Obrot[h]e, a canon of Ossory, to be received as a monk of the Cistercian monastery of St. Mary [the Virgin], Kilcooly (de Arvicampo), in the diocese of Cashel, and to receive his profession. The pope recently, on learning the voidance of the Cistercian monastery of St. Mary the Virgin, Kilcooly (de Arvicampo) by the death of Philip Omulwardayn alias Obrothe, made a grant of provision thereof to Malachy Omulrian, a Cistercian monk of Holycross, Wotheycland (sic), in the same diocese of Cashel. The said Malachy having this day resigned to the pope the said grant, before the letters thereabout have been drawn up, and the said monastery being therefore still void as above, the pope, recapitulating the preceding mandate to cause the above William Omulwardayn alias Obrothe, to be received as a monk of St. Mary's, orders the above abbot, if he find the said William (who was lately dispensed by papal authority, on account of illegitimacy as the son of the said Philip, then professed of the said order, and an unmarried woman, to be promoted to all, even holy orders, and hold any compatible benefices of any number and kind, and to resign them, simply or for exchange, as often as he pleased) to be fit, to make provision to him of the said monastery, value not exceeding 16 marks sterling. The pope hereby grants him indult to be blessed by any catholic bishop, and dispenses him to rule etc. the monastery, notwithstanding the said defect and that the said Philip was his father and in the church of the monastery ministered in the sacrifice of the altar, etc. Solicite considerationis. To the bishop of Silves (Silvensis) and the abbots of Melros and Calco in the dioceses of Glasgow and St. Andrews. Mandate, as below. The recent petition of Thomas Penven, priest, of the diocese of Glasgow, M.A., contained that after Nicholas V had granted provision to Robert Penven, then a clerk, of the diocese of St. Andrews, of a canonry of Glasgow and the prebend de Glasgu primo when they should become void by the obtaining by the said Thomas of another canonry and prebend of the said church or in any other way except by Thomas's death, the said Thomas and the late Adam Athinlek [rectius A[u]chinlek] resigned for purpose of exchange their respective canonries and prebends de Glasgu Primo and Kyrkmanchquho, namely Thomas by an alleged proctor and Adam in person, to the ordinary, who carried out the exchange. Subsequently, upon the parish church of Thancarton in the said diocese [of Glasgow] becoming void by the death of Gilbert de Farule, Andrew bishop of Glasgow made collation and provision thereof to the said Thomas, who in virtue of such collations and provisions obtained and still holds possession of the said canonry and prebend and parish church. At the said petition, adding that he doubts whether the said collations and provisions hold good, because he was promoted to all even holy orders by another bishop without letters dimissory of his ordinary, and to two of them, namely those of acolyte and subdeacon, on one day, the pope orders the above three to collate and assign to the said Thomas, who is also a bachelor in decrees, the said canonry and prebend
of Kyrkmanchquho, which is of lay patronage, the consent of the patron of which was given on the occasion of the aforesaid collation and provision to Thomas, and whose fresh consent is not required, and also the said parish church, value together not exceeding 60l. sterling; whether the said canonry and prebend be void as stated, or by the death of the said Adam, or by the promotion of Thomas de Spens to the church of Whiteherne, or by his consecration which was administered without the Roman court, or whether they and the said parish church became void in any other way. To the bishop of Brechin, the abbot of Dundranen in the diocese of Whiteherne, and the dean of St. Patroclus's, Soest (Susacien.), in the diocese of Cologne. Mandate, as below. The recent petition of Robert de Colston, rector of the parish church of Kyrkcrist in the diocese of Whiteherne, contained that his predecessor held, as united to the said parish church, the church or chapel called Kyrknok (fn. 4) situate within the bounds of the said parish (in which church or chapel a nun or otherwise religious woman used to dwell of old), took its tithes etc. and exercised the cure of souls of the parishioners who dwelled thereby, and that Robert himself, following his said predecessor's example, has continued the said possession for about eight years; but that, inasmuch as no other proof can be given of such union etc., he fears to be interfered with in regard to the said tithes etc. and the continuance of such possession. At the said petition, adding that no nun or religious woman has for thirty years led a regular life in the said church or chapel, and that its buildings are fallen, and that it has been so long void that there is no certain knowledge of the true way of its voidance, the pope hereby orders the above three to summon those concerned, and if they find the facts to be as stated, to approve and confirm the said union etc., if any such has hitherto taken place, and moreover, pro potiori cautela, to unite etc. the said church or chapel, howsoever void, to the said parish church, value not exceeding 6l. and 10l. sterling respectively, so that Robert may take and continue possession thereof, and convert the said tithes etc. to his own uses and those of the said parish church, etc. Decet Romanum pontificem. Mandate (the pope having been informed by Patrick Obugyll, priest, of the diocese of Derry, that Conossius Obugyll, rector of Leamcayll in the said diocese, has committed simony, and perjury and dilapidated the goods of the said church) if and after Patrick accuses Conossius before them, to summon him, and if they find the foregoing to be true, to deprive and remove him, and in that event to collate and assign the church, value not exceeding 6 marks sterling, to Patrick. To the prior of Dearg in the diocese of Ardagh. Mandate as below. Upon the rectory of the rural lands or plebes

of Muntyreolays in the diocese of Ardagh, said by some to be of lay patronage, although no lay patron is to be found who has used such right, becoming void at the apostolic see and therefore ipso facto reserved to the pope, by the death there of its rector, Robert Magranail, the pope granted provision thereof to Rory Magranayl, clerk, of the said diocese, who also died at the said see, so that it is still reserved, although a number of canons of Ardagh (on the ground that Cormac bishop of Ardagh had formerly divided [amongst] the canons's prebends the said rectory, as void by the death of Cornelius Y[f]argayl, after the issue of a citation by a certain papal delegate at the instance of the above Robert, to whom provision had been ordered to be made by papal authority, although the said bishop afterwards consented to the sentence delivered on behalf of the said Robert) have unduly detained possession, as they still do, of a part of the said rectory. The pope therefore orders the above prior to collate and assign the rectory, the cure of which has been wont to be exercised by perpetual vicars, and whose value does not exceed 24 marks sterling, to Donald Ofeargayl, clerk, of the same diocese, who is illegitimate, being the son of a priest and an unmarried woman, summoning and removing the said canons and any other unlawful detainers; whether it be void as above, or by the resignation of the said Robert and Rory or of Donatus Y[f]argayl, clerk, of the same diocese, or by the deaths of Malachy Miccukoyg and the said Cornelius Y[f]argayl, or in any other way.
