Declaration, etc., as below. After the pope had sent Emerichus (fn. 1) de Kenid (?), (fn. 2) of the order of Friars Minors, called the Friars Observants, as his commissary to publish the Crusade beyond the Alps, (fn. 3) with divers faculties, he made a general revocation of the faculties which he had granted for the said Crusade, but, seeing that it had not been his intention to revoke the said faculties in those places in which collecting-boxes (fn. 4) had been placed, and that some people doubted whether the Crusade had not been completely revoked, he decreed and declared, by other letters in the form of a breve, that the Crusade had not been and was not revoked or suspended in such places, and that the said Emericus could proceed to plenary execution thereof, with the faculties which had been granted to him; the pope at the same time ordering him to open the said crusade boxes and send the contents to the church of the Araceli at Rome, and granting him faculty and power to preach the Crusade in places in which boxes had already been placed and in others, and exercise his faculties etc., until he removed the said boxes, (fn. 5) as is more fully contained in the said letters. Seeing that, as the pope has learned, it is alleged by some people, perhaps with malicious intent, that the Crusade has been entirely revoked, and that the said declaration did not emanate from him, wherefore the said Americus and Master Bartholomew (fn. 6) de Juliano, archdeacon of Piacenza, (fn. 7) nuncio of the apostolic see to the whole of Almain and the realm of Scotland, papal notary and collector of the said Crusade, are hindered from opening the said boxes and sending the money collected therefrom to the said church of the Araceli, the pope hereby testifies and declares, motu proprio, that the said letters in the form of a breve concerning the said declaration did emanate from him, that, as stated therein, the Crusade was never revoked or suspended in the places in which the said boxes had been placed, that the said Americus could proceed to plenary execution thereof, with the faculties which had been granted to him, and that everything done by him and by his substitutes in regard to the foregoing, in virtue of the said faculties, even in regard to indults granted by the said substitutes to choose a confessor, (fn. 8) was rightly done; the pope furthermore, potiori pro cautela, approving hereby and confirming all the said doings, as if expressed word for word in these presents, and decreeing that the said confession indults (fn. 9) could and ought to have taken effect, and in future can and ought to take effect, and that in virtue thereof the holders of them could and ought to have been absolved, and in future can and ought to be absolved, by the confessors of their choice. The pope, moreover, in order that the foregoing may come to the knowledge of all and singular, orders all rectors of churches, etc., and all persons of anysoever dignity etc., under pain of eo ipso sentence of excommunication, to absolve those who hold the said confessionalia, (fn. 10) and to publish and make known these presents to all, whenever requested, in order that the faithful who have contributed their alms to the said Crusade and have gained the indulgences contained in the said faculties, may know that they have not been deceived. To the bishop of Ossory, and the priors of Sayrkeran and Ahagamicart, in the diocese of Ossory. Mandate, as below. The pope has been informed by Maurice Okennedyg, clerk, of the diocese of Killaloe, (fn. 11) that Thady Ocuyrck, a canon of Killaloe, was, when in minor orders, present at a fight in which one man was killed and very many others badly wounded, he himself being left for dead, (fn. 12) thereby contracting irregularity; and that Philip Okennedyg, rector of Disertheni alias Balegybbun, (fn. 13) in the said diocese, has not resided in the said church, and has not kept it in repair, but has left it without a roof. (fn. 14) The pope, therefore, hereby orders the above three, if the said Maurice (who was lately dispensed by papal authority on account of illegitimacy, as the son of the prior of a monastery, (fn. 15) O.S.A., and an unmarried woman of noble birth, to be promoted to all, even holy orders and hold a benefice even with cure, in virtue of which he obtained a benefice with cure, which he has resigned; and who is afraid to meet the said Thady and Philip in the city and diocese of Killaloe) will accuse Thady (who was lately received by papal authority as a supernumerary canon of Killaloe) and Philip before them, to summon Thady and Philip, and if they find the foregoing to be true, to deprive them of their respective benefices, namely, a canonry of Killaloe and a prebend erected for Thady's life from the rectory of the parish church of Letrachonayn in the said diocese, of lay patronage, and the said church of Dyserthen (fn. 16)alias Balegybbun, also of lay patronage, and in that event to collate and assign the said benefices, the value of each of which does not exceed 8 marks sterling, to Maurice, uniting to the said canonry and prebend, for as long as he shall hold them, the said parish church, and extending the erection of the said prebend for his lifetime. The pope hereby dispenses him to receive the said canonry and prebend, and to retain them with the said annexed parish church, notwithstanding the said defect, etc. Vite ac morum. To the bishop of Raphoe, Thomas Macharmaych, canon of Raphoe, and the official of the same. Mandate, as below. The pope has been informed by Emundus Orobfarryn, rector of Tulachfirma in the diocese of Raphoe, that John Olasce, a canon of Raphoe, has, when under sentence of excommunication, celebrated masses and other divine offices, and taken part therein, thereby rendering himself unworthy to rule and administer the monastery of St. Mary, Assaroe (de Sameria), O. Cist., in the said diocese, which he holds in commendam by papal grant and dispensation. The pope therefore hereby orders the above three, if Emundus will accuse John before them, to summon the latter, and if they find the foregoing