To the abbot of Fermoy (de Castro dei) in the diocese of Cloyne (Clonen.), and the treasurer and Rory Macconmara, canon, of Cloyne. Mandate, as below. A canonry of Cloyne and the prebend of Kahirultayn (fn. 2) therein having become void, and ipso facto reserved to the gift of Pius II, by that pope's promotion of Gerald, [now] bishop of Cork and Cloyne, to those united churches, and by his consecration carried out at the apostolic see by order of the said pope; and, the said pope having died without having disposed thereof, remaining still void and reserved to the present pope, he hereby orders the above three to collate and assign them, value not exceeding 10 marks sterling, to Maurice Stantun, clerk, of the diocese of Cloyne, to whom the pope has this day by other letters ordered provision to be made of a canonry of Cork and the prebend of Kylasbuycmellayn therein and of the precentorship of Cloyne, a non-major dignity, which are about to become void, and whose values do not exceed 12 and 8 marks sterling, respectively; summoning and removing Cornelius Oteye, priest, of the diocese of Limerick, who, as the said Maurice alleges, has by his own temerity and without any collation or provision detained possession of them for between two and three years. The pope has been informed by John Pyndragas, clerk, of the diocese of Lismore, that Patrick Goer alias Guer, canon of Lismore, has dilapidated and turned to his own profane and evil uses many goods of his canonry of Lismore and the prebend of Mora alias Morthon therein, has committed perjury and simony, and is much defamed in those parts of other crimes, etc. The pope therefore hereby orders the above abbot, if the said John will accuse the said Patrick before the said abbot, to summon Patrick and others concerned, and if he find the foregoing to be true, to deprive and remove him, and in that event to collate and assign the said canonry and prebend, value not exceeding 5 marks sterling, to John. The pope has been informed by David Olaccha, priest, of the diocese of Lismore, that Adam Ohyffyrnayn, canon of Cashel, has dilapidated and turned to profane and evil uses many of the goods of his canonry of Cashel and prebend de Nova Capella alias Mollachynneona therein, has committed … other crimes, etc., as in the preceding. The pope therefore hereby orders the above three, if the said David (who for fear of Adam's power cannot safely meet him in the city and diocese of Cashel) will accuse the said Adam before the said three, to summon Adam and others concerned, and if they find the foregoing to be true, to deprive and remove Adam, and in that event to collate and assign the said canonry and prebend, value not exceeding 10 marks sterling, to David.Vite etc. (N. and A. de Cortesiis. | N. xx. To the dean, the treasurer and the precentor of Emly. Mandate to collate and assign a canonry of Limerick and the prebend of St. Munchin's (Sancti Muncini) therein, value not exceeding 16 marks sterling (which became void and ipso facto reserved by the pope's promotion of Matthew, [now] bishop of Killaloe (Laon[i]en.) to that church (Leonen., recte Laon[i]en.), and by his consecration carried out by the pope's order at the apostolic see) to Thady [son] of Matthew Macommari, clerk, of the diocese of Killaloe (Leonen.), who alleges that Donald Macgyllapadyre (recte Macgyllapadryc), clerk, of the said diocese, who is to be summoned and removed, under pretext of a certain common grace made to him by Pius II (fn. 3) [Cal. Papal Lett., XI, p. 499] of the said canonry and prebend, when they were expected to become void by the said promotion and forthcoming consecration, (the papal letters concerning which grant were not drawn up, or at least engrossed and withdrawn from the bullaria of the said pope, (fn. 4) ) and without any canonical title, has for between two and three years unduly detained possession of them; that, moreover, Bernard Obrien, clerk, of the diocese of Limerick, who is also to be summoned and removed, falsely pretends to have a right in or to the said canonry and prebend; that he, the said Thady, has been successively dispensed by papal authority on account of illegitimacy, as the son of an unmarried nobleman and an unmarried noblewoman related in the double fourth degrees of kindred, (i) to be promoted to all, even holy orders and receive and retain a benefice even with cure, (ii) to receive and retain the treasurership of Killaloe, which is a non-major dignity, and the rectory of the parish church of Bonrathy (fn. 5) alias de Tradray in the said diocese of Killaloe (provision of which, then void, the pope has by other letters ordered to be made to him), and to resign them, simply or for exchange, as often as he pleased; and that for fear of the power of the said Donald and Bernard he cannot safely meet them in the city and diocese of Limerick. Collation and provision to him, who was lately dispensed by papal authority on account of illegitimacy, as the son of a priest and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure, of a canonry of Tuam and the prebend of Theachsagsan therein, value not exceeding 2 marks sterling, void at the apostolic see, and therefore ipso facto reserved to the pope, by the death there of Thady Oclunayn; notwithstanding that he holds the perpetual vicarage of the parish church of Ynis Meoyn alias Purt Myan in the said diocese, value not exceeding 3 marks sterling. To the bishops of London and Rochester, and John bishop of Ardfert, residing in the city of London. Mandate, as below. The recent petition of Edmund Cotis, layman, and Helen Wytecastell, man