To Richard Wolston, a monk of the Benedictine monastery of St. Augustine by Canterbury. Indult (the pope having learned that in the said monastery there are several benefices called chantries and perpetual chaplaincies at the altars situate in [the church of] the said monastery and dedicated to divers saints, the collation etc. of which chantries etc. belongs by ancient custom to the abbot, and which chantries etc. have been wont to be assigned to secular clerks) to receive and retain for life one of such chantries etc., if collated to him by the abbot. To Thomas Obraeyn, a canon of Tuam. Mandate, if he find lawful the resignation made before a notary public and witnesses by John Okeallay of the Augustinian priory of St. Catherine de Achdruymomane in the diocese of Clonfert, to admit the same by papal authority, and thereafter to collate and assign the said priory, conventual, elective and with cure, value not exceeding 30 marks sterling, to Donatus Maccayg, a canon thereof, who is illegitimate, being the son of unmarried parents, and whom the pope hereby absolves from all sentences of excommunication etc. as far only as regards the taking effect of these presents; whether it be void by the said resignation, or by the deprivation and removal of Malachy Miccayg made by papal authority for his faults and demerits, or be void in any other way. To James de Mozanicha, a Friar Minor. S.T.B., vicargeneral of the Order, which is at present without a ministergeneral (fn. 3). Mandate, as below. The recent petition of William Yragillig, minister-provincial of Ireland. S.T.M., contained that the present pope, by letters cunningly (fn. 4) impetrated in the name of Henry king of England, ordered the bishop of Lismore and the dean of Cashel, or one of them, to summon the said minister and others concerned, and if they found the said William was a rebel or unfaithful and disobedient, to deprive and remove him, and in that event to ordain that David Carru, S.T.P., and Nicholas Walsche, S.T.B., friars of the Order, should until the election of a future minister-provincial of the said province and the confirmation of such election, be presidents in the stead of the said minister; that, upon the said David and Nicholas falsely relating to Robert bishop of Lismore and John Cantuelle, then dean of the said church [of Cashel], that the said William was a rebel, unfaithful and disobedient to the said king they, under pretext of the said letters, caused him to be cited to appear before them at Clonmel (Clonmellie) in the diocese of Lismore in order to prove his innocence, or, if not, to be deprived and removed; that, inasmuch as the said place was, on account of wars notoriously raging in those parts and of a writ to arrest him obtained under false pretences by the said David and Nicholas from a certain official of the said king, and for other reasons, unsafe for him and his proctor, he appealed to the apostolic see; that the said bishop and dean, on his non-appearance, deprived him of the said office of minister as being contumatious, which he was not, ordered Gillibertus Walsche, a friar of the said order and S.T.P. (who had procured his own election as minister-provincial by certain friars who had been publicly excommunicated by the said minister [William Yragillig]) to be received by the friars of the houses of the said province as their minister-provincial, and otherwise molested William, in regard to the foregoing, as did also the said Gillibertus, wherefore he again appealed to the said see; that subsequently the present pope, at the instance of Francis de Eugubio, then proctor-general of the order in the Roman court, gave commission to the late Angelus de Perusio, then minister-general of the order, to summon the parties, inquire summarily etc. (fn. 5) into the truth of the foregoing, decide what was just, and cause his decision to be observed by ecclesiastical censure, who, proceeding in the cause, annulled by his definitive sentence all that had been done against William, imposing perpetual silence on Gillibertus in regard to the said office; and that although the said sentence was not appealed from by the said Gillibertus within the lawful time, but became a res judicata, nevertheless, inasmuch as before the lawful documents in the matter of the said sentence were drawn up, and before it was executed, the said Angelus died, the said William (who on account of the said commission to the said minister-general and for other lawful reasons was not able otherwise to prosecute his said appeal) fears lest he may be wrongfully molested in regard to his said ministership and otherwise by reason of the aforesaid. The pope therefore orders the above James, if he find lawful the said sentence of Angelus and res judicata, to cause the said sentence as far as it is just to be executed (fn. 6), and if he cannot so find, on account of the said documents not having been drawn up, to summon (notwithstanding the lapse of the time for prosecuting the said appeal) the said Gillibertus and others concerned, hear both sides, and decide what is just, causing his decision to be observed by ecclesiastical censure, without appeal. Mandate to admit the resignation which for purpose of exchange John de Eklis and Thomas Malcilhauche propose to make of their respective perpetual vicarages of Eisilton (rectius ‘Ersilton,' which also occurs) and Symonton, in the dioceses of St. Andrews and Glasgow, the value of each not exceeding 9l. sterling, and thereupon to carry out the exchange. To the bishop of Ardagh. Mandate (the pope having learned that the rectory of Srard Mady breaeragy from (de) Lathuahelti to (usque) Acchsalas, Corraliath and Cluanmadain, in the diocese of Ardagh, belonging to the abbatial mensa of the Cistercian monastery of St. Mary, Granard, in the said diocese, has been wont to be given and granted to secular clerks in turn to farm and for a yearly pension payable to the abbot for the time being (fn. 7); and the recent petition of Thomas Macmurchertaid, priest, of the said diocese, containing that James, the present abbot of the said monastery, or his proctor, has consented that the said Thomas may and shall, with the consent of the apostolic see, receive and hold the said rectory for life to farm and in return for the payment of the said pension (fn. 8) ), if the facts be as stated, to grant to the said Thomas that he may, with consent of the present abbot or his proctor, receive and hold for life the said rectory or its fruits etc. to farm, in return for the said pension payable therefrom to the said abbot (fn. 9). To the perpetual vicar of the church or chapel of Holy Trinity and all the inhabitants of the town of Kyngenton (sic) on Hull in the diocese of York. Indult, at their recent petition, containing that at the said town the sea ebbs and flows, wherefore many merchants of divers parts and other persons of both sexes who go to the said town are very often, when they wish to go away, obliged on account of the said ebb and flow to put to sea in great haste without hearing mass (fn. 11) ) to cause a mass to be celebrated before daybreak by a fit priest in the said church or chapel. To the bishop of Clonfert. Mandate, at the recent petition of William de Burgo, layman and (fn. 12) Slany Ingybreyn, of his diocese—containing that formerly, namely, after William had contracted marriage with another woman and had alleged to the said Slany that before the said contract he had carnally known another woman, a kinswoman of the said wife, the said Slany (deceived by the advice of a number of her relatives and friends and of certain religious, who alleged that the said marriage was therefore null) and William (putting away the said wife), after having obtained canonical dispensation on account of their relationship in the double fourth and the third degrees of kindred, and the third and third and the double fourth degrees of affinity, contracted marriage per verba legitime de presenti, consummated it, and had offspring; and that subsequently, upon William's failing to prove, although it was true, that he had thus known the said kinswoman, he was at length compelled by a judgment of the church to return to the said first wife, upon whose death (which they in no wise contrived) they again contracted marriage per similia verba, consummated it and had offspring; and adding that for the sake of the said offspring, to save Slany from being perpetually defamed, and to keep the peace between their kinsmen and friends, etc., they desire to remain in the said last contracted marriage—to absolve William from sentence of excommunication incurred, enjoining penance etc., and dispense him and Slany to remain in the said last contracted marriage, notwithstanding the said and any other impediments of kindred; decreeing the said offspring and that to be born of the marriage legitimate. To the bishop of St. Andrews and the prior of Inchmahome (de Inchmaqwomo) in the diocese of Dunblane (fn. 14). Mandate, as below. The recent petition of Isabel, duchess of Albany and countess of Lennox (Leuenax), of the diocese of Glasgow, contained that some (pluribus) years ago her husband, the late Murdoch (Murdacus) duke of Albany and earl of Fiffe and Myntech (rectius Mynteth), in the dioceses of St. Andrews and Dunblane, and governor of all Scotland, and her father the earl of Lennox, [and] their children, namely the sons and brothers of the said countess (fn. 15), were by order of the late James king of Scots, who was evilly counselled or informed, disinherited and put to death, leaving no successor in the right line, except only the said countess, a solitary widow and