To Nicholas, bishop of Orte, residing in the Roman court, Mandate, as below. The recent petition of Rory Iguda, clerk, of the diocese of Killala (Aladen.), contained that inasmuch as the late Bernard, bishop of Killala, had inflicted on him very many injuries, his brother, a layman, lay in wait for the said bishop outside the city of Killala, with the intention only of despoiling him of his horses, and when on the morrow he met the bishop, and had begun to fight with the bishop's men in order to carry off his horses, he wounded the bishop so severely that a few days afterwards he died of his wound; and that; inasmuch as the said Rory followed after his brother on the day on which the bishop was wounded, although not with the intention of harming the bishop, he fears lest on account of the foregoing he may have incurred sentence of excommunication. (fn. 2) At the said petition of Rory, who alleges that he was not present at the said crime, and was not guilty of the said bishop's death otherwise than as aforesaid, and that he deeply grieves thereat, the pope hereby orders the above bishop to absolve him from sentence of excommunication if any incurred, enjoining a salutary penance, etc. Sedes apostolica, pia mater. Indult at their recent petition (containing that by the statutes and customs of their said church it is provided that the provost and canons shall devote themselves to the study of theology, and that some of them are bound to lecture (ad legendum) daily, some of them on certain days, and the rest of them to study in the said faculty), that the present provost shall not be bound to perform the duty of a papal delegate, nor the present canons that of a papal sub-delegate, provided that the provost do subdelegate without delay any causes etc. which may be delegated to him by the apostolic see. Dispensation to him (who was formerly dispensed by papal authority on account of illegitimacy [not here defined], to be promoted to all, even holy orders and receive and retain one or more benefices, even if one of them had cure of souls, and even if they were canonries and prebends in a cathedral or a collegiate church, in virtue of which he was so promoted, and obtained inter alia a canonry and prebend of Lincoln), so that he, who is a chaplain of Edward, king of England, may receive and retain any benefices, of any number and kind, with or without cure, compatible with one another and with the aforesaid, even if they be canonries and prebends, major or principal dignities, etc., and may resign them, simply or for exchange, as often as he pleases. To the archdeacon of Berkshire (Barkschirie) in the church of Salisbury, dwelling in the city of London. Mandate, as below. The recent petition of Thomas Say, clerk, of the diocese of Lincoln, contained that after Pius II had granted to Vincent Clementis, collector of the papal Camera in England, faculty to dispense any persons of the realm on account of defect of age to hold, after attaining their twentythird year, a benefice with cure [see Cal. Papal Letters, Vol. XI, p. 23], the said collector dispensed the said Thomas accordingly. Subsequently, after the accession of the present pope, on the voidance of the parish church of St. Augustine without the gate of the cemetery (cimpiterii) of the church of London, the said Thomas, then in his said twenty-third year, obtained collation of it by authority of the ordinary, but, inasmuch as the pope revoked all such collectors’ faculties to dispense, in cases in which they had not yet taken effect, some doubt whether the said dispensation was not therefore revoked, and whether the said Thomas had not obtained the said church uncanonically. The pope therefore orders the above archdeacon to summon those concerned, and, after inquiry, to declare and decree that the said dispensation was and is not revoked by the said revocation of faculties, and that Thomas could and can receive and retain the said church by virtue of the said dispensation.Sic decet Iesu Christi vicarium. Mandate to collate and assign to Thady [son] of Matthew (Mathei) Macho[n]mara, clerk, of the diocese of Killaloe (Laon[i]en.) (who is illegitimate, being the son of an unmarried clerk and an unmarried woman, nobles, related in the double fourth degree of kindred, notwithstanding which he was made a clerk, and was lately dispensed by papal authority to be promoted to all, even holy orders, and receive and retain a benefice even with cure) the treasurership of Killaloe, a non-major non-elective dignity with cure, value, with that of a certain prebend which is annexed to it, not exceeding 8 marks sterling, void because Odo [son] of James Maconmara has obtained, by collation made by authority of the ordinary, the parish church of Killanasulech in the said diocese, and to collate and assign to him also the rectory of the parish church of Bunrathy alias Traydray in the same diocese, of lay patronage and with cure, value not exceeding 40 marks sterling, so long void, because Matthew [son] of James Maconmara held it for more than a year without having himself ordained priest, and without dispensation, that its collation has by the Lateran statutes lapsed to the apostolic see, although Matthew [son] of Laurence Macconmara, a bigamist, of the said diocese, has, under pretext of papal letters which made no mention that he was a bigamist, intruded himself in the said treasurership and rectory, and has unduly detained possession for about a year, and for fear of whose power the said