and wife, of the diocese of Winchester, contained that formerly the said Helen (falsely alleging that after Edmund had contracted marriage with her per verba legitime de presenti, he contracted marriage per similia verba with Catherine Gat, of the said diocese, consummated it, and cohabited with the said Catherine), brought Edmund and Catherine before the official of the archdeacon of Surre in the church of Winchester, to which archdeaconry the said parties belong; that from certain [stated] grievances by the said official the said Helen appealed to the apostolic see, but that Catherine, in contempt thereof, brought Edmund before Thomas Wynterborn, auditor of causes of the court of the archbishop of Canterbury, who, wrongfully proceeding, excommunicated Edmund (who was not cited, at least lawfully, and was absent, but not by contumacy), and ordered and caused him to be publicly proclaimed excommunicate. The pope therefore, at the said petition, orders the above three to summon Catherine and others concerned, conditionally (ad cautelam) absolve Edmund from the said excommunication, hear both sides, taking congnizance also of the principal matter, and decide what is canonical without appeal, causing their decision to be observed by ecclesiastical censure. To the archbishop of York. Mandate, as below. The recent petition of Richard Andrewe, archdeacon of Bukyngham in the church of Lincoln, contained that although the probate and registration (fn. 13) of wills, alike of clerks and laymen who die within the said archdeaconry, belong by ancient custom to the archdeacon, and although he and his predecessors have been in peaceful or almost peaceful possession of the right of proving and registering (fn. 14) such wills, and of doing other things pertaining to their execution, nevertheless John, bishop of Lincoln, and his commissaries, John More and John Wy[n]terborne, have proved and registered (fn. 15) and done other things pertaining to the execution of the wills of the late William Ufford, rector of Bech[a]mpton, Thomas Rede of Haddenham, layman, and Anne Oictelade of Codington, who lived and died within the said archdeaconry, and have molested him in regard to the said probate and registration of the wills of persons dying in the said archdeaconry, and have threatened to do so in future, wherefore he has appealed to the apostolic see, etc. The pope therefore hereby orders the above archbishop to summon the said bishop John, John Wy[n]terborne and John More, and others concerned, hear both sides, taking cognizance also of the principal matter, and decide what is just, without appeal, causing their decision to be observed, in the case of the said bishop by the pope's authority, and in the case of the others by ecclesiastical censure. To the archdeacons of St. Andrews and Aberdeen, and the dean of Dunkeld. Mandate, as below. The recent petition of David de Ogylvi of Inchmertine, donsel, nobleman, of the diocese of St. Andrews, contained, that whereas formerly Elena Erskyn, damsel, noblewoman, of the said diocese, falsely alleging that the said David was bound to pay her certain sums of money, brought him before the official of St. Andrews, to whom by ancient custom belongs the cognizance of civil causes between lay persons of the said diocese, and who, wrongfully proceeding, promulgated an unjust definitive sentence in favour of Elena and against David, from which he appealed to the apostolic see but, by reason of a lawful impediment, has not prosecuted his appeal within the due period. The pope therefore hereby orders the above three, if they find to be true what is alleged about the said impediment, to summon Elena and others concerned, hear both sides, and decide what is just, without appeal, causing their decision to be observed by ecclesiastical censure. After Pius II's general reservation to his gift of all major cathedral dignities, the deanery of Ossory, a major dignity, became void and ipso facto reserved by the death of Thomas Auther (recte Archer), and, the said pope having died without disposing thereof, still remains void and reserved to the present pope. He therefore orders the above three to collate and assign it, elective and with cure, and value not exceeding 40 marks sterling, to Peter Motyng, priest, of the diocese of Lismore, bachelor of canon law, summoning and removing John Strang alias Strong, who under pretext of an election by the chapter, after and against the said reservation by pope Pius, and under pretext of a confirmation thereof by authority of the ordinary, has detained possession for less than three years. To Robert Darrij (recte Darcy), priest, of the diocese of Lincoln, bachelor of canon and civil law. Grant, as below. Nicholas V dispensed him to receive and retain for life, with the church of Rancote (recte Kancote) in the diocese of Lincoln, any one other benefice, or if he resigned that church any two other benefices, with cure or otherwise incompatible, even if parish churches or their perpetual vicarages, or major or principal dignities, etc., and to resign them, simply or for exchange, as often as he pleased, the said pope's letters stating that he was at the time a clerk of the collector of the papal Camera in England. At his petition, containing that at the date of the said letters, or afterwards, he was not a clerk of the said collector, wherefore he fears lest they may be held surreptitious, the pope hereby grants that the said dispensation and letters shall hold good from the date of these presents, as if they contained no mention that he was a clerk of the said collector.
