Mandate to dispense Patrick lord of Haliburton, nobleman, and Margaret de Hepburn, damsel, noblewoman, of his diocese, to remain in the marriage which they formerly contracted per verba legitime de presenti in ignorance that, as they afterwards learned, they are related in the third and fourth degrees of kindred, proclaiming legitimate the offspring [born, if any, and that] to be born of the said marriage. To Thomas Olean, perpetual vicar of Cromiyth in the diocese of Limerick. Dispensation to him (who was formerly dispensed by papal authority, on account of illegitimacy as the son of a priest and an unmarried woman, to be promoted to all even holy orders and hold a benefice even with cure, in virtue of which he was so promoted and obtained the said vicarage, collated to him by authority of the ordinary) to receive and retain four other benefices with or without cure, compatible with one another and with the said vicarage, and to resign them all, simply or for exchange, as often as he pleases, and hold instead five other compatible benefices. To the archdeacon of Killaloe (Leonien, rectius Laonien.) and Donald Ocuynt [sic] and David Ocormachay [sic], canons of the same. Mandate as below. The pope has been informed by Cornelius Oladyan, clerk, of the diocese of Killaloe, that after Martin V's renewal of all sentences of excommunication etc. for simony, and his reservation to himself and his successors of absolution therefrom, upon the voidance of the perpetual vicarage of Vngare in the said diocese by the deprivation, made by Donatus bishop of Killaloe, of Henry Oladyan for his demerits, Denis Odalay, priest, of the said diocese, promised the said bishop that if he made him collation of the vicarage he would, in return for obtaining the collation, pay him a certain sum of money, and also do so yearly in future (fn. 2); that the said bishop, after the said promise, collated the vicarage to Denis, but only de facto; and that Denis paid the sum for some years, (fn. 2) and under pretext of the said collation and provision took possession and still detains it, thereby incurring the guilt of simony and the said sentences etc. The said collation and provision being therefore without force, and the vicarage being, as the pope has learned, still void as above, he hereby orders the above three, if and after Cornelius (who was lately dispensed by authority of the ordinary, on account of illegitimacy as the son of a clerk in minor orders, after an unmarried woman, to be promoted to minor orders, after which he had himself tonsured) accuses Denis before them, to summon Denis and if they find the foregoing to be true, to declare the said collation and provision and their consequences null and void, and in that event to collate and assign the vicarage, value not exceeding 5 marks sterling, to Cornelius; whether it be void as above, or by the death of David Odalyd or the free resignation of the said Denis or Henry Yladyan, or in any other way. The pope hereby dispenses him to be promoted to all even holy orders and receive and retain the vicarage, notwithstanding the said defect etc. Vite etc. (P. and Ernestus. | P. xxv. Sextodecimo Kal. To the bishop of Achonry (Akaden.). Mandate, at the recent petition of Eugenius Omyged, clerk, and Felorsia Yngheagram, of his diocese (containing that formerly, he not being ignorant, but she being ignorant, that she was related to him in the double third and double fourth degrees of affinity, because he had committed fornication with another woman related to her in the same degrees of kindred, they contracted marriage per verba de presenti, consummated it and had offspring) after temporary separation, to absolve Eugenius from sentence of excommunication incurred, enjoining penance, and thereup⊙n to dispense them to contract marriage anew and remain therein, decreeing legitimate the said offspring and that to be born. Lib. 1.’ The contemporary flyleaf and about the first twenty folios have gone, and the first few of those that remain are injured by water. On the bottom edge of the volume is the usual contemporary description, hardly legible in parts: ‘Primus de diversis et de conservatoriis anno quarto domini nostri domini Calisti pape tertii.’ There are cclxxviii. ff. of text, of which the earlier ones are missing, as mentioned, and some of the others are blank.
