To the prior, the archdeacon and the official of St. Andrews. Mandate, as below. The pope has been informed by Nicholas Monypeny, priest, of the diocese of St. Andrews, bachelor of canon law, that James Lewington, priest, precentor of Dunkeld, has for several years, although under sentences of excommunication, and aggravation and re-aggravation thereof, delivered against him by papal authority on account of his disobedience to papal letters and processes executive, (fn. 2) and although publicly proclaimed therefor, has publicly and wittingly celebrated masses and other divine offices in contempt of the Keys, to the shame of the priestly order. The pope therefore hereby orders the above three, if the said Nicholas (who is of noble birth, and who for fear of James's power has no hope of safely meeting him in the city or diocese of Dunkeld), will accuse James before the said three, to summon James and others concerned, and if they find the foregoing to be true, to deprive and remove him, and in that event to collate and assign the said precentorship, a non-major non-elective dignity without cure, value not exceeding 40l. sterling, to Nicholas. To the abbot of the monastery of Molana (de Insula Sancti Maelanfay) in the diocese of Lismore, and Walter Mondewyl and Thomas Oflathamayn, canons of Lismore. Mandate, as below. The recent petition of John [son] of Maurice de Gerardinis [sic], clerk, perpetual beneficiary in the parish church de Martir in the diocese of Cloyne (Clonen.), contained that Thomas Ohelathaygh, after having obtained by canonical collation the precentorship of Cork, a nonmajor dignity with cure, has held possession thereof for more than a year without having himself ordained priest and without dispensation, although admonished by authority of the ordinary and of the metropolitan to do so, under pain of deprivation, thereby incurring the said sentence of deprivation. The pope therefore hereby orders the above abbot to summon the said Thomas (for fear of whose power the said John cannot safely meet him in the city and diocese of Cork) and others concerned, and if they find the foregoing to be true, to remove Thomas, and in that event to collate and assign the said precentorship, value not exceeding 30 marks sterling, to John, who is by both parents of noble birth; notwithstanding that he holds a certain benefice in the said parish church, called a parcel, without cure and value not exceeding 5 gold florins of the Camera, and that the pope has lately ordered provision to be made to him of the parish church of Kyllhia in the said diocese, value not exceeding 24 marks sterling. He is hereby specially dispensed to receive the said precentorship and retain with it for life the said church, and to resign both, simply or for exchange when he pleases, and hold instead two incompatible benefices, namely, for three years if they be parish churches or their perpetual vicarages, and for life if not; and is also dispensed not to be bound to be promoted for seven years, on account of the said precentorship and church, to any holy orders except during the first of such seven years to that of subdeacon, whilst studying letters at an university.Nobilitas generis, vite etc. (Hug. and A. de Cortesiis. | Hug. xl. Mandate (the pope having been informed by Dermit Oflannagan, canon of Elphin, that Odo Omocham, provost of Elphin, has sold and alienated and turned to his evil purposes the goods of the said provostship, and has committed simony and other excesses and crimes, of which he is greatly defamed in those parts) if the said Dermit, who is by both parents of noble birth, and is born of a lawful marriage, will accuse the said Odo before the above prior, to summon Odo and others concerned, and if he find the foregoing to be true, to deprive and remove him, and in that event to collate and assign the said provostship, a non-major elective dignity with cure, wont to be held by canons of the said church of Elphin, and value not exceeding 12 marks sterling, to Dermit, who receives therefrom a certain annual pension. To Robert Pringil, priest, of the diocese of St. Andrews. Reservation, as below. He has this day resigned to the pope the suit pending before Master Gaspar de Theramo, a papal chaplain and auditor, between him and Nicholas Grahame, clerk, of the diocese of Glasgow, about the perpetual vicarage of the parish church of Kilpatrik in the said diocese [of Glasgow] (provision of which had been made by authority of the ordinary to Nicholas, and of which he is in possession, but which Robert claimed), and all right therein or thereto; and the pope has surrogated Nicholas in and to such right, and has granted him provision of the said vicarage. The pope therefore reserves to Robert (who, when the Roman court was in the pope's city of Ancona, had his right hand cut off there, through no fault of his own, in a riot in which he chanced to find himself; and who was dispensed by papal authority on account of illegitimacy, as the son of unmarried parents, to be promoted to all, even holy orders and receive and retain four benefices with or without cure, even if canonries and prebends, dignities, etc., but not major or principal dignities, nor two parish churches or their perpetual vicarages, and to resign them, simply or for exchange, as often as he pleased, in virtue of which he has been so promoted), a yearly pension of 10l. of the money of Scotland, value not exceeding 3½l. sterling, on the fruits, etc., of the said vicarage, to be paid by the said Nicholas, who has consented, and by his successors, vicars of Kilpatrik, in the city of Glasgow, half at All Saints’ and half on the feast of SS. Philip and James, beginning at All Saints’ next to come, the said pension to be paid for Robert's lifetime, or until with Nicholas's help provision has been made to him, and he has obtained peaceable possession, of the canonry and prebend of the collegiate church of Bethwel [sic], (fn. 1) in the said diocese of Glasgow, which Nicholas lately held in that church, value not exceeding 6l. sterling, or other benefice without cure equivalent to the said canonry and prebend; with the usual sanctions for delay in payment. Robert is hereby specially dispensed to receive and retain the said canonry and prebend or other benefice without cure, notwithstanding the said defect of his right hand, etc.Vite etc.

