Certify my Lords speedily what accounts are depending before you, and your reasons why same are not presented to the Treasury Lords for declaration : as likewise of all other accounts belonging to [audited in] any of your offices which have not been delivered to you : so that orders may be given therein. For your encouragement to proceed effectually herein my Lords would have you lay before them what sums are due to you upon your several salaries or annuities and what are owing from any Receiver, bailiff, fee farmer or tenant [to you individually] within your respective districts, out of which my Lords may satisfy such part of your arrears as they think fit to assign [thereon]. Treasury order to the Customs Commissioners to observe two Orders in Council, dated Dec. 21 last, granting permission to the ships James and John and Bonadventure to go to Guinea : on the petition of the Royal Africa Company. Out Letters (Customs) XII, p. 372.

Prefixing : (a) Order of the King in Council, dated Dec. 31 last, for the said Commissioners to examine the complaint of the Royal Africa Company, who this day presented to the Privy Council an account of some ships among many that are this year gone for Guinea, but [falsely] cleared out for other parts. If the said Commissioners find that the said ships are gone or going to Guinea, contrary to the bonds given by the masters or owners, they are to stop till further order such as are in port and to put in suit the bonds of the ships which are gone : and to certify the Privy Council whether there be such frauds practised for ships to go to other places than those for which they gave bond. Same to Sir George Treby, Solicitor General, to enter a noli prosequi upon the information against the pearl ashes imported by Hugh Redman of London, merchant, who in September last imported in the Providence, Magnus Mason master, from Rotterdam, 10 casks of the said pearl ashes of the growth and manufacture of Germany, but by mistake entered same as potashes, and same are seized by Mr. Gawden under the Act of Frauds [14 Car. II, c. 11] ; it appearing that, although by the relative clause in the said Act potashes of all sorts from Germany or the Netherlands seem to be prohibited, yet the said clause being explanatory of the Act of Navigation, in the opinion of the Customs Commissioners it cannot be supposed to intend to restrain the importation of any commodities from the places of their own growth, but that the intention thereof was that the potashes of Russia and those more remote countries should not be brought from Holland : and further upon enquiry the said Commissioners find that a sort of ashes called pearl ashes has been entered "under that [potashes] denomination" from Bremen and other parts of Germany as ashes of the product of that country : for which reasons the said Commissioners have no objection to a noli prosequi. Treasury reference to the Surveyor General of Crown Lands and Mr. Ryley of the petition of Sir John Shaw, bart., on behalf of himself and the parishioners of Eltham. co. Kent, shewing that he is tenant to the Queen Dowager of the manor of Eltham, that Edward Roper has enclosed part of the common way ; and therefore praying a stop to his proceedings. Same to Sir Robert Cotton and Thomas Franckland, Postmaster General, of the petition of Hyppolito Luzancy. minister of Harwich, shewing that 4d. per month is deducted out of the seamen's pay of the pacquet boats, for [support of] a chaplain, and they having no chaplain on board and petitioner doing that duty on shore, therefore prays that the said groats may be paid him. Ibid.
Treasury warrant to the Excise Commissioners to discharge the following distillers from the duty of 12d. per gallon on low wines and from the old duty of 2d. per gallon upon spirits on their payment of the duty of 2d. per gallon for the low wines : it appearing that they had in their respective wash backs [vats] in their distilling houses on 1690, Dec. 24. and 1690-1. Jan. 5 (being the time of passing the Act for laying a duty on low wines), several quantities of brewers' wash and tilts and that the respective quantities of low wines as follows were drawn by them from the said wash on the said Dec. 24 and Jan. 5, and that the said low wines were not in their intrinsic value worth near the 12d. per gallon imposed by the said Act.

Royal warrant to the Lords Justices of Ireland to direct the Barons of the Exchequer and all others concerned to forthwith cause to be dissolved all custodiams that have been granted of forfeited lands in the kingdom of Ireland. Out Letters (Ireland) VI, p. 106.

