To the abbot of Drybrugh in the diocese of St. Andrews. Mandate, as below. After the issue of the pope's letters ‘Ad perpetuam rei memoriam. Cum in omnibus judiciis sit rectitudo etc.’ [printed in Cocquelines, Bullarium Romanum, Vol. III, part iii., Rome, 1743, p. 118], the recent petition of Alexander Thome [sic], nobleman, lord of the place of Home in the diocese of St. Andrews, contained that prior John and the convent of St. Mary's, Coldyngham, O.S.B., in the said diocese, in consideration of the services which the said Alexander had rendered to them and the said monastery, and those which he and his heirs and successors can render, granted to him and his said heirs and successors in perpetuity the office of bailey, (fn. 2) which concerns the government and maintenance of all the lands and yearly rents belonging to the said monastery, with the power of appointing one or more substitutes, and assigned as the yearly salary of the said office 20l. of the usual money of Scotland, as is said to be more fully contained in the letters of the said prior and convent, sealed with their seal. At the said petition the pope hereby orders the above abbot to summon the said prior and convent and others concerned, and if he find the foregoing to be true, and the said grant to be to the manifest advantage of the said monastery, to confirm the said grant and assignment by papal authority etc. Sedis apostolice copiosa benignitas. To Thomas Overay, rector of the parish church of Chedon in the diocese of Bath and Wells, LL.B. Dispensation to him (whom Pius II dispensed to receive and retain for life together with the said church of Chedon any other benefice [with cure] or otherwise incompatible, even if another parish church or its perpetual vicarage, a chantry or a hospital, or a major or principal dignity, etc., and to resign them, simply or for exchange, as often as he pleased; and who in virtue thereof obtained by canonical collation the parish church of Bageworth in the said diocese, which he holds together with that of Chedon, the value of both not exceeding 100l. sterling) to receive and retain for three years together with the said two churches any third benefice with cure or otherwise incompatible (provided that it be not a parish church or its perpetual vicarage), even if it be a major or a principal dignity, etc., and to resign all, simply or for exchange, as often as he pleases. To the dean of Bristol in the diocese of Worcester, William Fawkys, canon of Worcester, and the official of Worcester. Mandate, as below. The recent petition of William Hirdson (or Hudson), (fn. 3) perpetual vicar of the parish church of Samford Harundell (which is of the patronage of laymen), and of the present patrons thereof, of the diocese of Bath and Wells, contained that although the said patrons and their predecessors have been from time immemorial in possession of the right of presenting a rector to the bishop of Bath and Wells, and although the rectors, after institution, have been wont to receive all the fruits etc. of the said church, nevertheless the abbess and convent of the monastery of Canunlahe, O.S.A., in the said [sic] diocese, have by their own temerity appropriated or rather usurped the greater part of the said fruits, etc., and moreover appointed the late Richard Vintener, priest, of the said diocese, as vicar in the said church, then void, without the consent of the said patrons, and on condition that if he began litigation (fn. 4) against the said abbess and convent he should incur penalties of 20l.sterling. At the said petition, therefore, the pope hereby orders the above three to summon the said abbess and convent and others concerned, hear both sides, and decide what is just, without appeal, causing their decision to be observed by ecclesiastical censure. To Alexander de Rate, canon of Brechin, member of the pope's household. Collation and provision to him, who is the pope's continual commensal, of a canonry of Brechin and the prebend of Kylmer therein, value not exceeding 9l. sterling, void at the apostolic see, and therefore ipso facto reserved to the pope, by the death there of Robert Forest.Grata familiaritatis obsequia.
Concurrent mandate to the bishop of Hvar (Faren.) and the abbots of Holyrood de Edenburgh and St. Mary's de Balmerenoch, in the diocese of St. Andrews. Hodie dilecto filio. (Hug. and M. Amici.
