To the abbot of Macosquin (de Claro fonte) in the diocese of Derry (Deren.). Mandate, as below. The pope has been informed by William Oheghretyd, (fn. 2) perpetual vicar of the parish church of Donnackyde in the diocese of Derry, that Maurice Mackylabride, abbot of the monastery of Londonderry (Colle nigre, recte Celle nigre), O.S.A., in the said diocese, has committed adultery with a married woman, by whom he has had offspring, and whom he openly keeps as his concubine, (fn. 3) has committed simony in the receiving of canons in the said monastery, and has dilapidated and converted to his unlawful uses the goods of the said monastery. The pope therefore hereby orders the above abbot, if the said William will accuse the said Maurice before the said abbot, to summon Maurice and others concerned, and if he find the foregoing to be true, to deprive and remove Maurice, and in that event to receive William, and cause him to be received, as a canon of the said monastery, give him the regular habit, and receive his profession, and thereafter, if he find him fit, to make provision to him of the said monastery, value with its annexes not exceeding 14 marks sterling. The pope here grants that he may be blessed by any catholic bishop in communion with the apostolic see, without prejudice to the bishop of Derry, to whom the said monastery is by ordinary right subject, and also grants him indult to retain in commendam for life with the said monastery the said vicarage, value not exceeding 8 marks sterling. To Henry Ruston, prior of Bullington, O. Semp., in the diocese of Lincoln. Indult, at his recent petition (containing that the priors of the priories of the said order, which is immediately subject to the apostolic see, are by the rules of the order removeable yearly at the pleasure of their superiors), that he (who has for more than twelve years held at the pleasure of his superior the said priory, which is not conventual nor a dignity nor a personatus, and who was lately dispensed by papal authority, and also allowed by his superior, to receive and retain therewith for life any benefice with or without cure wont to be held by secular clerks, even if a parish church or its perpetual vicarage, or a chantry), cannot be removed from the said priory for life, without reasonable cause, by the said or other superior.Religionis zelus, vite etc. (P. and A. de Piscia. | P xxii.de Varris.) To the abbot of Thornton Curtase in the diocese of Lincoln, and the dean and the treasurer of Lincoln. Mandate, as below. On its being set forth to Pius II by all the inhabitants near the chapel called the chapel of St. Mary, Marsschapell', by the seashore, within the bounds of the parish church of Fulstowe in the diocese of Lincoln, that, the said chapel being distant an English mile from the said church, it often happened that on account of floods etc. the said inhabitants could not without great difficulty go to the said church for burials, the said pope granted to the said inhabitants an indult to have a cemetery near the said chapel and to bury therein, the rector of the said church being convoked, or his deputy, or any other priest; without prejudice to the said church. At the recent petition of the abbot and convent of the monastery of Louth Park (de Parco laude [sic]), O. Cist., in the said diocese, and of the perpetual vicar of the said church (containing that the said church with the said chapel etc. is united to the said monastery, that the cure of the said church and chapel is exercised by a perpetual vicar, and that the abbots and vicars and the said convent have been from time immemorial in peaceable possession of the right of burying, by themselves or by their chaplains, at the said church and not at the said chapel, all the parishioners who inhabit near the said church and chapel, and of the right of receiving the funeral dues and oblations, and that the said letters were obtained from the pope's said predecessor by suppressing the true and expressing the false, and that the said parishioners have, without summoning the said abbot and convent and vicar, got the said cemetery blessed, and have buried therein many bodies, without any chaplain or priest being present, or had them buried by laymen and women, (fn. 4) to the prejudice of the said abbot and convent and vicar, and to the grave scandal and pernicious example of many), the pope hereby orders the above three to summon the said inhabitants and others concerned, and do and decree what is lawful. To the abbot of Gutburyn and the prior of Muemoyr (recte Mucmoyr), in the diocese of Connor, and the archdeacon of Connor. Mandate (the pope having learned that the perpetual vicarage of the parish church of Culrayn in the diocese of Connor is void by the death of John Ogillachinni, although Magonius Oduuin, priest, of the said diocese, has for between seventeen and eighteen years unduly detained possession by his own temerity, and without any title or tittle of right; and it being alleged by Henry Olonan, abbot of the monastery of St. Mary de Clarofonte, alias de Madeosgan (sic), O. Cist., in the diocese of Derry, that the fruits etc. of the said monastery do not exceed 10 marks sterling in yearly value) to summon the said Magonius and others concerned, and to grant the said vicarage, value not exceeding 4 marks sterling, to the said abbot Henry for life in commendam, removing Magonius and any other unlawful detainer.Religionis zelus, vite etc. (F. and N. de Castello. | F. x.Residuum gratis pro deo. To the official of St. Andrews. Mandate, as below. The recent petition of the vicar and friars of the order of Friars Minors of Scotland contained that the late Henry, bishop of St. Andrews, granted to them the place of Bertheon in the diocese of St. Andrews, after which the said friars had a house with a church and other necessary offices built in the said place, and have therein for more