Mandate (the pope having been informed by Patrick Olucharean, clerk, of the diocese of Armagh, that Patrick Olucharean, rector of the parish church de Tulachnaysgan in the said diocese, has committed simony and perjury and, being under sentence of excommunication and publicly proclaimed excommunicate, has celebrated or rather profaned masses etc., even in contempt of the Keys, to the shame of the priestly order) if and after the said Patrick, clerk (who without mention of his illegitimacy as the son of unmarried parents, has had himself made a clerk, and whom the pope hereby absolves from all sentences of excommunication etc. as far only as regards the taking effect of these presents) accuses the said Patrick, rector, before the above three, to summon the latter, and if they find the above to be true, to deprive and remove him, and in that event to collate and assign the said rectory, value not exceeding 3 marks sterling, to the said Patrick, clerk; whether it become void by such deprivation, or be void by the resignation of Maurice Olucharean, priest, of the said diocese, or any other, or by the death of Thomas Olucharean without the Roman court, or be void in any other way. Mandate to collate and assign to David Merike, priest, of the diocese of Killala (whose parents, after contracting espousals, carnally knew one another (fn. 2), and who, believing it to be lawful for him, had himself promoted to all, even holy orders, and whom the pope hereby absolves from all sentences of excommunication etc. as far only as regards the taking effect of these presents) the perpetual vicarage of Killbelfada in the said diocese, value not exceeding 2 marks sterling, so long void that there is no certain knowledge of the last mode of voidance, and that its collation has by the Lateran statutes lapsed to the apostolic see; summoning and removing Matthew Dundonaill, priest, of the same diocese, who has after the said lapse unduly detained it for between one and two years, without any [canonical] title. Mandate (the pope having been informed by Maurice Oclabaid alias Omaneachan, priest, of the diocese of Elphin, that Cornelius Oclabaid, perpetual vicar of St. Patrick's de Fuaian (rectius Fuaran) in the said diocese, has divided the fruits etc. of the said vicarage and made thereon a simoniacal agreement with Matthew Oclabaid, priest, of the same diocese, who formerly claimed to have a right in the vicarage (fn. 3), and has dilapidated and alienated in many ways its possessions, and is greatly defamed in those parts of these and divers other crimes [not here expressed], to the shame of the priestly order), if and after Maurice (all of whose benefices and their values the pope holds to be expressed by these presents, and whom the pope hereby absolves from all sentences of excommunication etc. as far only as regards the taking effect of these presents) accuses before them the said Cornelius, who is a priest and is very ignorant of letters, to summon Cornelius, and if they find the above to be true, to deprive and remove him, and in that event to collate and assign the vicarage, value not exceeding 5 marks sterling, to Maurice; whether it become void by such deprivation, or be void by the resignation of one (alicuius) of the said Maurice and Matthew, or in any other way. Mandate to collate and assign to Roger Odubayll, priest, of the diocese of Derry, the rectory of Killerunechan (rectius Killcrunechan) in the said diocese, value not exceeding 3 marks sterling, so long void (because Roger, also [called] Odubayll, obtained the perpetual vicarage of Druymabla in the diocese of Connor, collated to him by authority of the ordinary) that by the Lateran statutes its collation lapsed to the apostolic see; summoning and removing Odo Otheadgan, clerk, of the said diocese of Derry, who obtained it, collated to him by the said authority after the said lapse, and has unduly detained it for about two years; notwithstanding that the said Roger, priest, holds the rectory of Discertmarcham in the said diocese of Derry, which he is to resign upon obtaining that of Killerunechan. Mandate to collate and assign to Bernard Ochathasaich, priest, of the diocese of Clogher, whom the pope hereby absolves from all sentences of excommunication etc. as far only as regards the taking effect of these presents, the perpetual vicarage of the parish church of St. Lascrianus (rectius Laserianus) de Damynys in the said diocese, value not exceeding 4 marks sterling, which became void by the deprivation and removal by Roger (fn. 4) bishop of Clogher of Cornelius Ocathasaich, for his neglect to reside in contempt of the said bishop's monition, and has been void so long that by the Lateran statutes its collation lapsed to the apostolic see; summoning and removing Charles Magugyr, subdeacon, of the said diocese, who under pretext of an expectative grant made to him by the present pope accepted it after the lapse of eight months from the time of his learning the said voidance, and got provision made to him thereof, and has unduly detained possession for between two and three years without any other canonical title; whether it be void as stated, or by the