To William, elect of Ely. Faculty to him, to whom the pope has this day made provision of the said church, to be consecrated by any catholic bishop, assisted by two or three others. The consecrator shall thereafter receive from him the usual oath of fealty, according to the form enclosed, and shall send it to the pope by William's letters patent sealed with William's seal (fn. 2) without prejudice to the archbishop of Canterbury the metropolitan. Mandate (the pope having been informed by Odo Omalegan, priest, of the diocese of Connor, that Z[e]fanus Okyeonnayc (rectius Okyeonnaye), abbot of the Cistercian monastery of St. Mary, Cumur, in the diocese of Down, has committed simony, publicly kept a concubine, and dilapidated and alienated and uselessly consumed its possessions, and is much defamed about these things in those parts; and the pope having this day [above, p. 676] ordered the above prior and two colleagues [not here named] to cause the said Odo to be received as a monk of the said monastery) if and after Odo, who was lately dispensed by papal authority on account of illegitimacy as the son of a priest and an unmarried woman, to be promoted to all, even holy orders, and hold a benefice even with cure, after which he had himself so promoted, and who from fear of Zefanus's power has no hope of obtaining justice in the city and diocese of Down) accuses Zefanus before the above prior, to summon him, and if he find the foregoing to be true, to deprive and remove him, and in that event to make provision of the said monastery, value not exceeding 6 marks sterling, to Odo, whom the said prior is to cause to be blessed by any catholic bishop, and whom the pope hereby dispenses to be appointed abbot and to rule the monastery, etc., notwithstanding the said defect etc. Ex suscepte servitutis. Mandate (the pope having been informed by Malachy Macmachuna, clerk, of the diocese of Clogher, that Eugenius Occonnalayg, abbot of the Augustinian monastery of SS. Peter and Paul, Cluayneoys, in the said diocese, has publicly kept a concubine within the precincts of the said monastery and incurred perjury, and dilapidated and alienated and uselessly consumed the goods of the monastery; and the pope having this day [above, p. 678] ordered the above prior and two colleagues [not here named] to cause the said Malachy to be received as a canon of the said monastery) if and after Malachy (who was lately dispensed on account of illegitimacy, as the son of unmarried parents, to be promoted to all, even holy orders and hold a benefice even with cure, after which he had himself made a clerk, and whom the pope hereby absolves from all sentences of excommunication etc. as far only as regards the taking effect of these presents) accuses Eugenius before the above prior, to summon him, and if he find the foregoing to be true, to deprive and remove him, and in that event to make provision to Malachy of the said monastery, value not exceeding 20 marks sterling, and if he do so, to cause him to be blessed by any catholic bishop, without prejudice to the bishop of Clogher, to whom by ordinary right the said monastery is subject. Mandate (the pope having been informed by John Okyllyn, a friar of the Third Order of St. Francis, called the Order of Penance, that Mark Macbridyn. abbot of the Augustinian monastery of St. Mary alias St. Congal, Bancor, in the diocese of Down, has committed simony, publicly kept a concubine, and dilapidated and alienated and uselessly consumed the moveable and immoveable goods of the said monastery, and is much defamed of these things in those parts) if and after John. who is a priest and who from fear of Mark's power has no hope of obtaining justice in the city and diocese of Down) accuses Mark before the above prior, to summon him, and if he find the foregoing to be true, to deprive and remove him, and in that event to make provision to the said John of the said monastery, the value of whose mensa, after the bearing of its burdens, does not exceed 24 marks sterling, and. if he do so, to cause him to be blessed by any catholic bishop, without prejudice to the bishop of Down, to whom the monastery is by ordinary right subject. John is hereby specially dispensed to be appointed abbot and to rule the said monastery etc., notwithstanding that he has made his profession of the said order of St. Francis, and is to wear the habit worn in the said monastery and conform to its regular institutes. To John de Carrik, perpetual vicar of Lothtresk in the diocese of St. Andrews. Rehabilitation, as below. His recent petition contained that formerly (after he had been dispensed by papal authority, on account of illegitimacy, as the son of unmarried parents, to be promoted to all, even holy orders and hold a benefice even with cure, and after he had been so promoted and had obtained the