunication and other sentences, censures and pains, enjoining penance, dispense him on account of irregularity if any, contracted by celebrating masses and other divine offices etc., rehabilitate him, and confirm the said agreement and assignment of a pension. To the abbot of Dumfermlin in the diocese of St. Andrews. Mandate, at the recent petition of the abbot and convent of the Cistercian monastery of Meluos (rectius Melros) in the diocese of Glasgow (containing that the monastery, which is situate on the borders of the realm of Scotland near the realm of England, is on account of the wars which have very much afflicted those parts so much diminished in its rents that the abbot and convent cannot therewith be well maintained and bear their burdens), if he find the facts to be as stated, to appropriate to the monastery in perpetuity the hospital of Soltra in the diocese of St. Andrews, of the patronage of James, king of Scots, value not exceeding 50l. sterling, that of the monastery not exceeding 300l. sterling; so that on the death or resignation of the rector they may take possession of the hospital, maintaining decent and wonted hospitality therein etc. Apostolice servitutis officium.
