To the abbot of Holyrood, Edimburg, in the diocese of St. Andrews, the archdeacon of Huete in the church of Cuenca (Conchen.), and Gilbert de Rerick, canon of Glasgow. Mandate, as below. The pope, having learned that the parish church of Tunergach in the diocese of Glasgow, of lay patronage, was void by the death at the apostolic see of Edward Loel, granted provision thereof, under date 3 Kal. Oct. anno 2 [1465], to James Inglis, priest, of the said diocese, who has this day, without the letters of grant having been drawn up, and without his having had possession of the said church, resigned it to the pope, who has admitted his resignation. He therefore hereby orders the above three to collate and assign the said church, value not exceeding 9l. sterling, to William Fergusii, priest, of the diocese of St. Andrews; notwithstanding that the pope has lately made provision to him of a canonry of Dunkeld with reservation of a prebend thereof, and of a benefice with or without cure, wont to be assigned to secular clerks, in the common or several gift of the abbot and convent of Calco, O.S.B., in the said diocese of St. Andrews, which, as soon as he has obtained possession of the said church, shall be null and void as far as regards a benefice incompatible therewith. To the prior of Dearg in the diocese of Ardagh. Mandate, as below. The pope has been informed by Maurice Omulkerayn, clerk, of the diocese of Meath, that Cormac Magruoke, perpetual vicar of the parish church of Mulenger in the said diocese, made, on the voidance of the said vicarage, which is of lay patronage, by the death of William Ymulketayn (recte Ymulkerayn), an agreement that if the patron thereof would present him to the ordinary he would pay him a sum of money, and also with certain other powerful persons that if they would induce the ordinary to institute him he would pay them another sum of money; that the said sums were paid, that the patron presented him to the ordinary, that on the said presentation and at the instance of the said powerful persons the said ordinary, perhaps in ignorance of the foregoing, instituted him, and that under pretext of the said presentation and institution he obtained possession of the said vicarage, thereby committing simony and incurring the sentences of excommunication etc. provided therefor. The pope therefore hereby orders the above prior, if the said Maurice (who is illegitimate, being the son of a priest and an unmarried woman, and who for fear of Cormac's power cannot safely meet him in the city and diocese of Meath) will accuse Cormac before the said prior, to summon him and others concerned, and if he find the foregoing to be true, to remove him, and in that event to collate and assign the said vicarage, value not exceeding 24 marks sterling, to the said Maurice, if found fit. To John Macgellauanach, canon of Kilmacduagh (Duacen.), Robert Glys (recte Elys), canon of Clonfert, and the official of Kilmacduagh. Mandate, as below. The pope has been informed by Maurice Ohogayn, clerk, of the diocese of Killaloe, (fn. 2) that Dermit Mackallapadrig, rector of the church in ecclesiastical fee of Dru[m]clep in the said diocese, (fn. 3) being under a sentence of excommunication delivered against him by papal authority, and being publicly proclaimed excommunicate, has taken part in divine offices, in contempt of the Keys, thereby contracting irregularity, to the shame of the clerical order. The pope therefore hereby orders the above three, if the said Maurice, who for fear of Dermit's power cannot safely meet him in the city and diocese of Killaloe, (fn. 4) will accuse Dermit before the said three, to summon him and others concerned, and if they find the foregoing to be true, to deprive and remove him, and in that event to collate and assign the said rectory, without cure and value not exceeding 4 marks sterling, to the said Maurice. To Robert de Forest, priest, of the diocese of St. Andrews, M.A. Reservation to the pope's gift, for collation to him, of the perpetual vicarage of the parish church of Lythqu in the diocese of St. Andrews, with cure and value not exceeding 18l. sterling, about to become void, etc., as in the preceding; notwithstanding that provision was lately granted to him by papal authority of the then void perpetual vicarage of the parish church of Leiartwod in the said diocese, also with cure, and value not exceeding 9l. sterling. He is hereby dispensed to receive and retain it for five years together with the said vicarage of Lythqu, and to resign them, simply or for exchange, as often as he pleases, provided that he do not hold two major or principal dignities, or one of each. To the abbot of Holy Trinity de Cella parva in the diocese of Annaghdown, and Donatus Okinnullud and Donald Macartham, canons of Annaghdown. Mandate to collate and assign to Odo Okallonan, canon of Annaghdown (who was dispensed by authority of the ordinary on account of illegitimacy, as the son of a priest and an unmarried woman, to be promoted to minor orders and hold a benefice without cure, and afterwards by papal authority to be promoted to all, even holy orders and hold a benefice even with cure, after which he was promoted to all holy orders, even to the priesthood), the perpetual vicarage of the parish church of Fura[n]mor in the diocese of Annaghdown, of lay patronage and value not exceeding 4 marks sterling, so long void (because John Macgyllanarha, (fn. 7) having obtained it by a collation made to him by authority of the ordinary, when holding the rectory of Aerd[ra]han in the diocese of Kilmacduagh (Duacen.), held it together with the said rectory, which has cure, for more than a month against ‘Execrabilis,’ and thereafter for about two years, without papal dispensation) that by the Lateran statutes its collation lapsed to the apostolic see, although David Brenach, priest, of the diocese of Tuam, by his own temerity and without any canonical title, has unlawfully detained it for two further years after the said lapse; whether it be void as above, or by the resignation of William Ydallyd, or in any other way. To the abbot of Holy Trinity de Cella parva in the diocese of Annadown. Mandate, as below. The recent petition of Rory Ylaherty, priest, of the diocese of Annaghdown, contained that on the perpetual vicarage of the parish church of Rathuna in the said diocese becoming void (because Thomas, de facto and reputed bishop of Annaghdown, (fn. 12) deprived and removed Bernard Ohogayn, then dean of Annaghdown, of the said deanery, with which the said vicarage was united for the lifetime of the said Bernard, and as long as he should hold the deanery), John de Burgo, canon of Tuam (having general power from Donatus archbishop of Tuam, then in possession of the rule etc. of the said church of Annaghdown, perpetually united to Tuam), (fn. 13) made by his ordinary authority collation and provision of the said vicarage, thus void, to the said Rory, who in virtue thereof obtained and holds possession thereof, although he receives few of the fruits, but now doubts whether the said collation and provision hold good. The pope therefore hereby orders the above abbot to collate and assign to the said Rory (who was lately dispensed by papal authority on account of illegitimacy, as the son of an Austin canon, not in holy orders, and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure), if found fit, the said vicarage, with cure and value not exceeding 3 marks sterling, whether it be void as above, or by the death of Thady Yllanayn, or by the free resignation of the said Bernard or Thady, or because the said Bernard did not keep in the said church of Annaghdown the residence due on account of the said deanery, to which the said vicarage was united, as above, or whether it be void in any other way.Dignum etc. (P. and Jo.