deprivation, made by the late Peter bishop of Clogher, of Comedinus Omarthanan for his faults and demerits, or be void in any other way, and notwithstanding that provision was lately made to Bernard by papal authority [above, p. 546] of the sacristship of the said church, an office with cure [value not here stated], of which he is not in possession, and which, if he meanwhile obtain it, or any right in or to it, he is, as he has offered, to resign upon obtaining the vicarage. To the archdeacons of Glasgow and Whiteherne and the official of Whiteherne. Mandate, as below. The recent petition of the abbot and convent of the Cistercian monastery of St. Mary, Dundianan (rectius Dundrenan), in the diocese of Whiteherne, contained that formerly a dispute arose between the then abbot and convent of the said monastery, of the one part, and the then prior and chapter of Whiteherne, of the other part, about a number of tithes of fruits of the lands called ‘de Biskeby’ situate within the bounds of the parish of the said church of Whiteherne, which has a parish, the taking of which tithes the said prior and chapter falsely alleged to belong to them, and the abbot and convent alleging that they were not bound to pay them; and that at length an amicable composition was arrived at, as is more fully contained in letters sealed with the seals of the said two parties. At the said petition, adding that although by the said composition the question was settled etc., nevertheless William Douglas, the present prior of the said church and the chapter refuse to observe it, and molest the abbot and convent in regard to the said tithes, the pope hereby orders the above three to summon the said prior and chapter, and if they find the facts to be as stated, to compel them by ecclesiastical censure, without appeal, to observe the said composition. Mandate, at the recent petition of Edmund Fitzimond, acolyte, of the diocese of Meath—containing that the fruits etc. of the Benedictine priory of SS. Taurin and Feighin, Dofowr alias Falbrie (rectius ‘de Fowr alias Fawrie’), in the said diocese, which is conventual, has cure and is elective, and provision of which the pope recently ordered to be made to him after he should make his profession as a monk thereof, are so much diminished on account of wars, mortalities etc., that with the said fruits, whose value does not exceed 80 marks sterling, the prior cannot be decently maintained etc.—to grant in commendam to the said Edmund, to be held by him together with the said priory for life, the perpetual vicarage of Machyn in the said diocese, value not exceding 6 marks sterling, void because he, having obtained it by canonical collation, held possession for more than a year without having himself ordained priest and without dispensation. To the prior of St. Andrews in Scotland. Mandate, at the recent petition of the abbot and convent of the Augustinian monastery of Holyrood, Edymburph (sic), in the diocese of St. Andrews–containing that the perpetual vicarages of the parish churches of Falkirk (Varie capelle) and Kyngorn’ (fn. 16) were canonically united and appropriated to the said monastery, and that in virtue thereof they obtained possession and have held possession of them for many years, and have had them governed by canons of the said monastery instituted by the bishop as perpetual vicars, but that, lest they be molested, they desire the said appropriation to be confirmed by papal authority; and alleging that the yearly values of the said vicarages of Falkirk (Varia capelle) and Kyngorn’ and of the monastery itself do not exceed 20l., 20l. and 1,000l. sterling respectively—if the above prior find the facts to be as stated, to confirm the said appropriation by the said authority. To the abbot of Newbotil, and the provosts of Crichton and Corstorphin, in the diocese of St. Andrews. Mandate, at the recent petition of Archibald, abbot of the Augustinian monastery of Holyrood, Edinburch, in the said diocese (containing that after provision had been made to him by papal authority of the said monastery [above, p. 509], and he had taken oath not to alienate its rents etc., he, on account of the imprisonment of his person and many other injuries etc. which were inflicted upon him before he was admitted to the temporalities, etc., was compelled to enter into, and to swear to observe, a number of contracts etc. with divers persons, ecclesiastical and secular, in regard to a number of lands, tithes, rights and other things belonging to the monastery, whereby it has been enormously injured; that he cannot with a good conscience tolerate the same any longer and desires the said rents, tithes etc. to be revoked without delay, but fears that he cannot contravene the foregoing on account of the said oaths) to summon those concerned, make enquiry summarily etc., and if they find the facts to be as stated, to absolve the said abbot from perjury incurred by transgressing the first mentioned oath, simply or conditionally as shall seem best to them (fn. 17), decree and declare that he is free from the vice of dilapidation, relax the said last-mentioned oaths, restore the monastery and abbot, in regard to such