Mandate (at the recent petition of Walter Lucy, knight, and Eleanor, damsel, husband and wife, dwelling in the diocese of Hereford, containing that they formerly obtained dispensation by authority of Boniface IX, to marry notwithstanding that they were related in the third and fourth degrees of kindred from divers lines, that by virtue of the said dispensation they contracted marriage per verba legitime de presenti and have had offspring, and that for the tranquillity of their conscience they desire the said dispensation and marriage to be confirmed by the present pope), if he find the facts to be as stated to grant the desired confirmation by papal authority, and to grant that, as far as necessary, they may contract marriage anew and remain therein, offspring past and present being declared legitimate. To William Lyndewode, rector of Shorham in the diocese of Rochester, I.U.D. Dispensation, as below. The late John XXIII dispensed him, who was holding, in addition to other things, the parish church of Wynfred’ in the diocese of Salisbury, to hold together with that church for seven years any other benefice with cure or otherwise incompatible, etc. [Cal. Lett. VI, p. 294]. At his recent petition containing that he thereafter resigned Wynfred’ and obtained the parish church of Shorham with the annexed chapel of Otteforde in the diocese of Rochester, and subsequently the parish church of All Hallows in Bredestrete London, and has held them together, as he still does, in virtue of the above dispensation, and that the end of the said period is at hand, the pope hereby grants dispensation to him (who is a member of the household of Henry, archbishop of Canterbury, and official of the court of Canterbury, who holds, as above, Shorham with Otteforde and All Hallows, value not exceeding 100 and 60 marks respectively, and the canonry and prebend of Roscomp in Salisbury, value not exceeding 18 marks, a canonry and prebend of Exeter, value not exceeding 6, and the canonries and prebends of Taunton in Wells, value not exceeding 8, Hundreton in Hereford, value not exceeding 15, and Llannothrill and Llanlloweluyn in Abyrguylly, value not exceeding 20) after the lapse of the said period to continue to hold the said two churches together for life, and to resign them, simply or for exchange, as often as he pleases. To the inhabitants of the town of Bilburgh in the diocese of York. Indult (at their recent petition, containing that the said town is distant four miles of those parts from the church of the Benedictine priory of Holy Trinity, York, of which they are parishioners, and to which their dead have been wont to be taken for burial, and that very often during the year, on account of wind-storms and floods in winter and intense heats in summer, it is a burden to go thither) to cause to be consecrated by any catholic bishop the chapel of St. Cuthbert, Bishop and Confessor, which has been founded in their town, and in which the prior and convent cause masses etc. to be celebrated for the said inhabitants by a priest appointed by the prior and convent, and sacraments and sacramentals administered, and to cause the adjacent garden (ortus) to be made into a cemetery for them and to be similarly consecrated. To Thomas, duke of Exeter (Oxonien.). Grant that the dean of his private chapel (capelle hospicii tui), or any other fit priest of his choice, may hear, as often as opportune, the confessions of the duke and all the members of his household, and grant absolution and enjoin salutary penance, except in cases reserved to the apostolic see, and may administer to him and them in the said chapel, wherever the duke may reside or sojourn, all sacraments and sacramentals, but not burial; saving the right of the parish church within whose bounds the duke may be resident. To Thomas Barton, perpetual vicar of Cropry alias Croprydi in the diocese of Lincoln, bachelor of canon law. The late John XXIII dispensed him to hold for ten years together with the above vicarage, which he was then holding, one other benefice with cure or otherwise incompatible, even if it were of the patronage of laymen, and were a parish church etc., and to resign both, as often as he pleased, simply or for exchange, etc. [Cal. Lett. VI, p. 306]; after which, as his recent petition contained, he obtained successively the parish churches of Thornynghe and Helmyngham in the diocese of Norwich, and subsquently the archdeaconry of Stafford in Lichfield, after resigning all which he obtained the treasurership of Lichfield, a non-major dignity, to which is annexed the canonry and prebend of Sallow, and held the same together with his said vicarage, as he still does, all by virtue of the said dispensation. The end of the said period being at hand, the pope hereby grants to him (who is also M.A., and has studied theology at Oxford for ten years, holds canonries and prebends in Knosall’ and St. John Baptist's, Stoke, in the dioceses of Lichfield and Norwich, and holds the said treasurership and its annexed canonry and prebend and the said vicarage, value altogether not exceeding 300 marks) an extension of five years. To Master Frederick Deys, papal chaplain and auditor. Mandate (at the recent petition of Thomas Rosellis, perpetual vicar of St. Peter's, Drogheda, in the diocese of Armagh, containing that a cause arose lately between him and Robert Sutton and Simon Northew, clerks, of the diocese of Meath, about the archdeaconry of Kenlys in Meath to which is annexed the parish church of Nebyre in the diocese of Meath, on its voidance by the death of Adam de la Naas, Thomas claiming that provision had been made to him by papal authority, Robert and Simon opposing it and preventing it from taking effect, and each of them claiming that the archdeaconry belonged to him by right; and that the pope committed the cause, at the instance of Thomas, notwithstanding that it had not by its nature devolved to the Roman court, to the above auditor, and that whilst the cause has been pending before him Simon has resigned to him his right) to surrogate Thomas to Simon in respect of such right, if any, and if in the course of the suit he find that Simon had no right, and that neither Thomas nor Robert has any, to collate and assign the archdeaconry itself, a non-major, non-elective dignity with cure, value not exceeding 100 marks, to Thomas; notwithstanding that he holds the said vicarage, value not exceeding 20 marks, which upon obtaining the archdeaconry he is to resign, and that provision has been lately by papal authority ordered to be made to him of a canonry of Dublin and the prebend of Glemethan, and afterwards that of Swords (de Swerdis) therein, the value of which prebend does not exceed 360 marks.
