To the abbot of St. Mary's, Cong., in the diocese of Tuam, and William Obethill and Nimeas Magneyll, canons of Tuam. Mandate, as below. The pope has been informed by Magonius Omaynayd, priest, of the diocese of Tuam, that Malachy Odurara, perpetual vicar of the parish church of Scryn, commonly called the wardenship of the relics of St. Gerlaheius in the church of Tuam, in the diocese of Tuam, (fn. 1) has dilapidated some of the moveables of the said vicarage, has committed perjury and fornication, and has contracted irregularity. The pope, therefore, hereby orders the above three, if Magonius will accuse Malachy before them, to summon the latter, and if they find the foregoing to be true, to deprive and remove him, and in that event to collate and assign the said vicarage, value 4 marks sterling, to Magonius. Dispensation to him (who was lately dispensed by papal authority on account of illegitimacy, as the son of unmarried parents, to be promoted to all, even holy orders and hold a benefice even with cure, and who in virtue thereof was so promoted and obtained the perpetual vicarage of Stinnygolynd (?) (fn. 2) in the diocese of Limerick, which he has resigned), to receive and hold any benefice with or without cure, even if a canonry and prebend, or a dignity, etc., but not a major or principal dignity, and to resign or exchange it, etc. Vite etc. (In the margin: Novembris.) Mandate to collate and assign to Donatus Omo Omolchmyll, (fn. 3) priest, of the diocese of Clogher (who was lately dispensed by papal authority on account of illegitimacy, as the son of a priest and an unmarried woman, to be promoted to all, even holy and priest's orders and hold a benefice even with cure, after which he was promoted to the priesthood, and who has also been dispensed on account of the murder of a priest (fn. 4) thereafter committed by him) the [perpetual] vicarage of the parish church of St. Congallus de Gobluyn sive plebis de Dartria in the said diocese, value 12 marks sterling, void because Eneas Okaribrey, clerk, having obtained it by canonical collation, held it for between one and two years without being ordained priest and without dispensation, although the said Eneas, who is to be summoned and removed, has without any title detained possession for some time, but not for another year, after the lapse of the said year. To the abbot of Cella parva in the diocese of Annaghdown (Enachdunen.), and Dermit Offlaferty and Walter Blake, canons of Annaghdown. Mandate, as below. The pope has learned that the perpetual vicarage of Meari in the diocese of Annaghdown, of lay patronage, became void because Thomas Macgillivanach, after obtaining it by canonical collation, held it for more than a year without being ordained priest and without dispensation, and has been so long void that its collation has lapsed to the apostolic see, although the said Thomas has continued to hold it, without any new title, for between six and nine years after the said year; and the pope has been informed by William de Burgo, clerk, of the said diocese, that whilst a suit was pending by papal delegation before the dean of Annaghdown between Theobald, also de Burgo, clerk, and Donald Machartayn, priest, of the said diocese, about a canonry of Annaghdown and the prebend of Lechachaolie and Balecula therein, and the perpetual vicarage of Lechachaolie in the said diocese, they agreed that Donald should have possession of the vicarage, and Theobald of the canonry and prebend, and that Donald should pay Theobald a sum of money, that they withdrew from the said suit and took or continued in possession of the said benefices, and that Donald paid Theobald the said sum, whereby they have incurred simony and the sentences therefor. The pope, therefore, at the recent petition of the said William, who is of noble birth, containing that the fruits etc. of the said canonry and prebend are too slight to maintain their holder, hereby orders the above three, if William will accuse Donald and Theobald before them, to summon them, and if they find the foregoing to be true, to deprive and remove them, and in that event to unite the said two vicarages, value together 10 marks sterling, to the said canonry and prebend, value 1 mark sterling, for the lifetime of the said William, and thereupon to collate and assign to him the said canonry and prebend and annexes, removing Thomas from the said vicarage of Meari, and Theobald and Donald from the said canonry and prebend and vicarage of Lechachaolie, respectively. To John de Burgo and Malachy Oconceanayad, canons of Tuam, and Walter Blach, a canon of Annaghdown (Enachdunen.). Mandate, as below. The pope has been informed by Maurice Offalluyn, a canon of St. Mary's, Rathgcali, O.S.A., in the diocese of Limerick, that whilst a suit was pending before certain judges in those parts between Donatus Ochellay and Donald, also Ochellai, canons of the said monastery, about the priory of St. Mary's, Clontuasgertomane, of the said Order, in the diocese of Clonfert, which the said Donatus was detaining, as he does still, he made an agreement with the said judges that if they would deliver a definitive sentence in his favour, he would give them 5 marks sterling in money (fn. 5) and more, and that they promulgated such a sentence, and that he gave them the said sum, thereby incurring simony and the sentences etc. therefor; and that, moreover, he has dwelt outside the said monastery of Clontuasgertomane, and inside it has lived so incontinently that he is very much defamed in those parts. The pope, therefore, hereby orders the above three, if Maurice (who is illegitimate, being the son of an unmarried nobleman and an unmarried woman, and who, after he had set out on a journey to the Roman court, was arrested in the town of Galuie, in the diocese of Annaghdown, and swore, in order to be set at liberty, that he would not impetrate the said priory from the apostolic see, or otherwise, and whom the pope hereby absolves from the said oath), will accuse the said Donatus before them, to summon him, and if they find the foregoing to be true, to declare that he has no right in or to the priory under pretext of the said sentence, and to deprive and remove him, and in that event to collate and assign it, a conventual dignity with cure and elective, value 20 marks sterling, to the said Maurice, who is hereby dispensed to receive and retain it, notwithstanding the said defect, etc. Relligionis [sic] zelus, vite etc. (In the margin: Novembris.) Simili modo to the same. Faculty for him, to whom the pope has recently made provision of the above church, to be consecrated by any catholic bishop of his choice in communion with the apostolic see, assisted by two or three like bishops, the said consecrating bishop first receiving from him the usual oath of fealty, according to the form enclosed: if not, the said bishop shall be eo ipso suspended from the exercise of the pontifical office, and both he and Cormac from the administration of their churches. The said Cormac shall without delay send the said oath to the pope by his own letters patent, sealed with his own seal, by his own messenger (fn. 6); without prejudice to the archbishop of Armagh, to whom the said church is by metropolitical right subject. To Walter Blake, a canon of Annaghdown (Enachdunen.), and David Pyndragas and David Macglyn, canons of Tuam. Mandate, as below. The pope has learned that the rectory of Ryllereyn (recte Kyllere[r]yn) alias Mynthirathi (fn. 7) in the diocese of Tuam, of lay patronage, has been so long void that its collation has lapsed to the apostolic see, although David Omyri, clerk, has without any title detained possession for between four and five years; and the pope has been informed by Thomas de Burgo, a canon of Annaghdown, that John, also de Burgo, who by papal grant and dispensation holds in commendam the monastery of St. Mary, Knockmoy (Collis Victorie), O. Cist., in the said diocese, has taken part in secular affairs, caused the said monastery and its buildings to be set on fire by his accomplices, and done other things which have caused bloodshed. The pope, therefore, hereby orders the above three, if the said Thomas, who is by both parents of noble birth and is present in the Roman court, will accuse the said John before them, to summon the latter, and if they find the foregoing to be true, to deprive and remove him, and in that event, and if they find the said rectory to be void as above, to unite it to the said canonry and prebend, value 8 and 1 marks sterling, respectively, for the lifetime of the said Thomas, and moreover to grant to him in commendam for life the said monastery, value 50 marks sterling.
