To William Ogilby, clerk, of the diocese of St. Andrews, M.A. Grant to him (who is by both parents of noble birth, and to whom the pope lately ordered provision to be made of the deanery of Ross, previously reserved) after he has in virtue of the said letters obtained possession of the said deanery, which is a major elective dignity with cure, value not exceeding 24l. of old sterlings, to resign it, simply or for exchange, into the hands of the bishop of Ross or any other ecclesiastical prelate of his choice, without requiring licence of the apostolic see and any other; with faculty for the said bishop or prelate to receive and admit such resignation and carry out the exchange, etc. Nobilitas generis, litterarum etc. (P. and A. de Amelia. | P. xxx. de Varris.) Dispensation to him, who is a priest, and is by both parents of knightly birth, (fn. 2) to receive and retain for life with the said church, value not exceeding 10 marks sterling, any other benefice with cure or otherwise incompatible, even if a major or principal dignity, etc., and to resign it, simply or for exchange, as often as he pleases, provided that he do not hold two major or principal dignities, or two parish churches or their perpetual vicarages, or such mixed. To the bishop of Brechin. Mandate, as below. Nicholas V (upon its being set forth to him by James king of Scots that formerly James bishop of St. Andrews, at the petition of the late William de Creichton, then temporal lord of Creichton in the diocese of St. Andrews, chancellor of Scotland, had erected, with consent of the late James de Creichton, knight, son and heir of the said William and of the prior and chapter of St. Andrews, the [parish] church of the said place of Creichton, which was of the patronage of the said William, into a collegiate church, had instituted therein a provostship, being a principal dignity, eight canonries and prebends for as many canons forming the chapter, and two for two boys, and a perpetual vicarage to which should belong the cure of souls of the parishioners, had united and appropriated to the said collegiate church, with the consent of the rector, the parish church of Lochquhorquhart in the said diocese, had instituted in that church a perpetual vicar to exercise the cure of souls of the parishioners, and had reserved the patronage of the said provostship and canonries and prebends and vicarage, and the presentation thereto as often as void to the said William and his successors; and that the said William had sufficiently endowed the said collegiate church and its fabric and the said provostship, canonries and prebends and vicarage, and had notably augmented the original foundation, as is contained more fully in certain letters sealed with the seal of the said bishop James and chapter, William and James his heir) ordered, at the petition of the said king, the bishop of Whiteherne, if he found the foregoing to be as stated, to confirm the said erection, creation, institution, union, appropriation, reservation, endowment and augmentation etc., and make good any defects in the proceedings of the said bishop James etc. [see Nicholas V's mandate in Cal. Papal Lett., Vol. X, p. 64]. The recent petition of the said king and of the chapter of the said erected church contained that Thomas bishop of Whitherne made the said confirmation etc.; that after the said chapter had, in virtue of the said union etc. and confirmation, held for about four years the said united church, they, in a cause brought against them by James Borthwic, priest, of the said diocese, about the said united church (provision of which he alleged to have been made to him by papal authority, as void in a certain way, and which he alleged to belong to him) and ventilated by the present pope's commission before divers judges in the said [Roman] court, won a definitive sentence by which the said union and appropriation and their consequences were declared to have been and to be canonical, and perpetual silence imposed on the said James, and procured in the matter of the execution of the said sentence, which became a res judicata, the decreeing of the processes in the customary form. At the said petition of the said king and chapter, who allege that the values of the said collegiate church and united church do not exceed 40l. and 20l. sterling respectively, the pope hereby orders the above bishop of Brechin, if he find the foregoing to be as stated etc., to approve and confirm the said bishop [Thomas's] proceedings taken in virtue of the said letters of pope Nicholas etc., and cause the said sentence to be observed by ecclesiastical censure, without appeal. To the bishop of Perugia, the precentor (cantori) of Moray and the chancellor of Brechin. Mandate, at the recent petition of Patrick Blar, priest, of the diocese of Brechin (containing that he simonically bound himself to pay to Thomas de Hay, [now] clerk, of the diocese of St. Andrews, 20 marks a year of the money of Scotland from the fruits etc. of the perpetual vicarage of Alycht in the diocese of Dunkeld, if Thomas would resign it in his favour: that Thomas accordingly resigned it to Thomas bishop of Dunkeld, who, ignorant of the said bargain, admitted the resignation and made collation and provision to Patrick; and that under pretext thereof Patrick obtained possession and has held it for about a year, and has in accordance with the said bargain made money payments to Thomas) to absolve Patrick from the sentences etc. incurred by the said simony, enjoining penance, dispense him on account of irregularity, and rehabilitate him. Mandate, at the petition of Odo Yceindedyg, layman, and Morina Inycearbaill, of his diocese (containing that they formerly, not in ignorance that they were related in the second and third degrees of kindred and the third and third and the third and fourth and the fourth and fourth degrees of affinity, (fn. 4) committed fornication several times) after absolving them from the crime of fornication and incest, and enjoining penance, to dispense them to marry, notwithstanding the said impediments of kindred and affinity etc., proclaiming legitimate the offspring born, if any, and that to be born of the marriage. Dispensation, at his own petition and that of Henry (sic) duke of Norfolk, who says that James is his kinsman and that he is in about his sixteenth year, so that after he is in his eighteenth year he may receive and retain for life any two benefices with cure or otherwise incompatible, even if major or principal dignities etc., and resign them, simply or for exchange, as often as he pleases, provided that he do not hold two parish churches or their perpetual vicarages, or such mixed. To the bishop of Cloyne (Clonen.). Mandate, as below. The petition of Maurice Iherlathi, clerk, and Joan Inyymwyt, of the dioceses of Ardfert and Limerick, who are dwelling in the above bishop's diocese, contained that formerly, Maurice not being ignorant, but Joan being ignorant, that they were related in the third degree of affinity, they cohabited for eight or nine years, committed fornication several times and had offspring, so that by common opinion they were and are reputed to be true man and wife; but that, it having come to Joan's knowledge that they were joined by the said affinity, they have thenceforth for more than a year abstained from carnal intercourse, although they still cohabit. At the said petition, adding that if the foregoing were divulged, and if they were separated, Joan, without hope of marriage, would with the said offspring be defamed, the pope hereby orders the above bishop to dispense them, after imposing penance for the said incest, to contract marriage and remain therein, decreeing legitimate the said offspring and that to be born of the marriage.
