To the abbot of St. John the Evangelist's, Tuam, and Dermit Oscara and Thomas Macbressim (sic), canons of Tuam. Mandate (the pope having been informed by Milerus Bremchram (? rectius Bremicheam), clerk, of the diocese of Tuam, that Thady Ohauli (rectius Ohanli) alias Ohanin, rector of Dunmor in the said diocese, has alienated etc. the fruits etc. of the rectory and consumed them for the uses of a certain concubine (fornicarie) whom he openly keeps in his own house and by whom he has had offspring, even living, and for other evil uses, has committed perjury and simony, and is greatly defamed in those parts of the aforesaid and divers other crimes and excesses) if and after Milerus, who is illegitimate, being the son of unmarried parents, accuses Thady before the above three, to summon him, and if they find the foregoing to be true, to deprive and remove him, and in that event to collate and assign the rectory, of the patronage of laymen and value not exceeding 24 marks sterling, to Milerus, whether it become void by such deprivation and removal, or be still void by the death of Raymund Bremicharam (sic) (fn. 2) at the apostolic see, or by the resignation of the said Thady, or in any other way, provided that the said patrons consent. The pope hereby dispenses him to be promoted to all even holy orders and receive and retain the said rectory or any other benefice with cure, notwithstanding the said defect etc. Vite etc. (L. To the prior of Yniscronnan in the diocese of Killaloe (Laonien). Mandate, as below. The pope lately, upon learning that the rectory called [the rectory] of the rural lands of Cimhy and Ocayssin in the diocese of Killaloe, with cure and of lay patronage, had been so long void (because Thady Maccommara had obtained, collated to him by authority of the ordinary, the perpetual vicarage of Rylleogennedi [rectius Kylleogennedi] in the said diocese) that its collation had by the Lateran statutes lapsed to the apostolic see, although the said Thady had by his own temerity unlawfully detained it together with the said vicarage for five years without papal dispensation or any tittle of right, ordered the provost of Elphin to summon him and others concerned, and to collate and assign the said rectory to Henry Olladrayn, priest, of the said diocese, the pope's letters expressing its value as not exceeding 25 marks sterling, as was alleged by Henry. The pope, having been informed by Thady [son] of Donatus Maccommara, clerk, of the said diocese, that the value exceeds 40 marks sterling, and that the said Thady Maccommara has incurred perjury and committed simony and alienated etc. many goods of the rectory, hereby orders the above prior to summon the said Henry and Thady Maccommara, and if he find that the value amounts to 40 marks, to decree and declare that the said letters and their consequences are null and void, and that Henry has no right in the rectory, and if and after Thady Donati accuses Thady Maccommara before the above prior, to summon him, and if he find the foregoing or one of them enough for the purpose to be true, to deprive and remove him, and in the event of his making such declaration or deprivation, to collate and assign the rectory to the said Thady Donati, its value, as he alleges, not exceeding 50 marks sterling. Confirmation etc., as below. Nicholas V, upon its being set forth to him by James lord de Hammylton, knight, of the diocese of Glasgow, that he, considering that the parish church of Hammylton, otherwise called from of old Cadzow, in the said diocese etc., as above, Reg. Vat. CCCXCIII, f. 324, ordered the bishop of Glasgow to erect the said parish church into a collegiate church, etc. as ibid. (fn. 3) Afterwards, as the pope has learned, Thomas bishop of Whiteherne and Archibald abbot of Holyrood, Edinburgh, whom the late William bishop of Glasgow commissioned to proceed in his stead, erected the said parish into a collegiate church, with the insignia etc. of other collegiate churches in Scotland, created the provostship, a principal dignity, from the fruits etc. of the perpetual vicarage of the said parish church, the presentation thereto to belong to the said knight and his heirs, and the institution to belong to the bishop of Glasgow etc., as is contained more fully in the letters of the said pope Nicholas and the said bishop of Whiteherne and abbot. Seeing that a dispute subsequently arose between George de Graham and Martin Vaus, clerks, of the said diocese and that of Aberdeen, about the said provostship, to which, on its voidance by the death of the last vicar or provost or after the said erection, they alleged that they had been presented by the said knight as the true patron and by Thomas Vaus dean of Glasgow, respectively, that the cause was by Martin's appeal lawfully introduced to the Roman court and committed by the present pope to a certain papal auditor, and that Martin has given up to the pope the suit and all his right in and to the provostship, and the said dean Thomas all right in and to the presentation and the taking of a pension of 4 marks sterling from the said vicar, by their proctor Gilbert de Rerich, a canon of Glasgow, the said knight has petitioned the pope to confirm the aforesaid letters, erection etc. The pope therefore confirms and approves the said letters, erection etc. and their consequences, and makes collation and provision of the said