To the bishop of Lucera, the prior of St. Peter's, Newtown (de Novavilla) by Tryn in the diocese of Meath, and the official of Dublin. Mandate as below. The petition of Elias Borlach, rector of the parish church of [St. Lonanus], Kilwelach, in the diocese of Meath, contained that although he accepted, and provision was canonically made to him of, the said church, under papal letters, on its voidance by the death of Nicholas Rede [cf. above, p. 367], John Nugent, priest, of the said diocese, asserting that the church belonged to him, has prevented and still prevents the said acceptance and provision from taking effect, detaining possession and taking the fruits, on account of which Elias appealed to the apostolic see; that the pope, at the instance of Elias, committed the appeal and the principal matter to Master Henry Fleckel, papal chaplain and auditor—who, at the instance of Master John de Scrivanis, Elias's proctor, cited Nugent, who did not appear— and then to Master John de Thomariis of Bologna, papal chaplain and auditor, who also cited Nugent, and upon his remaining contumacious, declared that the said acceptance and
provision were canonical and ought to have taken and to take effect, adjudged the church to Elias, removing Nugent and putting Elias in possession, and condemned Nugent in fruits taken and costs, which costs he afterwards assessed at 32
gold florins of the camera. The said petition adding that Elias doubts whether others may have intruded or may intrude themselves, the pope hereby confirms the said sentence and orders the above to execute it, inducting Elias and removing Nugent, and to execute it equally against such intruders as far only as regards possession of the church, proceeding by ecclesiastical censure and invoking the secular arm. They have faculty to publish citations etc. in public places near the said church, which shall have force as though personally served.Exhibita nobis. (Gratis pro deo.) [4½ pp.] |

To the bishop of Spoleto, the abbot of Rathtuoyg in the diocese of Ardfert, and the archdeacon of Ardfert. Mandate to collate and assign to Philip Odwynychayn, deacon, canon of Ardfert, the still void perpetual vicarage of Kylthome in the said diocese, value not exceeding 5 marks, which he obtained by collation of bishop Nicholas on the resignation, made to that bishop, of John Stephani. He doubts whether the said collation holds good. The collation is to be made notwithstanding that he holds the rectory, without cure, in ecclesiastical fee, of the said parish church, and the canonry and prebend of Gleanardella in Ardfert, value not exceeding 1 mark each, united for his life.