Thady cannot safely meet him in the city or diocese of Killaloe; removing the said Matthew Laurentii and any other unlawful detainers. To the abbot of St. Mary's, Macosquin (de Claro fonte), in the diocese of Derry (Deren.), and Donald Ocailte and Patrick Omeargy, canons of Derry. Mandate, as below. The pope has been informed by Roger Macconnuigy, canon of Derry, that on the rectory of the parish church of Comar in the said diocese becoming void by the resignation of Patrick Yartan, made to the late Bartholomew, bishop of Derry, and admitted by that bishop by his ordinary authority, Patrick Omuiradaid, under pretext of certain papal letters expectative, under which the said rectory was not comprised, accepted it de facto and got provision made to him thereof, and, in order that he might obtain peaceable possession, or that the said bishop might make provision to him by his ordinary authority, paid a certain sum of money to the said bishop, who thereupon made collation and provision by his ordinary authority to the said Patrick, who under pretext thereof obtained possession, and has unduly detained it for between five and six years, thereby committed simony, and incurring the sentences of excommunication etc. provided therefor. At the petition of the said Roger (containing that in the church of Derry there is not a certain number of canons or certain prebends instituted, for lack of which it has hitherto suffered detriment in regard to divine offices, and that he has been received as a canon by papal authority, but that because he has no prebend or other benefice he cannot keep personal residence in the said church, and serve God in divine offices and at the canonical hours as he desires, whereas he could do so if the said rectory were erected into a prebend of the said canonry, and its fruits etc. assigned as an endowment of such prebend) the pope hereby orders the above three, if Roger (who is in or about his twenty-third year, and who was lately dispensed by papal authority on account of illegitimacy, as the son of a priest, professed of the order of canons regular of St. Augustine, and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure, after which he was made a clerk), will accuse the said Patrick before them, to summon Patrick and others concerned, and if they find the foregoing to be true, to declare the said collation and provision and their consequences to have been and to be null and void, and to remove Patrick, and in that event to erect the said rectory, with cure and value not exceeding 6 marks sterling, into a prebend of the said canonry for Roger and for his lifetime, and to collate and assign to him the prebend thus erected. The pope hereby specially dispenses him to receive and retain such prebend, notwithstanding the said defects, etc., and wills that on his resignation or death the said rectory shall return to its pristine state. To the abbot of Carrigillihy (de Fontevivo) in the diocese of Ross, and Donald Ohedersceoyl and Denis Ocrunyn, canons of Ross. Mandate, as below. The pope has learned that a canonry [of the church of Ross] and the prebend called the prebend of Nacnocybduba and Beladiarthac are void by the death of Dermit Ohaega, that the vicarage called the stipendiary vicarage of Gleandnaruryge [in the church of Ross] is void by the death of Davit [sic] Ogyllagymayn, called the vicar stipendiary, and that the precentorship (cantoria, corrected from cantorie) of the church of Ross is void by the death of Donatus Odeayg, although John Odonnamayn, who behaves as a canon of Ross, has unduly detained the said precentorship, which is a nonmajor dignity, for two years, under pretext of a collation by the ordinary, on its voidance in a certain way, when he had no sufficient dispensation on account of illegitimacy, as the son of a deacon and an unmarried woman, to receive and retain such dignity, and without any other canonical title. The recent petition of Dermit Ygyllagymayn, clerk, of the said diocese, containing, moreover, that the fruits of the said canonry and prebend, vicarage and precentorship, value not exceeding ½, 4 and 3 marks sterling, respectively, are so slight that even all of them together are hardly enough for the decent maintenance of one person, the pope hereby orders the above three to summon the said John (as far as regards the said precentorship) and others concerned, unite to one another the said canonry and prebend and vicarage (which is an office therein, i.e. in the church of Ross), and to unite to them the said precentorship; whether they be void as above, or by the resignations of the said Dermit Yhaega, or David or Donatus, or in any other way, and to collate and assign the said canonry and prebend and vicarage, thus united, to the said Dermit (who was lately dispensed by papal authority on account of illegitimacy, as the son of unmarried parents, to be promoted to all, even holy orders and hold a benefice even with cure), so that after the said union he may take possession of the said precentorship by his own authority, and convert its fruits to his own uses and to the uses of the precentorship for as long as he lives, and as long as he holds the said canonry and prebend and vicarage. The pope hereby specially dispenses him to receive and retain the said canonry and prebend and vicarage, together with the said precentorship to be united thereto, etc., or not more than three other mutually compatible benefices, notwithstanding the said defect etc. Ex iniuncto nobis.