Mandate (the pope having been informed by Thady Ohanyatan, canon of the monastery of St. Mary de Portupuro, Clonfert, O.S.A., that of Odo Ohmyam, canon of the said monastery, and Culaus Omaeladuni, perpetual vicars of the parish churches of Tirneasgrach (fn. 1) and Cillmulonog, respectively, in the diocese of Clonfert, the former has neglected to administer the sacraments of penance, Eucharist and Extreme Unction to several of his parishioners who were at the hour of death, and by his neglect has suffered them to die without them, whilst the latter has openly committed fornication, even after lawful admonition, dilapidated and converted to evil uses the goods of the said vicarage of Cyllmulonog, and has committed perjury), if Thady, who is a priest and has made his profession of the said order, will accuse the said Odo and Culaus before the above three, to summon them and others concerned, and if they find the foregoing to be true, to deprive and remove them, and in that event to collate and assign the said vicarages, value not exceeding 3 and 2 marks sterling respectively, to Thady. To the priors of Studley, Tutbury and Repton, in the dioceses of Worcester and Coventry and Lichfield. Mandate, as below. The recent petition of abbot Richard and the convent of the monastery of St. Mary, Alcester (Alincestria) alias Racheford, O.S.B., in the diocese of Worcester, contained that Thomas Hoggis, Roger Holond, Thomas Harward, and other laymen, their co-litigants, parishioners of the parish church of Pebworth in the said diocese, falsely alleging that the said abbot and convent were bound to keep at their expense in the said church, which is canonically united to the said monastery, a clerk or literate called ‘a decon,’ (fn. 1) and a number of candles burning therein at a certain time, brought them before William Vance, clerk, commissary of the bishop of Worcester, who promulgated an unjust definitive sentence in favour of the said laymen and against the said abbot and convent, and, before the legal time for appealing therefrom had expired, cited the abbot to appear before him to see the said sentence executed; that although the abbot duly appeared, and alleged certain reasonable causes why the said commissary ought not to execute the said sentence, nevertheless he unjustly refused to hear him, excommunicated him, and caused him to be publicly proclaimed excommunicate, wherefore the said abbot and convent have appealed to the apostolic see from the said definitive sentence, etc. At the said petition, therefore, the pope hereby orders the above priors to summon the said laymen and others concerned, conditionally absolve the said abbot from the said excommunication, and, for the rest, to hear both sides and decree what is just, without appeal, causing their decision to be observed by ecclesiastical censure.Humilibus supplicum votis. Declaration, as below. Pius II, during the lifetime of Nicholas, abbot of the monastery of Inchaffray (Insule missarum), O.S.A., in the diocese of Dunblane, reserved the provision thereof to his gift, and, on its becoming void by the death of Nicholas, made provision to William Hadinthton, a canon thereof. Subsequently a cause arose between the said William and George Mureff, also a canon of the said monastery, a completed bachelor (fn. 2) of theology and a papal chaplain, about the rule and administration, the latter alleging that he had been canonically elected by the convent, that the election had been confirmed by authority of the ordinary, that provision had subsequently been ordered to be made to him by papal authority, and that the said William unjustly opposed the said election, confirmation and mandate, and prevented them from taking effect. The said cause having by George's appeal lawfully devolved to the Roman court, the said pope committed it, at George's instance, to Master Anthony de Grassis, then, as now, a papal chaplain and auditor. Subsequently, after the said auditor had proceeded, short of a conclusion, the present pope (having been informed by the said George that the said William, before his said provision and appointment, had de facto and by lay power taken possession of the rule and administration, without any title or tittle of right, that he had intruded himself, and that, continuing his intrusion, he had procured his election