provostship, a principal dignity with cure, of lay patronage, as above, and value not exceeding 12l. sterling, howsoever void, to the said George; with mandate executory hereby to the bishop and archdeacon of Glasgow (fn. 4) and the provost of St. John Baptist's, Corstorfyn, in the diocese of St. Andrews, to induct him etc. Ad perp. rei mem. Confirmation etc., as below. The pope lately (upon its being set forth to him by Nemeas and Richard de Ybernia, Friars Minors of the Observance, that although there were in the province of Ireland many places of the said order, there was only one in which the due Observance was kept according to the rite of the order of the Observants, but that all the said places were ruled by conventual or non-observant friars) ordered the bishop of Killala to grant to the said two friars licence and faculty to reform four places of the said friars conventual and to reduce them, with consent of the friars dwelling therein, to the Observance, keep therein the regular observance according to the order, rule and rite of the Observants, and live and remain under the obedience of the ultramontane vicar-general of the Observance [above, Reg. Vat. CCCCLXXVI, f. 231d.]. At the recent petition of the vicar-provincial and Friars Minors of the regular Observance of the said province (containing that although the late Bernard bishop of Killala reformed and reduced to the regular Observance three convents of the said order in the said province in accordance with the said letters, nevertheless certain Friars Conventual of the province in many ways disturb the said friars of the Observance, thus reformed, and have lodged a frivolous appeal to the pope and the apostolic see) the pope hereby confirms and approves the reform made by the said bishop and its consequences, etc., imposes perpetual silence upon the said Friars Conventual in regard to the said and any other frivolous appeals etc. against the said reform, and orders the bishop of Killala to cause it to be observed, and not allow the said friars of the Observance to be molested. To John bishop of Hereford (Herforden.). Faculty to him (who is so old and weak that he can no longer rule and administer the said church, and proposes to resign it to the pope, provided that a pension on the fruits etc. of his episcopal mensa be reserved and assigned to him) to treat with a suitable person, in the event of his so resigning and his resignation being admitted by the pope, and of provision being made to such person, for the reservation and assignment to John for life by such person and his successors of a pension not exceeding a third part of the said fruits etc., to be paid under pain of suspension and deprivation; provided that the result of such treaty be reported to the pope. To the bishops of Orte and St. Andrews and the abbot of Dunfer[m]lim in the diocese of St. Andrews. Mandate, as below. The pope has learned by the complaint of the abbot and convent of the Benedictine monastery of St. Thomas the Martyr, Aberbroth, in the diocese of St. Andrews, that although a number of parish churches of divers other dioceses have been united thereto, and that although they have been granted, inasmuch as they have in all such churches perpetual vicars instituted by the bishops and obedient thereto, the privilege of not being bound to appear at annual synods, except that only of the ordinary, the bishop of St. Andrews, nevertheless a number of other bishops and ordinaries of such places or churches disturb them on account of the said churches, and cause their fruits etc. to be sequestrated on the pretext that the abbot and convent do not obey them, or do not appear at their synods or chapters, or do not pay the immoderate exactions or subsidies etc. imposed by the said bishops etc., or neglect the smallest expense for the repair of the said churches, (fn. 6) and, because they do not obey the mandates and sequestrations of the said bishops, excommunicate both them and the parishioners, tithe-payers etc. of them and of the said churches for paying their debts and tithes to the monastery. (fn. 7) At the said petition the pope hereby orders the above three to inhibit all bishops and ordinaries, except only the bishop of St. Andrews, under pain of ipso facto excommunication etc., to molest the said abbot and convent or monastery or tithe-payers or debtors etc. on account of the said churches or sequestrations, or sequestrate the fruits etc. of those churches, which fruits etc. the pope hereby exempts from the jurisdiction of the said bishops, or to excommunicate the abbot and convent or their debtors for paying their tithes; with faculty hereby to the above three to grant to the abbot for the time being of the said monastery or its claustral sub-prior, or other his deputy, that they may, for the said debts etc., constrain the bishops’ debtors or other notorious detainers of the goods of the said monastery, by ecclesiastical censures etc. until becoming satisfaction is made, and thereafter to give absolution. (fn. 8) They are furthermore to hear and decide, without appeal, all causes to be brought by the abbot and convent against the said bishops and ordinaries, causing their decision to be observed by ecclesiastical censure, and have faculty to make citations etc., even by public edict, which shall be binding upon those concerned as if personally served upon them.
