To the abbot of Fermoy (de Castro dei) and the prior of St. Mary's Bridgetown (Villepontis), in the diocese of Cloyne (Clonen.), and the official of Cloyne. Mandate, as below. After the pope's late reservation of all major dignities in cathedral churches, upon the deanery of Cloyne, a major dignity, becoming void by the death of Robert Heoth extra Romanam curiam, the pope ordered the bishop of Orte, the abbot of St. Mary's, Inysgad, and the prior of the secular and collegiate church of Inyscayth, in the diocese of Killaloe [above, p. 290], if they found it void as above or otherwise, to collate and assign it to Donatus Macray, rector of the canonically united parish churches of Ogormayk in the said diocese of Killaloe, the said mandate stating that the value of the said deanery did not exceed 16 marks sterling. At the recent petition of Philip Roche, perpetual vicar of the parish church of Moyn Anaynyny in the diocese of Cloyne, containing that at the time of the said letters the value of the said deanery was and is 20 marks sterling, the pope, seeing that if this be true the said letters are surreptitious, hereby orders the above three to summon the said Donatus and others concerned, and if they find that the said value was and is 20 marks sterling, to declare the said letters surreptitious, etc., and in that event to collate and assign the said deanery, with cure and elective, value, as the said Philip alleges, not exceeding 20 marks sterling, to the said Philip, to whom the pope has this day granted provision of a canonry and prebend of Cork, value not exceeding 5 marks sterling; removing the said Donatus and any other unlawful detainer. To the prior of St. John Baptist's by Le Naenach in the diocese of Killaloe (Laonien.), and the chancellor and Thady (Tatheo) Olachnayn, canon, of Killaloe. Mandate, as below. Pius II (upon being informed by Maurus Ohurhile, perpetual vicar of the parish church of Ustrayn in the diocese of Killaloe, that the late Cornelius Ohogayn, then precentor of Killaloe, had committed simony and for several years by his own temerity shared with another the fruits etc. of the said precentorship, had openly kept a concubine, dilapidated the immoveable goods of the precentorship, and perpetuated other excesses and crimes) ordered the then prior of the monastery of Monaincha (de Insula vivencium) in the diocese of Killaloe, and the dean and Donatus Ogrado (recte Ograde), canon, of Killaloe, if the said Maurus would accuse the said Cornelius before them, to summon Cornelius and others concerned, and if they found the foregoing to be true, to deprive Cornelius, and in that event to collate and assign the said precentorship to Maurus. The present pope has been informed by William Ohogayn, perpetual vicar of the parish church of Aersgrene in the diocese of Emly, that the said Maurus in due course accused the said Cornelius before one of the said prior, dean and canon, or one of their sub-delegates, and that such sub-delegate by his definitive sentence deprived and removed Cornelius, and made collation of the said precentorship to the said Maurus, after which the latter made a bargain with Cornelius (who had appealed to the apostolic see), to the effect that if Cornelius would give up to him all right in or to the said precentorship, or would at least allow his appeal to become a res judicata by default, (fn. 2) Maurus would resign to him for life part of the fruits etc. of the precentorship, or a certain church annexed thereto, with the fruits etc. thereof, which he did upon Cornelius's giving up the said right, Maurus thereby incurring simony and the sentences of excommunication etc. against simoniacs, bound by which sentences he celebrated or rather profaned masses and other divine offices, and took part therein, whereby he contracted irregularity, dilapidating, moreover, the moveable goods of the said precentorship, and being a notorious fornicator. The pope therefore hereby orders the above prior, chancellor and canon, if the said William (who is a priest, has studied canon law for some time in the University of Oxford, and was lately dispensed by papal authority on account of illegitimacy, as the son of a priest and an unmarried noblewoman, (fn. 3) to be promoted to all, even holy orders and hold a benefice with or without cure, after which he was so promoted and obtained the perpetual vicarage of the parish church of Olaygach in the diocese of Cashel, and, after resigning it, the above vicarage of Aersgrene, provision of which the pope recently ordered to be made to him) will accuse the said Maurus before them, to summon Maurus and others concerned, and if they find the foregoing to be true, to deprive and remove Maurus, and in that event to collate and assign the said precentorship, a non-major non-elective dignity with cure, value not exceeding 12 marks sterling, to the said William. The pope hereby dispenses him to receive it and to retain it for life together with the said vicarage, value not exceeding 3 marks sterling, and any other benefices of any number and kind, with or without cure, compatible with one another and with the said vicarage and precentorship, even if they be canonries and prebends, major or principal dignities, etc., and to resign all, simply or for exchange, as often as he pleases. To the prior of SS. Peter and Paul's, Selskere by Wexford (iuxta Weysfordiam), in the diocese of Ferns. Mandate to collate and assign to Henry Roche, priest, of the diocese of Ferns, of noble birth, the deanery of Ferns, a major elective dignity with cure, value not exceeding 36 marks sterling, which became void, and therefore ipso facto reserved to the pope (under his late reservation of all major dignities, void and to become void) by the death of Nicholas Ketyng extra Romanam curiam, perhaps in ignorance of which reservation the chapter elected as dean the said Henry, who consented and obtained the ordinary's confirmation of the election, which, as well as the said confirmation, is, in accordance with the foregoing, without force, so that the said deanery is still void, as above.
