Mandate—at the recent petition of John Paston, an Augustinian friar, containing that formerly, after making his profession as an Augustinian friar, he left the order and habit and became a secular priest, without intent to apostatize, and that he desires to be transferred from the said order to the order of canons regular—to absolve him from excommunication etc. incurred, enjoining a salutary penance, to dispense him on account of irregularity contracted, after temporarily suspending him, and to rehabilitate him, and to license him to be so transferred. Indult to the Augustinian prior and convent of St. Mary's, Gysburn in Clyvelande, in the diocese of York (inasmuch as a former prior and the convent, at divers visitations of ordinaries, proved their right and title to their possessions, assigned to them for the most part as their original foundation endowment), that in future for such proof they shall not be obliged to exhibit their original muniments, the writing and seals of which are liable to be injured, but that these presents shall suffice, and that they shall not be bound to appear in person, without their priory, at such visitations etc. Ad perp. rei mem. Appropriation to the Augustinian prior and convent of Kyrkeby super Wrethek in the diocese of Lincoln,—whose priory was founded hardly fifty-seven years ago, for a prior and twelve canons and, owing to the death of the founder, was insufficiently endowed—of the parish church, of their patronage and value not exceeding 3 marks, of Twyforde in the county of Leicester in the said diocese, that of the priory not exceeding 150. On the resignation or death of the rector they may take possession and have the church served and the cure of the parishioners exercised by a fit priest, one of their canons or a secular priest, appointed and removed at the pleasure of the prior. Provision to him, who is in or about his twenty-fourth year and of the order of St. Augustine, of the Augustinian priory of St. Mary, Monaincha (de Insula vivencium), in the diocese of Killaloe, which is conventual, has cure, is elective, depends on no monastery or other regular place, and whose value, after deducting the portions of the canons and its other burdens, does not exceed 12 marks, void and reserved— under the pope's late reservation of all conventual priories and other benefices, secular and regular, with and without cure, then void and to become void [Ottenthal, op. cit., John XXIII, No. 3]—by the death of Dermit Omechayr; notwithstanding his said defect of age and that he is the son of the said Dermit, priest and prior, and an unmarried woman, on account of both of which defects he is hereby dispensed to hold the priory. Boniface IX.—at the petition of the abbess and convent of St. Mary's, Brusyerde, of the order of St. Clare, in the diocese of Norwich, containing that their monastery, in which were twenty-two nuns, besides their servants, on account of floods, pestilences, the burning of divers of its goods and other mishaps, had become so poor that the whole of it, and especially its refectory and dormitory, were soon likely to fall to ruin; and that Roger Wlverstone and John Stoneham (or Stoueham), laymen, of the said diocese, proposed to give them, for purpose of appropriation, their patronage of the parish church of Sitton in the said diocese—ordered the abbot of St. Mary's, Leyston, in the said diocese, to appropriate to the monastery, value not exceeding 60 marks, the said church, value not exceeding 8, so that on the resignation or death of the rector they might take possession, a portion for a perpetual vicar being reserved. Their recent petition contained that the said abbot made the appropriation, and added that they took possession on voidance in a certain way, the said portion being reserved, and that they are still in possession, but that they fear lest the appropriation be comprehended under pope Boniface's general annulment made on 11 Kal. Jan. anno 14 [1402, Cal. Lett. V, p. 599] of appropriations, and lest they be molested by Alexander Colewe (or Colowe or Colebre or Colobre), priest, of the said diocese, who is said to have impetrated the church from the apostolic see as void under the said annulment. The pope therefore confirms the appropriation, and grants that it shall hold good from the date of pope Boniface's letters, even if the said Alexander have had such papal provision. Ad perp, rei mem. To Nemeas Oguym, abbot of the monastery of St. John Baptist, Kells (de Deserto Connerie), O.S.A., in the diocese of Connor. Grant—at his recent petition, containing that on the voidance of the above abbey by the death without the Roman court of abbot Laurence, provision was made to him thereof, it being said to be void by the death of abbot Thomas, by letters of Angelus Corario, called Gregory XII, [dated] in the city of Rimini, where that pope was residing with his court, after the departure of the cardinals from the city of Lucca, and before the council of Pisa, in which the said Angelus Corario and Peter de Luna, called Benedict XIII, were condemned, by virtue of which provision he obtained possession of the rule and administration of the goods of the monastery; and adding that on account of the error in the name of his predecessor, and because the provision was made after the said departure, he doubts whether he may not be molested—that the said provision shall hold good as if it had been made before the said departure and as though the said error had not occurred.