Royal warrant to the Lords Justices, Ireland, granting to Simon, Bishop of Limerick, the arrears grown due since 1690, Dec. 4 (or which shall grow due up to the time of translation as below), on the revenues of the bishopric of Elphin in Connaught and the 80l. which will be due to the Crown as First Fruits for the said bishopric of Elphin : which bishopric the King promised by a royal sign manual of 1690, Dec. 4. to give to said Simon when the Province of Connaught should be reduced to obedience, he being granted time till the reduction of Limerick to determine his choice : and he having accepted the said translation and now praying this grant in consideration of the lowness of his present circumstances by his great losses through the calamity of the times in Ireland. Jan. 7. Henry Guy to the Customs Commissioners, enclosing an Order of Council with the draft [both missing] of a commission prepared by the Solicitor General for enquiring concerning a trade driven by the inhabitants of Jersey with the French. Same to the Excise Commissioners. My Lords direct that you and all officers of Excise that have 100l. per an. salary and upwards do pay into the Receipt the money that has been deducted on account of taxes assessed upon you or them. Ibid.
Same to the Commissioners for Farthings. Send my Lords an account what the neat produce of the farthings hath been since your time of being Commissioners and what the same may in all probability produce for one year. Ibid.
Same to the Attorney General. Hasten your answer to the Lord Chief Baron's letter concerning Sir Edward Herbert's chambers in Serjeants Inn in Fleet Street, which was sent to you some time since. Also hasten your report on the petition of the Earl of Westmorland and Mr. Munns. Ibid.
Order of the King in Council, dated Whitehall, for Peter Paggen, merchant, trading to Maryland, to deliver to the Customs Cashier the bills for, in all, 248l. 2s. 6d, which he has received, being made payable to him by order of the Convention of Maryland and drawn by several masters of ships in those parts as in discharge of a moiety of the duty of 2s. per hogshead and of the port duties payable in Maryland. The bills are to be endorsed by Paggen as for their Majesties' service relating to the Government of Maryland in order to be presented to the several merchants [acceptors] concerned and are to be disposed of by the Treasury Lords according to the Acts of Maryland in that behalf. Jan. 8. Commission under the King's sign manual to George Plater to be Collector and Receiver of revenues at Patuxent ("Receiver of our Revenues raised or to be raised for the support of our Province of Maryland [to wit] within the precincts of the river of Patuxent"), except of such duties and revenues as by Order in Council of 1690-1, Feb. 26. were declared to belong to Charles, Lord Baltimore, as Proprietor of the said Province : with the fee of 100l. payable out of the said revenues : to hold during pleasure.
Appending : instructions to the said Plater : not to trade as a merchant or factor or agent : render accounts to the Governor and to William Blathwayt as Surveyor and Auditor General of the King's revenues in America so often as shall be demanded : pay all sums to persons to whom same shall be ordered by warrant of the Governor or Commander in Chief with the advice and consent of the Council : transmit to Blathwayt half-yearly accounts of receipts, issues and remains for presentation of same by him to the Treasury Lords for their approbation or disallowance : keep books of the particular branches of the revenue and send Blathwayt a particular catalogue or ledger of all persons answerable for any payment whatsoever from time to time and copies of all Laws and public Acts concerning the said revenues and a half-yearly catalogue of entries of all goods imported or exported, with the names of the ships, masters, burden, men, guns : follow rules and directions from Blathwayt provided same be not contrary to the orders of the King or Treasury Lords : not to intermeddle with Lord Baltimore's moiety of the 2s. per hogshead and 14d. per ton, but to leave same to be collected by the said Lord or his agents. The bulk of the total of these two sums and of the following three other similar loans, for which money warrants have been already ordered, viz. for 5,000l. lent by Sir John Bancks Nov. 18 last, 15,000l. lent by John Johnson, gent., Nov. 23 last, and 2,500l. lent by John Stock Dec. 12 last (making in all 37,500l.), is to be transferred from the credit fund of the Exchequer in General to that of the second Twelve Months' Aid [3 Wm. and Mary, c. 5], viz. 35,500l. out of the total of 37,500l. is to be so transferred ; and the remaining 2,000l. principal money, with all the interest due on the whole 37,500l., is [to remain on the Exchequer in general and so] to be satisfied out of any disposable money in the Exchequer. Treasury reference to Mr. Digby of the petition of Robert Thompson, shewing that Charles II assigned him payment of 1,046l. 14s. 0d. on the fee farm rents, and that same is still owing, except 246l. 14s. 0d. which he sold : therefore praying payment thereof by assigning him fee farm rents yet unsold. Treasury warrant to the Excise Commissioners to direct the Excise officers in co. Durham to satisfy the judgment of 77l. against Thomas Johnson, Gilbert Scott and Henry Benson, ut supra, pp. 1392-3, for proceeding on the warrant of 1682, Oct. 13, of John Morland, Miles Stapylton and John Duck, three of the Justices of the Peace for co. Durham, for distraining John Hall's goods : on which proceedings, ut supra, have been taken and the said Johnson et al. have been for above two years past imprisoned for 77l.. and it appearing that the verdict and judgment against them, notwithstanding the efforts that have been used, cannot now be set aside or reversed, so that they are destitute of all relief from any Court of Law or equity and thereupon my Lords think it necessary to relieve them as herein in order that constables and other officers may not be discouraged from executing the like warrants [of distraint] for the future. Treasury warrant to Auditor Thomas Done to allow in the account of the present Bishop of Salisbury the sum of 168l. 5s. 0¼d. which stands in surplusage on the account of the late Bishop thereof for the year ended 1687, Christmas, representing money paid in in excess on that account by Sir Thomas Duppa, sub-collector of the Tenths of the said diocese.
