Mandate to collate and assign to Dufacus Johannis, priest, of the diocese of Sodor (who was lately dispensed by papal authority on account of his illegitimacy, as the son of a priest and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure, after which he was so promoted, and whom the pope hereby absolves from all sentences of excommunication etc. as far only as regards the taking effect of these presents) the perpetual vicarage of St. Fynnoga's Coll (Sancte Fynnoge de Cola) in the said diocese, value not exceeding 5 marks sterling, void by the deprivation by John, bishop of Sodor, by his ordinary authority, of Kenneth (Kennichum) Angusii for his faults and demerits; summoning and removing Donald Dominici, priest, of the said diocese, who has for about four years unduly detained possession of the vicarage (which belongs by ancient custom to the presentation of the prioress and convent of the Augustinian priory of St. Mary, Hy, in the said diocese) under pretext of a collation made to him by authority of the ordinary, on its voidance as above, without his having obtained any canonical presentation, and who has meanwhile dilapidated and consumed its possessions; whether it be void as stated, or by the death of Fynlaus (fn. 2), or by the resignation of the said Fynlaus or of the said Kenneth or of a certain Fy[n]gonius (fn. 3) or in any other way. Mandate (the pope having been informed by Patrick Makarmaic, clerk, of the diocese of Raphoe that Malachy Ogallebayr, rector of Cluaindabodoch in that diocese, has committed simony and perjury, publicly and notoriously kept a concubine, dilapidated, alienated and uselessly consumed the immoveable (fn. 7) goods of the said church, and has not resided, although monished by Laurence, bishop of Raphoe, to do so, but has neglected to celebrate, read or sing divine offices there or elsewhere etc.), if and after Patrick (whom the pope hereby absolves from all sentences of excommunication etc. as far only as regards the taking effect of these presents) accuses Malachy before the above three, to summon Malachy, and if they find the above or one of them enough for the purpose to be true, to deprive and remove him, and in that event to collate and assign the said rectory, value not exceeding 14 marks sterling, to Patrick (fn. 8); whether it become void by such deprivation, or be void by the death of Thomas Yuaan (or Ynaan), or be void by the deprivation of the said Malachy or by his resignation, or be void in any other way. Mandate—the pope having been informed by John Parvi, rector of Cormelles (de Cormeliis) in the diocese of Lisieux, licentiate of canon law, that formerly John Trabat of England obtained in return for a yearly pension of 20 nobles of England of good gold to John Clorp, clerk, a canonry and prebend of Lisieux in exchange for certain chaplaincies [not here named], thereby incurring sentences etc. for simony—if and after the said John Parvi, who is a priest, and to whom provision was lately made of the said canonry and prebend by royal authority, accuses John Trabat before them etc., to summon Trabat and Clorp, and if they find the above to be true, to declare the collation and provision which was made to Trabat to be null, and to remove him, and in that event to collate and assign the canonry and prebend, value not exceeding 60l. petits tournois, to Parvi; notwithstanding that he holds the said church, value not exceeding 100l. petits tournois. Mandate (the pope having been informed by Donald Osullevayn, clerk, of the diocese of Ardfert, that John Makenneri, abbot of the Augustinian monastery of Maelanfaih in the diocese of Lismore, has committed simony and perjury, is a public and notorious fornicator, has dilapidated and alienated and uselessly consumed the possessions of the monastery, and is much defamed about these matters in those parts), if and after Donald (whom the pope has this day ordered the above archdeacon and two others to cause to be received as a canon of the said monastery, and to receive his profession, and who from fear of John's power has no hope of obtaining justice in the city and diocese of Lismore) accuses John before the above archdeacon, to summon him, and if he find the above or one of them enough for the purpose to be true, to deprive and remove him, and in that event, and if he find Donald fit, and after he has made his profession, to make provision to him of the said monastery, value not exceeding 30 marks sterling; whether it become void by such deprivation, or be void by the death of Thomas Mecrach (rectius Mecrath i.e. Macrath), or in any other way. Mandate, at the recent petition of Henry Mason, a Cistercian monk of Balmorinach in the diocese of St. Andrews (containing that lately Richard Couentre, abbot thereof, in order that the monks should elect him abbot, promised to some of them gifts, to others favours, and to others licence to transfer themselves to an university, but that the said religious, publicly penitent, obtained absolution, whereas Richard has never done so, incurring simony; that afterwards, not as a pastor but as a devouring wolf, he in many ways dilapidated the possessions of the monastery and [converted] them to the uses of a certain concubine, a married woman, whom, although often made to swear by the ordinary that he would give her up, he has refused to repudiate (fn. 19), and, when under sentence