Mandate (the pope having been informed by Denis Olucharan, priest, of the diocese of Armagh, that Nicholas Ohaermegaidh, perpetual vicar of Domnachsinra (rectius Domnachfinra) in the said diocese, an open and notorious fornicator, has dilapidated etc. the goods of the said vicarage and, being excommunicated and publicly proclaimed excommunicate, has celebrated masses and other divine offices in contempt of the Keys, contracting irregularity, to the shame of the clerical order) if Denis (who was lately dispensed by papal authority, on account of illegitimacy as the son of unmarried parents, to be promoted to all even holy orders and hold a benefice even with cure, after which he caused himself to be so promoted and obtained the [perpetual] vicarage of Termunncumm[i]n in the said diocese, which he afterwards resigned), inasmuch as from fear of Nicholas's power he cannot safely meet him in the city and diocese of Armagh, accuses Nicholas before the above three, to summon him, and if they find the foregoing to be true, to deprive and remove him from the said vicarage of Donnachsinra (sic), and in that event to collate and assign it, value not exceeding 3 marks sterling, to Denis, whether it become void by such deprivation, or by the deprivation, made by authority of the ordinary by a definitive sentence which became a res judicata, of Donatus Micgillindam, priest, of the said diocese, for his faults and demerits, or by the resignation of the said Nicholas and Donatus, or in any other way. Mandate to collate and assign to Donald Macbrien, priest, of the diocese of Emly (who was lately dispensed by papal authority, on account of illegitimacy as the son of a priest and an unmarried woman, to be promoted to all even holy orders and hold a benefice even with cure, after which he had himself so promoted) the rectory of Gallbale alias Natharlach in the said diocese, of lay patronage, value not exceeding 8 marks sterling, so long void by the death of Geoffrey de Burgo that by the Lateran statutes its collation has lapsed to the apostolic see, summoning and removing William Odubartaig, priest, of the said diocese, who took possession by his own temerity and has without any title unlawfully detained it for more than three years but less than four; whether it be so void, or by the death of Macrobius alias Macrarth (rectius Macraith) Ycangussa, or by the resignation of the said Geoffrey or Macrobius, or in any other way. Mandate (the pope having been informed by William Ofergayl, clerk, of the diocese of Ardagh, that Maurus Macgillavonaem and Eugenius Macmuicertaig (sic), behaving as perpetual vicars of Granard in the said diocese, divide and simonically share the said vicarage, (fn. 8) dilapidate and alienate etc. its goods, and, each of them, openly keep a concubine, to the shame of the clerical order) if and after the said William (who, notwithstanding his illegitimacy as the son of unmarried parents who were related in the fourth degree of affinity and were of a noble race of dukes, has been made a clerk, and who from fear of Maurus and Eugenius has no hope of obtaining justice in the city and diocese of Ardagh) accuses Maurus and Eugenius before the above three, to summon them, and if they find the foregoing to be true, to deprive whichever of them holds the said vicarage, and remove both of them therefrom, and in that event to collate and assign the said vicarage, which it is said was formerly of lay patronage, although no patron is now to be found, (fn. 9) value not exceeding 50 marks sterling, to William, who is hereby dispensed, notwithstanding the said defect, to be promoted to all even holy orders and receive and retain it. Mandate—the pope having been informed by Salomon Ohegertayd, clerk, of Derry, that Rouelinus Omurgessan, priest, of the diocese of Derry (on the voidance of the parish church of Cluoynman in the said diocese by the deprivation and removal for his faults and demerits made by the late John bishop of Derry, by his ordinary authority, of John Omurgessan, by a definitive sentence which became a res judicata) by a simonical agreement paid a sum of money to the official of the said bishop, thereby incurring excommunication, and by means of the said official procured the making to himself, being thus excommunicate, of collation and provision of the said church, took possession under pretext thereof, and still unlawfully detains it; and that he has committed perjury and has dilapidated etc. the goods of the said church—the said collation and provision being without force, if and after Salomon (who was lately dispensed by papal authority, on account of illegitimacy as the son of a priest, a canon professed of the order of St. Augustine and an unmarried woman, to be promoted to all even holy orders and hold a benefice even with cure) accuses Rouelinus before the above abbot, to summon Rouelinus, and if he find the foregoing to be true, to declare the said collation and provision and their consequences null and void and remove him, and in that event to collate and assign the said church, value not exceeding 6 marks sterling, to Salomon, who is hereby dispensed to receive and retain it, and to resign it, simply or for exchange, notwithstanding the said defect etc. Vite etc. (P. and H. Collation and provision to him (who was lately dispensed by papal authority, on account of illegitimacy as the son of a priest religious professed of the order of St. Augustine and an unmarried woman, to be promoted to all [even] holy orders and hold a benefice even with cure, after which he had himself made a clerk) of the perpetual vicarage of Fathynmura in the diocese of Derry (Deren.), the value of which, after deducting its burdens, ordinary and extraordinary, does not exceed 4 marks sterling, void at the apostolic see, and therefore reserved, by the death there of Patrick Magroday; notwithstanding that the pope recently ordered provision to be made to him of the deanery of Derry, a major elective dignity with cure, value not exceeding 48 marks sterling of which he has not possession and which was then expected to become void in a certain way, and dispensed him by the same letters to receive and retain it, notwithstanding the said defect, on account of which the pope hereby dispenses him to receive and retain the said vicarage, and to resign it, simply or for exchange, when he pleases. The pope further grants to him, seeing that in the matter of the impetration of the said deanery he has endured great labours and expenses, that he may, without prejudice of the right of others, obtain possession of the vicarage before he obtains possession of the deanery, and nevertheless prosecute any right belonging to him in or to the said deanery, and win and obtain possession of the deanery, and freely and lawfully retain the vicarage meanwhile until he has obtained peaceable possession of the deanery, and decrees that by the obtaining of the vicarage the said right shall in no wise be considered to be void.
