The pope has been informed by Malachy Macachlerich, clerk, of the diocese of Kilmore, that John Macmaelmactain (?), rector of Kedy alias de Nurni (?), in the said diocese, has given a sum of money to the ordinaries in order to obtain benefices for himself and his son, thereby committing simony. The pope, therefore, hereby orders the above three, if Malachy will accuse John before them, to summon the latter, and if they find the foregoing to be true, to deprive and remove him from the said rectory, and in that event to collate and assign it, without cure and value 8 marks sterling, to Malachy. Mandate to collate and assign to Peter Cantuel, a canon of Cashel, bachelor in decrees (who was lately dispensed by papal authority on account of illegitimacy, as the son of an archdeacon in subdeacon's orders and an unmarried woman, to be promoted to all, even holy orders and hold a benefice, even if it had cure and were a canonry and prebend in a cathedral church, and who in virtue thereof has been so promoted, and has obtained by canonical collation a canonry and prebend of Cashel and the thereto united [perpetual] vicarage of the parish [church] of St. John Baptist de Fidarth in the diocese of Cashel, and who has no hope of obtaining justice in the city and diocese of Ossory), the archdeaconry of Ossory, a non-major dignity with cure, value 60 marks sterling, so long void that its collation has lapsed to the apostolic see, although Thomas Porcell, clerk, who is to be summoned and removed, has detained possession for between two and three years without any title; notwithstanding other letters by which the pope has ordered provision of the said archdeaconry to be made to Robert Edian, clerk, of the diocese of Ossory, as being then void by the resignation to the ordinary of Patrick Duyt (?), who has without any right detained possession for some time, but less than two years. To the abbot of St. Mary's, Fermoy (de Castro dei), in the diocese of Cloyne (Clonen.), and Gerald [son] of the White Knight (militis albi) and Gerald Machoyd, canons of Cloyne. Mandate to grant in commendam for life to Philip Roche, prior of St. Mary's, Bridgetown (Ville pontis), O.S.A., in the diocese of Cloyne (who has had provision made to him of the said priory by papal authority, but is not in possession), a canonry of Cloyne and the rectory called the prebend of Hathwli therein, and the perpetual vicarage of the parish church, also of Hathwli, in the said diocese. (to which vicarage is annexed the perpetual vicarage of the parish church of Villhathi in the same [diocese]) value altogether 24 marks sterling, so long void that there is no certain knowledge of the way of voidance, and that their collation has lapsed to the apostolic see; summoning, and removing John Whit and William Cwssin, clerks or priests, who have without any canonical title detained the said canonry and prebend of Hat[h]wli for between thirteen and fifteen years, and the said vicarage for between six and nine years, respectively. To the archdeacon and the chancellor of Ardfert, and John Offynd, a canon of the same. Mandate, as below. The recent petition of Odo Imwryhyrti [sic], a canon of Ardfert, contained that an attack was made by men-at-arms against the friends of the said Odo and his brother, and booty taken, that Odo and his brother and other armed men pursued the said men-at-arms for the recovery of the said booty, and that Odo cut off with his sword the thumb of one of the said assailants (fn. 1); that subsequently, upon the voidance of the rectory of Ballyhedyrsceoll in the diocese of Ardfert, John, bishop of Ardfert, by his ordinary authority and with the consent of the dean and chapter of Ardfert, united it and its perpetually annexed chapel of Leakh, in the same diocese, to a canonry of Ardfert and the prebend of Fenynd, which the said Odo was then holding, as he does at present, and that in virtue thereof he took possession of the said rectory and chapel, and has held them for between five and seven years. Odo's said petition added that it is doubted by some whether the said union holds good, that he is sorry in regard to the foresaid, that he was not guilty otherwise than as stated, and that he desires to do penance, and that if the said rectory and its annexes were united to the said canonry and prebend for his lifetime only, it would be to his benefit. The pope has also been informed by him that John de Geraldinis, prior of the priory of St. Mary, Killagh (de Bello loco), O.S.A., in the said diocese, has taken part in warlike and other cruel arts, wherein a number of men have been slain, (fn. 2) is a notorious fornicator, and has converted the fruits etc. of the said monastery to profane and unlawful purposes. The pope, therefore, hereby orders the above three to absolve Odo, who is by both parents of noble birth, from the said excess, enjoining penance etc., to dispense him on account of any irregularity contracted, to dispense him to be promoted to all, even holy orders, and minister therein and in those which he has already received, even in the ministry of the altar, and retain the said canonry and prebend, and to rehabilitate him, and moreover, in the event of their so doing, to unite anew the said rectory and its annex, value 10 marks sterling, to the said canonry and prebend, value 2 marks sterling, for so long only as he shall hold the latter; and moreover, if he will accuse the said John before them, to summon the latter and also Florence Marcharthy, who behaves as prior of the said monastery, and who (under pretext of papal letters in which, as Odo alleges, he falsely stated that the value of the said priory, which is of lay patronage, does not exceed 200 marks sterling, and in which he made no mention of the said patronage) has for between eight and nine years had a controversy with the said John, and held possession of part of the fruits etc. of the said priory, as he does at present, and if they find the foregoing to be true, and the said letters to be surreptitious, as above, to