than forty years served the Most High. At their petition to the pope to confirm the said grant, and to grant that they may receive the said house anew, and to absolve from excommunication those of them who received it without papal licence, and have inhabited it, etc., the pope hereby orders the above official to absolve all those friars who received the said house, and also those who have inhabited it, as above, enjoining a salutary penance, etc., dispense them on account of irregularity contracted, if any, and rehabilitate them, and moreover, if they find that the said grant was lawful, to approve and confirm it and its consequences by papal authority. In the event of such approbation and confirmation, the pope grants to the said vicar and friars indult to receive the said house anew for their use [and] habitation. Intenta continue salutis. To the dean of Ossory, Thomas Omobuygy, canon of the same, and Eugenius Macconkagry, canon of Ardagh (Ardakaden.). Mandate to cause James Ybuoy alias Macconbuaga, priest, of the diocese of Ossory (who, as his recent petition contained, after he had been dispensed by papal authority on account of illegitimacy, as the son of a priest and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure, and after he had thereafter obtained by canonical collation the perpetual vicarage of the parish church Detibrit (recte de Tibrit) (fn. 5) [in the said diocese], and had held it for more than six years, resigned it, and, without having obtained any other dispensation on account of the said defect, obtained by de facto collation the rectory of the parish church of Glastro in the said diocese, and has detained it for five years, taking the fruits, likewise de facto; and whom the pope hereby absolves from all sentences of excommunication etc., and rehabilitates on account of his taking the said fruits), to be received as a canon of the priory of St. Mary, Aghmaccert, (fn. 6) O.S.A., in the said diocese, give him the regular habit, and receive his profession, and thereafter to collate and assign to him, after he has resigned to them the said rectory, the said priory, which is conventual and elective and with cure, value not exceeding 15 marks sterling (that of the said vicarage not exceeding 2), void by the death of Patrick Obuoey, and ipso facto reserved to the pope in virtue of his general reservation of all conventual priories; whether it be void as stated, or by the death of Charles (Keruali) Ybuey, or by the resignation of the said Patrick, and Charles, or of the late Dermit Ymehayr, or in any other way, and moreover to grant to him in commendam for life, after he has resigned it, as above, the said rectory, of lay patronage and with cure, value likewise not exceeding 2 marks sterling, provided that the said patrons consent, to be held by him together with the said priory. The pope here specially dispenses him to receive and retain the said priory and rectory, notwithstanding the said defect, etc., but before they proceed to the execution (fn. 7) of these presents, he is to resign the rectory. To the provosts of Lynclodem and Botheweyle, in the diocese of Glasgow, and the treasurer of Glasgow. Mandate, as below. The recent petition of the abbot and convent of the monastery of Dundranen, O. Cist., in the diocese of Whiteherne (Candide case), contained that after they had won in the Roman court a definitive sentence in their favour and against the prior and chapter of Whiteherne, O. Prem., about the tithes, profits and fruits in a certain land called Biscobu in the parish of St. Martin's, in the said diocese, and the animals grazing therein (inibi) and their young, which sentence became a res judicata, both parties agreed, in order to spare litigation and expense, to have recourse to arbitration; that the arbitrators, four in number, co-opted a fifth, and that two of them gave a just decision, in regard to some matters, in favour of the said abbot and convent, but that the other two and the co-opted arbitrator gave an unjust decision in regard to all matters, which, as also another declaration made against the said abbot and convent, the latter forthwith disputed and appealed to the apostolic see. At the said petition, to order the said award, in respect of that part by which they were grievously injured, to be declared null, or order it to be revoked, to order their oath to observe the said award to be relaxed, and to order the said sentence to be executed, etc., the pope hereby orders the above three to summon the said prior and chapter and others concerned, relax the said oath of the abbot and convent, etc., (fn. 8) and for the rest, to hear both sides, and decide what is just, without appeal, causing their decision to be observed by ecclesiastical censure. To the bishop of London. Mandate, as below. The recent petition of Agnes Cauod, nun of the priory of St. Mary de Gratia, O.S.A., in the diocese of Dublin (Dunblenen.), contained that she lately left the said priory, with licence of her ordinary, came to the Roman court as a pilgrim, and visited the shrines of SS. Peter and Paul, Rome (de Urbe); and that she subsequently transferred herself from the said priory to that of Koveney, O.S.B., in the diocese of Lincoln, and there took the habit of the order of St. Benedict, and made her profession, wherefore she fears lest by the statutes etc. of the said priory of St. Mary and of the order of St. Augustine, etc., she has incurred sentence of excommunication. At the said petition of Agnes, who alleges that on account of her singular devotion to the said order of St. Benedict she desires to remain in the said priory of Koveney, the nuns of which live under a stricter rule, the pope hereby orders the above bishop, if he find the facts to be as stated, to absolve Agnes from such sentence, enjoining a salutary penance etc., and to grant that she may remain in the said priory of Koveney for life.
