To the bishops of Durham and Concordia and the provost of St. Lebuinus's, Deventer, in the diocese of Utrecht (Traiecten.). Mandate, motu proprio, to collate and assign to Thomas Polton, archdeacon of Taunton in Wells, bachelor of canon and civil law, the still void canonry and prebend of Strensale in York, value not exceeding 240 marks, which he obtained by provision, by his ordinary authority, of archbishop Henry, on their voidance by Henry Bowet's obtaining collation, by the same authority, of another canonry and prebend of York; whether they be void as above, or by the resignation, made to the pope this day, of Reynald, cardinal deacon of St. Vitus's in Macello or otherwise. To Master Frederick Deys, papal chaplain and auditor. Mandate, as below. A cause arose lately between William Pilton, canon of Exeter, and Reynald, cardinal priest of St. Vitus's in Macello, about the archdeaconry of York, provision of which, on its voidance by the death of Roger Coringham, William claimed to have been made to him by authority of the ordinary, under which he obtained possession, which provision and possession the cardinal disturbed, claiming the archdeaconry. The cause, lawfully introduced to the apostolic see, was committed by the pope at the cardinal's instance to the above auditor, who has taken some proceedings, since which the cardinal has resigned to the pope whatever right he possessed. |

The pope therefore, motu proprio, orders the auditor to surrogate William to such right, and moreover to collate and assign to him the archdeaconry itself, a non-major dignity with cure, whether it be void as above, or by the death of Francis, bishop of Sabina, who, holding it by papal grant and dispensation, and, being major penitentiary of Innocent VII, died at the court of that pope, or otherwise. To the bishop of Aosta (Augusten.), the dean of Dublin and the archdeacon of Kildare. Mandate, as below. The petition of John Okaerwillis, asserting himself to be rector of the parish church of Killalon in the diocese of Meath, contained that he canonically obtained the said church on its voidance by the death of Peter Welden, and that after he had held possession for some time Comedinus Makruerch, priest, of the said diocese, claimed the church and despoiled Okaerwillis of possession, which he still detains, taking the fruits, wherefore Okaerwillis appealed to the apostolic see; that the present pope, at the instance of Okaerwillis, committed the appeal and the cause to Master John de Thomariis, papal chaplain and auditor, who, at the instance of Master John de Scrivanis, Okaerwillis's proctor, proceeded to the usual citations, to which Comedinus was contumacious; that, upon Master John de Thomariis being temporarily hindered from proceeding, the pope committed the cause to Master William Maligeneri, papal chaplain and auditor, who, at the instance of the said proctor, continued the citations and, upon the continued contumacy of Comedinus, gave definitive sentence in favour of Okaerwillis, removing Comedinus from possession and restoring Okaerwillis, imposing perpetual silence on Comedinus, and condemning him in costs, which costs Master John de Thomariis, on resuming the cause, taxed at 34 gold florins of the camera. Seeing that Okaerwillis, as his petition added, is doubtful lest, whilst the cause has been impending, others may have intruded themselves or may do so, the pope, confirming the proceedings of the said two auditors, orders the above bishop etc. to execute them, restore Okaerwillis to possession and remove Comedinus, cause satisfaction to be made to Okaerwillis in respect of fruits etc. taken and the said costs, and to execute these presents against such intruders, proceeding by censure etc., invoking the aid of the secular arm, etc. Exhibita nobis. To the archdeacon of Kilmore. Mandate to collate and assign to Magonius Macamragan (sic), priest, of the diocese of Kilmore, if found fit, the perpetual vicarage, value not exceeding 6 marks, of Insula Brechungy alias Tempullapuret in the said diocese, collation and provision of which, on its voidance by the death of Andrew Macgamragan (sic), was made to him by bishop Nicholas. He doubts whether the said collation and provision of the said vicarage which, as the pope has learned, is still void as above, holds good. Dignum [arbitramur]. |