said vicarage of Lothtresk), on the voidance of a canonry of Dunbar in the said diocese and the prebend called—therein (fn. 8) by the resignation of the late Henry Sybald to James bishop of St. Andrews. that bishop made collation and provision thereof by his ordinary authority to the above John, who had obtained no other dispensation in regard to the said defect, and who under pretext thereof obtained possession of the said canonry and prebend, and has detained them for more than four years, taking the fruits, and who still holds the said vicarage, value not exceeding 12l. sterling. Dispensation to him, who has betaken himself from England to Italy for the sake of study, and desires to study letters in the pope's city of Bologna or other place in Italy where there is a university, not to be bound for seven years whilst thus studying letters at an university (provided that within the first year of the said period he be ordained subdeacon) to have himself promoted to any other holy order by reason of the said church, of which he has not yet had peaceable possession for a year, and whose value does not exceed 15l. sterling. Dispensation to him, who is in his eighth year, so that, after he has been tonsured, he may, after he has reached his tenth year in case of collegiate. and his twelfth year in the case of cathedral and metropolitan churches. receive and retain any canonries and prebends and other benefices without cure, and resign them, simply or for exchange, as often as he pleases, notwithstanding the pope's late ordinance forbidding the holding of canonries and prebends of cathedral churches below the age of fourteen [Ottenthal, Regulœ Cancellariæ Apostolicæ, p. 257, i. e. no. 18 of the Regulœ Nic. Mandate, at the petition of Celestinus [son] of Alexander de Yle, layman, and Fyngolla Lachlane Macgilance, of his diocese (containing that they formerly, not ignorant that they were related in the third and third and the third and fourth and the fourth and [fourth?] degrees of affinity, and in the third and fourth and the fourth and fourth degrees of kindred on divers sides, committed fornication several times. and that, in order to obviate probable homicides etc. between the said Celestinus and the relatives (parentes) of Fy[n]golla, and for the strengthening of peace and concord, they desire to marry) to dispense them to marry, notwithstanding the said impediments; decreeing legitimate the offspring born, if any, and that to be born of the marriage. Lib. 1.’ A flyleaf has, in three different contemporary hands: ‘Primus de provisionibus prelatorum et de diversis formis anno viii. domini nostri domini Nicolai pape V.’ ‘R(ecipe) Mo., A.' [de Feletis], and ‘Quesitus pro Jo(hanne) episcopo Leodiensi.’ Another flyleaf has the usual ‘Vidi Hib. ang. et pro domino pape,’ followed by ‘Vidi denuo de provisionibus prelatorum,’ and (in an eighteenth century hand) ‘Adest etiam alius liber cum eodem numero 105.’ and the number ‘105' (the wrong way round, having been caught when wet from another leaf now gone).
  • 2. forman autem juramenti quod te prestare contigerit nobis de verbo ad verbum per tuas patentes litteras tuo sigillo signatas per proprium nuncium quantocius destinare procuret.
  • 3. The foregoing faculty is, strictly speaking, out of place here. It ought to have been registered, not under the rubric ‘de provisionibus prelatorum,' but under the rubric ‘De Diversis Formis.’ Cf. the footnote to f. 79 below.
  • 4. Eubel, Hierarchia Catholica, ad loc., has under the above date ‘tr. Tho. ad Cantuar., Guilelmus Gray, adiac. Richemundiae, referend. S. P.’ from ‘Obl. 72, 62.’ The ‘Obliq.’ has in fact Eisdem die et loco [i. e. die Veneris xi. Kal. Julii in consistorio secreto as in the immediately preceding entry] s. d. n. … providit ecclesie Elten., ut premittitur [viz. ibid., by the translation of Thomas to Canterbury] vacanti, de persona reverendi patris domini Guillelmi Gray apostolice sedis refrehendarii (sic) archidiacom Rechemundie.…
  • 5. Eubel, op. cit., ad loc., has under the above date, ‘ob. Jo. (1452, Maii 25), Thomas (Bourchier), ep. Elien.’ from ‘Obl. 72, 61,’ which agrees with Eubel as far as it goes.

(14 Oct.). 1454, an. 8, three dispensations ‘Vite etc.’ on account of defects of age and birth to William le Franc (also written ‘Frank’), clerk, of ‘Londonen.,’ B.A., son of Thomas le Franc, physician in chief to Charles, king of France, he being in about his twenty-first year, a student at Padua and illegitimate, being the son of unmarried parents. ‘Londonen.’ (or Londouen., as it is also written) is evidently to be read ‘Loudouen.; i c. ‘Lodovensis., ‘Lodève in dép. Hérault, a suffragan see of Narbonne. On f. 311 the text had ‘Leodien dioc.,’ which is cancelled and over-written ‘P(etru)s,’ ‘Londouen.' being substituted in the margin by P[etrus de Varris].’
