Lateran Regesta, Vol. DCLIII. (fn. 1)

3 Paul II.

De Exhibitis.

1467.
Non. Sept.
(5 Sept.)
St. Mark's, Rome.
(f. 29.)
To the abbots of St. Peter's, Westminster, and St. Saviour's, Barmundesey, and the prior of St. Mary's, Overei, in the dioceses of London and Winchester. Mandate, as below. The recent petition of John Clerk, notary public, dwelling in the city of London, contained that although Roger Kadelif, dean of the church of St. Mary's le Bow (de Arcubus), London, had no jurisdiction over him, nevertheless, at the instance of William Camet, also a notary public, dwelling in the same city, he has without any reasonable cause excommunicated him, and caused him to be publicly proclaimed excommunicate, wherefore, and on account of certain other grievances, he has appealed to the apostolic see, etc. The pope therefore hereby orders the above three to summon the said William and others concerned, conditionally (ad cautelam) absolve the said John from the said sentence, and, for the rest, hear both sides and decide what is just, without appeal, causing their decision to be observed by ecclesiastical censure. Humilibus supplicum votis. (Hug. and M. Amici. | Hug. xvi. Folani prot. Bisunt.) [2½ pp.]

3 Id. Aug.
(11 Aug.)
St. Mark's, Rome.
(f. 254.)
To the abbots of St. Mary's, O'Dorney (de Kyrieleyson), and SS. Peter and Paul's, Ratuoych, in the diocese of Ardfert, and Thady Odyy, (fn. 2) canon of Ardfert. Mandate, as below. The pope has been informed by William Nell, priest, of the diocese of Ardfert, that when Thomas Fytzmoris, clerk, of the said diocese, was in the cemetery of the parish church of Dubhace in the said diocese, for the purpose of executing certain papal letters, Maurice Olucerayn, perpetual vicar of the said church, in order to prevent such execution, ordered certain laymen to lay violent hands on him and expel him from the cemetery, and that he afterwards ratified such expulsion, thereby incurring the censures promulgated therefor, bound by which he has celebrated masses and other divine offices in contempt of the Keys, and taken part therein, contracting irregularity; and that, after all the [perpetual] vicars of parish churches in the city and diocese of Ardfert were monished to reside in person in their churches, the same Maurice neglected to do so, without having obtained any canonical dispensation. The pope therefore hereby orders the above three, if the said William (who was lately dispensed by papal authority on account of illegitimacy, as the son of a priest and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure, after which he had himself so promoted), will accuse the said Maurice before the above three, to summon Maurice and others concerned, and if they find the foregoing to be true, to deprive and remove Maurice, and in that event to collate and assign the said vicarage, value not exceeding 8 marks sterling, to William. Vite etc. (P. and A. de Castello. | P. xx. Sexto Kal. Ottobris [sic] Anno Quarto. de Varris.) [32/3 pp.]
