Lateran Regesta, Vol. DCVII. (fn. 1)

1 Paul II.

De Beneficiis Vacantibus.

1464.
16 Kal. Oct.
(16 Sept.)
St. Peter's, Rome.
(f. 81.)
To the treasurer of Killaloe (Laonien.). Mandate, as below. Pius II. (on its being set forth to him on behalf of Richard Ychayll, priest, of the diocese of Emly, that on the voidance of the perpetual vicarage of the parish church of Emly (Imelacen.) by the resignation of John Ychayll to the present bishop of Emly, the said bishop made collation and provision of it to the said Richard, who was lately dispensed by papal authority on account of illegitimacy, as the son of a priest and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure, and who in virtue of the said collation and provision obtained possession, but who doubted whether they held good) granted the said Richard, under date Non. Aug. anno 6 [1464] a mandate to a certain judge to collate and assign to him the said vicarage, value not exceeding 16 marks sterling, whether void as above, or by the deaths of William Yleddan and John Ychayll, clerks, of the diocese of Emly, or in any other way. Lest the said grant etc. remain without effect, because the said pope died before his letters thereon were drawn up, the pope hereby decrees that it shall hold good from the said date, and orders the above treasurer to make collation and provision to Richard of the said vicarage. Rationi congruit. (B. and Jo. de Millinis. | B. xxviii. Septimo Kal. Octobris Anno Primo.Coronensis.) [3½ pp.]
16 Kal. Oct.
(16 Sept.)
Lateran. (fn. 2)
(f. 91d.)
To the dean, the sacrist and Donatus Ohurayn, canon, of Clonfert. Mandate to collate and assign to Arthur Churayn (? recte Ohurayn), priest, of the diocese of Clonfert, the perpetual vicarage of the parish church of Kyllcuahain in that diocese, value not exceeding 3 marks sterling, void by the resignation of Adam Ybrogay to Thomas, bishop of Clonfert, and also the rectory of the rural lands of Magonnbharlay in the same diocese, of lay patronage and without cure, value not exceeding 2 marks sterling, void by the death at the Roman court of James Ocormaicain, although Maurice Ocormaicain, clerk, of the said diocese, has without any right detained the said rectory for between two and three years; summoning and removing the said Maurice and any other unlawful detainers. Vite etc. (P. and Jo. de Augeroles. | P. xx. Quinto Id. Octobris Anno Primo. de Varris.) [2¾ pp.]
8 Id. Oct.
(8 Oct.)
St. Peter's, Rome.
(f. 160.)
To Gilbert Hartur, canon of Limerick. Mandate, as below. The recent petition of Cornelius Micconmara, clerk, of the diocese of Killaloe (Laonien.), contained that after he had been dispensed by papal authority on account of illegitimacy, as the son of unmarried parents, to be promoted to all, even holy orders and hold a benefice even with cure, on the voidance of the perpetual vicarage of the parish church of Kyllyelly [in the diocese of] Limerick he obtained possession thereof, under a collation made to him by the said authority, and held it for more than a year, although molested by a certain adversary, without having had himself ordained priest and without dispensation for the purpose, and has even held it for four more years and longer by tolerance of his ordinary on account of the said molestation. The said vicarage being therefore still void, and moreover the rectory of Deumlayll (? recte Drumlayll) in the diocese of Killaloe (Laonien.) being void at the apostolic see, and therefore reserved to the pope, by the death there of Odo [son] of James Micconmara, the pope hereby orders the above canon to collate and assign the said vicarage, which has cure, and rectory, which is without cure, value not exceeding 6 and 2 marks sterling respectively, to the said Cornelius. He is hereby specially dispensed to receive and retain them, notwithstanding the said defect, etc. Dignum arbitramur. (H. and A. de Cortesiis. | H. xxx. Expedita Octavo Kal.Novembris Anno Primo. Folani.) [2½ pp.]
17 Kal. Nov.
(16 Oct.)
St. Peter's, Rome.
(f. 225d.)
To Denis Odeach, canon of Killaloe (Leonien., recte Laonien.). Mandate, as below. The pope has been informed by Laurence Macconmara, clerk, of the diocese of Killaloe (Laonien.), that Thady Maccaucrhynne, perpetual vicar of the parish church of the place of Clonlochan in the said diocese, has dilapidated and alienated the moveable goods of the said vicarage, has kept in his own house a concubine, by whom he has had offspring, and has committed perjury, to the shame of the priestly dignity, about which things he is defamed in those parts. The pope therefore hereby orders the above canon, if Laurence, who alleges that he is by both parents of a race of dukes, will accuse Thady before the said canon, to summon Thady and others concerned, and if he find the foregoing to be true, to deprive and remove Thady, and in that event to collate and assign the said vicarage, value not exceeding 4 marks sterling, to Laurence; whether it be then void by such deprivation and removal, or be still void by the death of Cornelius Mickellamure, or in any other way. Dignum arbitramur. (P. and Jo. de Millinis. | P. xx. Sexto Kal. Novembris Anno Primo. de Varris.) [3¾ pp.]

(16 Sept.)
St. Peter's, Rome.
(f. 256d.)
To the bishop of Orte, the abbot of St. Mary's, Ferns, and Gerald Otuayl, canon of Dublin. Mandate etc., as below. Pius II., upon learning that Odo Odougnach, perpetual vicar of the parish church of Newcastle (de Castro novo) Magrunagayn [sic], alias Kylladraguyn, in the diocese of Dublin, proposed to resign, granted, under date 5 Id. Aug.anno 6 [1464], a mandate to certain judges to receive and admit Odo's resignation, and thereupon to collate and assign the said vicarage, value not exceeding 16 marks sterling, to Patrick Mackyncangy, clerk, of the said diocese, who had been dispensed by authority of the ordinary on account of illegitimacy, as the son of unmarried parents, to be promoted to all [minor] orders and hold a benefice without cure; the said pope at the same time specially dispensing him to receive and retain the said vicarage for life, notwithstanding the said defect, etc. Lest the said grant remain without effect, because on account of the death of the said pope his letters were not drawn up, the pope hereby decrees that the said grant and dispensation etc. shall hold good from the said date, and that the present letters shall be sufficient proof thereof, and hereby orders the above three to receive and admit the said Odo's resignation, and thereupon to collate and assign the vicarage to Patrick. Racioni congruit. (H. and [—]. | H. xxv. Expedita Septimo Idus Octobris Anno Primo. Folani.) [4 pp. See Cal. Papal Lett., XI, pp. 306, 340, 477.]