to be true, to annul the said commenda, deprive John of the rule and administration, and remove him therefrom, and in that event to receive Emundus as a monk of the said monastery, give him the habit and receive his profession, and thereupon to make provision to him, if found fit, of the said monastery, value 20 marks sterling, that of the said church (which he is to resign as soon as he has made his profession) not exceeding 7. To the abbots of Saballo, Insula, and Bangor, in the diocese of Down (Dunen.). Mandate to collate and assign to Patrick Macgyan, clerk, of the diocese of Down (who was lately made a clerk, in virtue of a dispensation by authority of the ordinary on account of illegitimacy as the son of unmarried parents) the rectory of Arkyn in the said diocese, value 3 marks sterling, so long void by the death of John Mackasyn without the Roman court that its collation has lapsed to the apostolic see, although Patrick alias Mackasyn, (fn. 18) priest, who is to be summoned and removed, has detained possession of it for several years without any title. To the prior of St. Mary's, Rathgaeli, in the diocese of Limerick, John Baptista de Ferrariis, a canon of Modena, and Gerald Machoeid, a canon of Cloyne (Clonen.). Mandate, as below. The ministership or priorship of the Trinitarian house or monastery of St. James, Athare, in the diocese of Limerick, a conventual dignity, has become void by the death of John Machlamche (recte Machlanche) without the Roman court, and therefore reserved to the pope by his late reservation of all conventual dignities. And the recent petition of Eugenius Offaelain, clerk, of the diocese of Cloyne, bachelor in decrees, contained that without letters dismissory of his own bishop, and without any mention of his illegitimacy, as the son of a clerk and an unmarried or a married woman, and without having obtained a dispensation, he had himself made a clerk by another bishop than his own, that he entered a certain house of Friars Minors in those parts, assumed the habit and wore it for three days, and, after having remained for a fortnight in the said house and order, put off the said habit and, with the consent of the guardian and friars, left the said house and order, and behaved as a secular clerk, as he does at present; that he obtained letters from the penitentiary of the present pope, by which letters (containing no mention of the foregoing) a certain judge in those parts was ordered to dispense him on account of illegitimacy, as the son, as he then alleged, of a clerk and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure; that, on the voidance of the priorship of the house or hospital of St. Edward, king and martyr, by the bridge of Limerick, O.S.A., conventual, elective, and with cure, and the subsequent voidance of the rectory of Sandron in the said diocese of Cloyne, of lay patronage, values 40 and 20 marks sterling, respectively, he, without having presented the said letters to the said judge, and under pretext of certain letters of Paul II, in which it was stated that he had been sufficiently dispensed on account of the said defect, obtained a grant of the said priorship of St. Edward's in commendam, and was also at the presentation of the patron instituted by the ordinary as rector of the said church; that under pretext of the said commenda and the said presentation and institution, respectively, he obtained possession of the said priorship and rectory, and has detained them for more than eight and eleven years, respectively, against Execrabilis; that he despoiled certain clerks of the fruits etc., valued 8 and 4 marks sterling, respectively, of the parish churches of Congaurat and Ballicancartcart (?) (fn. 19) in the dioceses of Cloyne and Limerick, which fruits etc. are wont to be granted to yearly farm or pension, (fn. 20) and had been granted to farm to the said clerks by the abbesses and nuns of Grayn and Themolinberch, O.S.A., in the dioceses of Dublin and Leighlin [sic], (fn. 21) to whom the said churches of Cogaurat (fn. 22) and Ballichancart are united in perpetuity, and took the said fruits etc. for some time; that he has been received as a canon of Cloyne; that he for some time trafficked in salt, iron and other things; and that by publicly studying and teaching civil law in the schools he has become versed therein. (fn. 23) The pope, therefore, (seeing that he has given up the said priory, rectory and fruits, or has been deprived of them, is ready to give up the said canonry, was publicly excommunicated on account of a res judicata, although he has been already absolved in foro conscientie, and is ready to come to an agreement with the adversaries at whose instance he was excommunicated, in respect of the matters about which he has not yet done so), hereby absolves him from the said excommunication of the res judicata and any other sentences of excommunication, suspension, interdict and irregularity, disability and infamy, even contracted by reason of such res judicata, and other sentences, censures and pains, (fn. 24) as far only as regards the taking effect of these presents, and, holding all his benefices and their values etc., and the time during which he has remained under excommunication by reason of the said res judicata, as being expressed by these presents, orders the above three to absolve him from apostasy, and from sentence of excommunication and other sentences, censures and pains aforesaid, enjoining penance, etc., dispense him on account of any irregularity contracted, and rehabilitate him, and, in the event of their so doing, to receive him as a brother of the said house or monastery of St. James, give him the regular habit, etc., and receive his profession, and thereupon to collate and assign to him the said ministership or priorship, elective and with cure, value, with its annexes, (fn. 25) 50 marks sterling. The pope hereby dispenses him to use the said character (i.e. of a clerk), and to be promoted to all, even holy orders, and receive and retain the said ministership or priorship, notwithstanding the said defect, etc. Solet apostolice sedis.