deprive and remove the said John, declare that the said letters were surreptitious, receive Odo as a canon of the said monastery, give him the regular habit, receive his profession, and thereupon, and in the event of their making the said deprivation and removal and the said declaration, to collate and assign the said priory, conventual, with cure, elective, and value 300 marks sterling, howsoever void, to the said Odo, removing the said John and Florence and any other unlawful detainer. The pope hereby dispenses Odo to retain the said canonry and prebend and annexes in commendam with the said priory, even after he has made his profession, until he obtains peaceable possession of the latter, but wills that after he obtains such possession the said commenda shall cease, and that upon his resignation or death or otherwise giving up the said canonry and prebend, the said union shall be dissolved, and the said rectory return to its former state. To John Ocronin and Philip Copmer, canons of Cork. (fn. 3) Mandate, as below. The recent petition of Maurice Mortel, clerk, of the diocese of Cork, contained that the monastery of Bath (Gacen. [sic]), O.S.B., in the diocese of Bath (Bacen. [sic]), holds in the said diocese of Cork a certain perpetual rectory (fn. 4) of the parish church of the place of Kinsale, which is let to farm or yearly pension to ecclesiastical or secular persons, under a certain annual cess to be paid to the said monastery or the abbot thereof, which [rectory] is at present detained by a monk of the said Order who does not understand the language of that country, on account of which he [cannot] hear the confessions of the parishioners and administer the sacraments, [and] neglects and refuses to appoint a chaplain who could do so, to the great detriment of the parishioners, etc. (fn. 5) The pope, therefore, hereby orders the above two to summon those concerned, make an inquiry, and if they find the facts to be as stated, to deprive and remove the said monk, and in that event, and if they find that the grant will be to the benefit of the said monastery, rectory and parishioners, to grant and assign the said rectory or (fn. 6) its fruits etc. to the said Maurice (who is a native of the said place) to farm or yearly pension, with such becoming increase of the said cess as shall seem good to them. Assignment, in aid of the defence of Rhodes, etc., of the first year's fruits of benefices in the Hospitallers’ priory of England, as below. The recent petition of John Gandal [sic], turcopolier of the hospital of St. John of Jerusalem, and preceptor of the preceptories of Melcheborne, Willuton’, Ossyngton’, Wymkeborne, Newland, and of the preceptories, called the master's camere, of Stalffeld, Rodemsam and Peccham, in the priory of England, and orator of the master and convent of the said hospital to the pope, contained that each lingua in the island of Rhodes is bound over and above the defence of the common treasury of the said hospital, to fortify the place assigned to it for defence, with arms, machines and other defensive and offensive warlike instruments, but that the said turcopolier and the English lingua, when in years past the said city was besieged by the Turks with a very powerful army, consumed all the said arms, machines and instruments for the defence of the place assigned to them, so that if (which God forbid) the said city were again besieged by the Turks or by other infidels, the said turcopolier and lingua could not conveniently fortify with the said arms and instruments the place to be assigned to them, inasmuch as the said lingua has no fixed revenues for the purpose; that the house or barracks of the said lingua in the said city was so much ruined by the blows of the machines at the time of the said siege, and by an earthquake during the year last past, that it is in great need of repair; and that if one year's fruits etc. of all ecclesiastical benefices in the priory of England, in the gift of the prior and preceptors and other persons of the said hospital and lingua, whenever they became void, were applied in perpetuity to the said fortification and to the repair of the choirs of the churches of such benefices, if necessary, or, if not, to the repair of others in need thereof, and also to the repair of the said house or barracks, a fit portion of the said fruits etc. being reserved for those to whom the said benefices shall be collated or who shall be instituted therein during the year in which the said fruits shall be taken, the said turcopolier and lingua would be more easily able to fortify and defend the place to be assigned to them, and repair the said choirs. (fn. 8) At the petition, therefore, of the said turcopolier and of the brethren of the said lingua, the pope, seeing that not only is the preservation of the said hospital and city at stake, but also the whole of Christendom, hereby applies and appropriates in perpetuity the first year's fruits etc. of all benefices within the bounds of the said priory, in the gift etc. of the prior and preceptors and other persons of the hospital and the English lingua, as often as they become void, to the said fortification and repair, in equal parts, a fit portion being reserved, as above. The pope further ordains that the said prior, preceptors and other persons shall not present etc. to the said benefices, unless they have first received fit and sufficient surety in proportion to the value of the said first year's fruits etc., and that the receiving and disposing of the moiety of the said fruits etc., [thus] applied and appropriated to the said fortification and the restoration of the said house or barracks, shall belong to the said John for life, even if he should cease to be turcopolier, and thereafter to the turcopolier for the time being, who shall every three years render an account of their receipts and disbursements to the said lingua, and that the receiving and disposing of the other moiety, applied to the repair, of the said choirs, shall belong to the said collators