as abbot by simoniacal and unlawful means, and by violently constraining certain of the canons), called up the cause to himself, and gave viva voce commission to Berardus, cardinal priest of St. Sabina's, to make inquiry and to report. Inasmuch as it appears from the said cardinal's report that many of the said statements are true, and that even the said George is without full right in or to the said rule and administration, the pope hereby declares the said provision and appointment of William, and the letters thereon, to have been and to be null and void, and removes him from the said rule and administration. To the dean, and Donald Ohyerlaychy and Richard Walche, canons, of Cork. Mandate, as below. The pope has been informed by Robert Ohuallachayn, monk of the monastery of St. Mary, Carrigillihy (de Fontevivo) O. Cist., in the diocese of Ross, that Miles, [now] bishop of Leighlin (Leythnen.), to whom Pius II granted in commendam the monastery of St. Mary, Tracton (de Albotractu), of the said order, in the diocese of Cork, which he was holding at the time of his promotion to the said see, made by the said pope, having been excommunicated and publicly proclaimed excommunicate at the instance of a certain creditor dwelling in the Roman court, has wittingly, openly and publicly celebrated masses and other divine offices, in contempt of the Keys, thereby contracting irregularity. The pope therefore orders the above three, if Robert, who has made his profession of the said order, and is illegitimate, being the son of an abbot in priest's orders and an unmarried woman, will accuse the said bishop before them, to summon the said bishop and others concerned, and if they find the foregoing to be true, to deprive and remove him from the said monastery and commenda, and in that event to make provision of the monastery, value not exceeding 80 marks sterling, to Robert; whether it be void by the promotion and consecration of the said bishop, or by the death of John Barry, sometime abbot, or in any other way. The pope hereby grants to the said Robert that he may be blessed by any catholic bishop of his choice in communion with the apostolic see, and dispenses him so that provision may be made to him of the said monastery, and that he may exercise its rule and administration, etc., and that he may resign the same when he pleases, simply or for exchange, and hold etc. instead any other monastery of the said order, notwithstanding the said defect, etc. Inter solicitudines. (containing that although he obtained the said priory and its annexes by canonical collation, and held it in peace for some time and laudably served it, and was guilty of no crime to justify his deprivation, nevertheless the present bishop of Norwich without reasonable cause has openly threatened to deprive him, wherefore he has appealed to the apostolic see), to summon the said bishop and others concerned, hear both sides, and decide what is just, without appeal, causing their decision to be observed, in the case of the bishop by the pope's authority, and in the case of others by ecclesiastical censure. To the abbot of SS. John and Peter's, Clanaude (recte Clonarde), in the diocese of Meath (Minden., recte Miden.). Mandate to make provision to Peter Bermichiam, a canon of the monastery of Holy Trinity, Tuam, O. Prem., a priest, if found fit, of the said monastery, value not exceeding 8 marks sterling, void by the death of abbot David, and in the event of so doing, to bless him, or cause him to be blessed by a catholic bishop in communion with the apostolic see. Moreover, the pope having learned that after his reception as a canon he was induced by certain of the canons to swear that he would not impetrate the said monastery or its abbatial dignity, he orders the above abbot to absolve him from the said oath, enjoining a fit penance for the said incautious swearing, and to decree that he is not bound to observe it. Wenzel's ‘An. 3. to. 18.’ There is no contemporary end-paper with the contemporary description of the volume, but the latter occurs, hardly legible, on the bottom edge, as usual, viz.: Primus de dignitatibus vacantibus et de regularibus iiio . anno domini nostri domini Pauli pape ii., which is confirmed by the contemporary headings ‘De dignitatibus vacantibus 3o’ on f. i., and ‘De regularibus 3o’ on f. clix.