contracts etc. as far as they have taken effect, and pronounce the said contracts etc. null, etc. Cum ad monasteriorum. To Richard Ewen, canon of London. Mandate, as below. The recent petition of Reginald Colter, prior, and the convent of the Augustinian monastery of St. Bartholomew in West[s]mythfeld, London, contained that a dispute arose formerly between them, of the one part, and John, master, and the brethren and sisters of the hospital of St. Bartholomew situate hard by (juxta) the said monastery (which hospital is of the patronage of the prior of the said monastery), of the other part, about a number of articles concerning the rights etc. of the said monastery and hospital drawn up by the late Simon bishop of London, and modified by the late bishop Richard; that at length, in order to avoid further labour and expense, and to end the said dispute etc., they agreed upon the choice of arbitrators, namely John Morkham, called a serjeant-at-law, and Nicholas Aysshton and Thomas Bingon (fn. 18), laymen, of the diocese of London, who, proceeding with all due formalities, gave an unanimous award by which they ordained and decreed, inter alia, as follows:— that, inasmuch as disputes used to arise between the said parties about the guardianship of the said hospital, when void, and about the creation, election, presentation and induction of a new master thereof, in future, as often as a new master should have to be created or elected, two brethren of the hospital should, in the name of all their co-brethren, go within twelve days after voidance of the hospital to the prior of the said monastery, or, in case of voidance of the priorship, to the sub-prior, in the event of their being present, and ask for licence to elect a master, as they had done before; and, if the prior or sub-prior (fn. 19) were not present in the monastery within the said twelve days, or if licence were asked from them in the manner and form aforesaid and they refused to grant it, then the brethren of the hospital should proceed to elect a master, who should, as hitherto had been wont, be presented by them within twelve days after the election to the said prior, if present in the monastery during those twelve days, or, in case of voidance of the priorship, to the sub-prior within the said twelve days; and that the prior or, in case of voidance, the sub-prior should present the master-elect to the bishop or, in case of voidance of the see, to the guardian of the spiritualities, for confirmation; that if the prior or, in case of voidance, the sub-prior were not present in the monastery within the said twelve days after the election, or if the prior or, in case of voidance, the sub-prior should refuse to present the master-elect to the bishop or to the said guardian, then the brethren of the hospital should, after the said twelve days, write direct to the bishop or the said guardian, and procure the confirmation of the election; that after such confirmation, they should write to the prior or, in case of voidance, to the sub-prior to induct the master-elect into corporal possession of the hospital; that the same forms etc. should be observed at each voidance of the hospital; and that the said arbitrators made other ordinances and decrees, all which the said parties approved and ratified etc., as is contained in certain letters. sealed with the seals of the said arbitrators and with the common seal of the hospital. At the said petition, the pope hereby orders the above canon, if he find the said award, ordinances and decrees etc. to be lawful, to confirm them, and to cause them to be perpetually observed. Mandate, at the recent petition of Andrew Ocluman, priest, and the rest of the friars and sisters of the third order of St. Francis, called the order of Penance, dwelling in the diocese of Achonry (containing that formerly John Ohadra, donsel and temporal lord of the place de Campolagrine (sic) in the said diocese, for the welfare of his soul and the souls of his progenitors, and to the praise of God and the Blessed Virgin Mary, and out of reverence for the said Saint, granted in frankalmin, with the consent of his brother and children, a number of lands etc., namely a half townland and the possessions called the cantred of Arduabair and the cantred of In[i]smaid and the place Ciurtw[i]lleag, in the said diocese (fn. 20), with all their appurtenances, to the said Andrew, friars and sisters for the building of a house of the said order in the said place Ciurtwilleag, and that Cornelius bishop of Achonry, with the consent of the chapter of Achonry, confirmed the same; and adding that the said Andrew has begun the building of a house or church for the use and habitation of the said friars and sisters in the said place) if the above bishop find the facts to be as stated, to confirm by papal authority the said grant and confirmation, and in the event of his doing so, to grant licence to the said Andrew, friars and sisters to complete the said house or to build another, with church, bell, bell-tower, cemetery, dormitory, refectory etc. in the said place, and to transfer themselves thither; saving the right of the parish church and of any other.