etc., prior, preceptors and brethren, for the said repair, etc. (fn. 9) The pope further decrees, inasmuch as it would be difficult to convey these presents to all places where it would be expedient, that notarial copies, sealed with the seal of the said turcopolier or prior or preceptors, or of an ecclesiastical court, or of an ecclesiastical dignity, shall have the same credence as these presents would have. Mandate (the monastery of St. Mary, Ballysadare (de Asdara), O.S.A., in the diocese of Achonry, having been so long void by the death without the Roman court of Maurice Macdonhyd, sometime abbot thereof, that its provision has lapsed to the apostolic see, although Cornelius Macserryd, a canon of the said Order, who is to be summoned and removed, has without any title detained possession for between one and two years), to grant the said monastery, value 30 marks sterling, in commendam for life to Magonius Maccloneyd [sic], abbot of Holy Trinity, Iochque (recte Lochque), O. Prem., in the diocese of Elphin, who was lately dispensed by papal authority on account of illegitimacy, as the son of an unmarried nobleman and an unmarried woman, related in certain degrees of kindred or affinity, to be abbot of the said monastery. To the archdeacon and the official of Cashel. (fn. 11) Mandate, as below. The recent petition of Richard Buttiler, clerk, of the diocese of Cashel, contained that the hospital of St. John Baptist without the new gate of the city of Dublin, immediately belonging to the Roman church, possesses from time immemorial a number of rectories of parish churches and arable lands in divers dioceses and in the province of Cashel, which,. or the fruits etc. thereof, have been wont to be granted to farm or yearly pension, for long or short periods, to any (fn. 12) persons, both ecclesiastical and secular, under a yearly cess payable to the said hospital or its prior; that some of the said rectories are at present granted to farm or yearly pension to divers persons, both clerks and laymen, under the wonted yearly cess; and that some of them have begun to fall into ruin through neglect of their holders, especially of Richard Edian, (fn. 13) who is a brother of the said hospital, and who (after he had impetrated the priorship of the said hospital from the apostolic see, and had caused the prior to be summoned before the papal executors, and had won a definitive sentence against him), obtained, as the result of an agreement made at the intervention of friends of both parties, a life grant to farm or yearly pension, under a yearly cess, of a number of the said rectories etc. Seeing that Edian (who is said to have obtained confirmation from the said see of the grant made to him), and other holders of the said rectories etc., do not keep the said churches in repair, but allow the rain to come through the roofs, even as far as the altars, and convert the fruits etc. to evil purposes; and seeing that, as the said petition added, Buttiler desires to devote himself to the repair of all the said churches, both with his own goods and with the fruits etc. of the said churches, if they be granted to him for life to farm or yearly pension, under the said wonted cess or a greater one, the pope, at the petition of Buttiler, who alleges that he is by both parents of noble birth, and that Hedian (fn. 14) has committed simony, both in the obtaining of the said rectories, and also with divers other ecclesiastical persons and with the said prior, and is a notorious fornicator, perjuror, and apostate, and is irregular, hereby orders the above three to summon Edian and others concerned, and if they find the foregoing to be true, to deprive Edian and other detainers of the grant and assignment made to them, and remove them, and moreover, in the event of their so doing, and if they find that it will be to the benefit of the said hospital and rectories, etc., to grant the said rectories to Buttiler to farm or yearly pension for life, under the said or a greater yearly cess, to be paid to the said hospital. Decree, etc., as below. The pope lately translated Robert, [now] bishop of Glasgow, from Aberdeen to Glasgow, then void in a certain way, (fn. 17) and William, [now] bishop of Aberdeen, from Ross to Aberdeen, void by the said translation of Robert; and the said Robert and William received at divers times from Philip de Stroziis and his fellows, merchants of Florence following the Roman court, and bound themselves to repay, a loan of 12490 ducats of gold of the Camera for the expedition of their letters of translation and for the payment of the annates due to the Camera, and for the payment of the dues of the college of cardinals and the officials of the said court, and also for the said bishops’ other needs. And although the said Camera, college and officials are, for certain causes and in a certain event, (fn. 17) bound to the said merchants in about 6000 florins of the said sum of 12490 ducats, nevertheless, inasmuch as the said translations have not hitherto completely taken effect, the said Robert and William have not been able to pay the said sum, nor are they likely to be able to pay it, unless they obtain possession of their respective churches, which, it is believed, will be very difficult. The pope, therefore, hereby ordains and decrees, motu proprio, that whosoever obtains from the pope or the apostolic see provision of the said church of Glasgow shall, before the papal letters of his provision are delivered to him from the said Camera, be held bound to pay the said sum of 12490 ducats to the said merchants out of his own pocket, (fn. 18) less what the said merchants should recover (fn. 19) from the said Camera, college and officials in the said event; with inhibition hereby to the chamberlain, clerks and the other officials of the said Camera, and all others interested, to deliver the papal letters of provision and appointment to any one, unless satisfaction has first been fully made to the said merchants: otherwise such appointment shall be null and void.