of excommunication and interdict, has several times celebrated masses and other divine offices in contempt of the Keys), if and after Henry accuses Richard before the above abbot, to summon Richard and if he find the above or one of them enough for the purpose to be true, to deprive him and in that event, and if he find Henry fit, to make provision to him of the said monastery, value not exceeding 100l. sterling, and, if he do so, to grant that he may be blessed by any catholic bishop, who shall thereafter receive from him the usual oath of fealty and send it to the pope by his letters patent sealed with his seal (fn. 20). Eugenius IV, on the voidance of the said church by the death of John, during whose life it had been specially reserved to the said pope, made provision thereof to James, [now] bishop of Killaloe (Loanien., rectius Laonien.), then elect of Annadown [see Cal. Papal Lett., VIII, p. 505 and note]; and afterwards made provision of the same church (void by the same pope's translation of the said James, the letters of whose provision to Annadown had not been drawn up, to Killaloe) to the late Donatus, elect of Annadown. The same church of Annadown having become void by the death, without his letters of provision having been drawn up, of the said Donatus, during whose life (fn. 26) the present pope specially reserved it, the pope hereby makes provision to the above Redmond, dean of Tuam, in priest's orders (fn. 27). The pope has been informed by John Barri, monk of the Cistercian monastery of St. Mary, Whitland (de Albalanda) in the diocese of St. Davids—who, without having obtained any canonical dispensation on account of illegitimacy as the son of an unmarried nobleman and an unmarried woman, by his own temerity and without canonical title, and by the force and power of his friends and kinsmen intruded himself into the rule and administration of the Cistercian monastery of Middleton (de Choro Sancti Benedicti) in the diocese of Cloyne (Clonen.). and detained it for about seven years, taking its fruits etc.; and who, after he had resigned that monastery and had made satisfaction in respect of the said fruits to the late Nicholas, abbot of the Cistercian monastery of St. Mary, Monasteranenagh (de Magio) in the diocese of Limerick, the father-abbot of the Cistercian monastery of St. Mary, Tracton (de Albotractu) in the diocese of Cork, received for some time (under pretext of an amicable composition between him and Simon, [now] a monk, then abbot of the said monastery of Tracton, whom by the said power he had vexed in respect of the rule of the said monastery) a number of the goods and a yearly pension on the fruits of the said monastery of Tracton, thereby committing simony and incurring the sentences etc. therefor; and who, being thus excommunicate, has celebrated masses and other divine offices, but not in contempt of the Keys—that Miles (Milo) Roche, abbot of the said monastery of Tracton, has dilapidated the goods thereof, committed simony, and is a notorious fornicator. The pope therefore orders the above dean to absolve John from simony and the said sentences etc., enjoining penance, dispense him on account of irregularity, and rehabilitate him; and after so doing, and if and after he accuses Miles before the above dean, to summon Miles, and if he find the above or one of them enough for the purpose to be true, to deprive and remove him, and in that event, and if he find John fit, to make provision to him of the said monastery, value not exceeding 50 marks sterling; whether it become void by such deprivation, or be void by the death without the Roman court of John Flemyng or of John Cultham, or be void in any other way; and, in the event of making the said provision, to grant that John may be blessed by any catholic bishop. The pope hereby dispenses him, notwithstanding the said defect, to rule the monastery, or to receive and retain any other dignities etc. of the said order, even if abbeys, conventual priories, etc. and to resign all, simply or (if they be not abbeys) for exchange, as often as he pleases. To the archdeacon of Cashel. Mandate, at the recent petition of Philip Ymyulbardan alias Ibrogaid, monk of the Cistercian monastery of St. Mary, Kilcooly (de Aruicampo) in the diocese of Cashel—containing that on the voidance of the said monastery by the death of abbot Thomas Bovil the convent unanimously elected the said Philip, who consented to the election and got it confirmed first by the father-abbot of the said monastery and afterwards by the vicar-general in those parts of the abbot of Citeaux, by their ordinary authority (fn. 28), and in virtue of the said election and confirmation was inducted into possession of the rule and administration, and still exercises the care thereof (fn. 29), but now doubts whether the election and confirmation hold good—if he find Philip fit, to make provision to him of the said monastery, value not exceeding 16 marks sterling, still void as above; whether it be so void, or be void by the resignation of the said Thomas, or be void in any other way; and to grant that he may be blessed by any catholic bishop, who shall thereafter receive from him the usual oath of fealty, and send it to the pope by his letters patent sealed with his seal (fn. 30); without prejudice to the archbishop of Cashel, to whom the monastery is by ordinary right subject.