very poor (fn. 16), who, succeeding by paternal right to her said father, enjoys the said county of Lennox; wherefore, for the welfare of their souls and in lasting memory of them, she desires the chapel of St. Mary the Virgin (which is situate in the burgh of the place of Dunbertane in the said diocese of Glasgow, and is within the bounds of the said county of Lennox, and is of her patronage, and which she intends to enlarge, build, repair and adorn for the purpose) to be erected into a collegiate church for a provost and a sufficient number of perpetual chaplains, and the creation and the endowment from her revenues and possessions of a provostship for such provost, who shall be the head of such college, and of perpetual chaplaincies for such chaplains; and that she desires that the hospital in the place called Polmade (which was formerly founded and endowed by her predecessors, and to which is annexed the parish church of Strablane in the said diocese of Glasgow, which hospital is so remote from the said county of Lennox that the said predecessors could not conveniently visit and reform it, so that it is neglected and forgotten, and is turned from its original purpose (fn. 17) ) may be transferred to the said chapel and future collegiate church (in which shall be observed the same hospitality as has been wont to be observed in the said hospital from the time of its foundation, and that the said hospital and its annexes, and also the parish church of Fyntre in the said diocese of Glasgow, which is also of her patronage, may be united and appropriated in perpetuity to the said chapel and future collegiate church. The pope therefore (holding the values of the said chapel and church of Fyntre and hospital to be expressed by these presents) orders the above bishop and prior, if they find the facts to be as stated, to erect the said chapel into a collegiate church, create and institute therein a provostship and as many perpetual chaplaincies as shall seem to them reasonable, which, as well as the provostship, shall be without cure, endow them from the said possessions of the countess, and after doing so to transfer the said hospital from the said place of Polmade to the said chapel, thus erected into a collegiate church, and to unite and appropriate it and the said church of Fyntre, provided that their rectors consent, to the said erected collegiate church, so that the provost and chaplains thereof may, on the resignation or death of the said rectors, take possession. The pope hereby grants faculty to the above bishop and prior, after making the said erection, creation, institution, endowment, translation, union and appropriation, to collate and assign for this turn the provostship to George de Abyrnethi (fn. 18), clerk, of the said diocese (who is a licentiate in arts, is by both parents of noble birth, is a kinsman of James, the present king of Scots, is at present rector of the said hospital, is a son of the sister of the said countess's husband (fn. 19), and is able to devote himself to the building, enlargement, repair etc. of the said collegiate church), and also the said chaplaincies for this turn to nominess of the countess, and to induct them etc., and to reserve the patronage of the provostship and chaplaincies and the presentation thereto in future to the countess and her successors and heirs, earls and lords of the said county of Lennox, and to reserve the institutions of the provost to the bishop of Glasgow, and of the chaplains to the provost, and decree that the ordinary jurisdiction etc. over the provost shall belong to the bishop, and over the chaplains shall belong to the provost, in regard to all delicts etc.; with faculty to do all other things necessary and opportune in regard to the foregoing. To Thomas de Sancto Claro, priest, of the diocese of Moray. Dispensation, at his recent petition (containing that, after he had been dispensed by papal authority, on account of illegitimacy as the son of unmarried parents (i), to be promoted to all, even holy orders and hold a benefice even with cure; (ii), having been so promoted, to hold a benefice compatible with the said benefice, and to resign them, simply or for exchange, once only, after which he obtained, canonically collated to him, the perpetual vicarage of Lochal in the diocese of Aberdeen. resigned it, and obtained instead the perpetual vicarage of Logidurno in the same diocese, collated to him by authority of the ordinary, value not exceeding 9l. sterling, provision of which the pope has this day ordered to be made to him [anew]) to receive and hold any other benefices, with or without cure, of any number and kind, compatible with one another and with the said vicarage, even if canonries and prebends, dignities etc., and to resign them, simply or for exchange, as often as he pleases.
