To the abbot of SS. Peter and Paul the Apostles, de Forgeo alias de Clar, in the diocese of Killaloe (Laonien.), the dean of Killaloe, and Donatus Ograda, a canon of the same. Mandate, as below. The pope has been informed by Gilbert Artur, treasurer of Limerick, that Eugenius Offelain, clerk, of the diocese of Cloyne (Clonen.), who holds in commendam by papal grant and dispensation the priory or house of the hospital of B. Mary and St. Edward the Martyr by the bridge of Limerick, O.S.A., in the diocese of Limerick, for several years took the fruits, etc., of certain churches in the said dioceses, under pretext of a certain forged process based upon certain papal letters which he alleged that he had, but which did not in fact exist, and has been convicted of forgery, and condemned to be punished as a forger of papal letters. (fn. 4) The pope therefore hereby orders the above three, if Gilbert (who alleges that he is of a family of magnates of the city of Limerick, (fn. 5) and who from fear of the power of Eugenius cannot safely meet him in the city or diocese of Limerick) will accuse Engenius before them, to summon the latter, and if they find the aforesaid to be true, to deprive him of the said commenda and remove him from the said priory, and in that event to grant the priory, which is conventual, elective and with cure, and in which hospitality to the poor is wont to be kept, and whose value does not exceed 40 marks sterling, to Gilbert in commendam for life, to be held by him with the said treasurership, a non-major, non-elective dignity with cure, value also not exceeding 40 marks sterling. 14 Kal. April.
(19 March.)
St. Peter's, Rome.
(f. 310r.)
To Master Anthony de Grassis, a papal chaplain and auditor. Mandate, as below. The recent petition of John, bishop of Exeter, contained that before he was promoted to the church of Exeter provision was made to him by authority of the ordinary of the wardenship of the church of Manchester (Mamcestria) (fn. 6) in the diocese of Coventry and Lichfield, on its voidance by the resignation of Roger Radclyff to the ordinary for purpose of exchange, and that he had obtained possession in virtue of the said provision, and had held it for some years, and was still holding it; that Paul II, who had made provision to the said John of the said church of Exeter, granted to him that even after his consecration, etc., he might retain in commendam for life with the said church of Exeter the said wardenship, which he alleged to be an office in the said church of Manchester (de Mancestria), decreeing that the said wardenship was not void by the said promotion or consecration, etc.; that, nevertheless, a dispute arose between him and Ralph Longley, clerk, who alleged that the said wardenship was in the Patronage, of the lord of the said place of Manchester (loci de Mamcestria), and that he had been presented thereto by the said lord after the said provision, and instituted by the said authority [of the ordinary]; and that, after the cause had long been agitated in the Roman court before divers judges, the said Ralph won three definitive sentences, with condemnation in fruits and costs, against the said bishop; that upon the latter appealing to the apostolic see from the last of the said sentences, and it being adjudged by three concordant definitive sentences one after the other that the said appeal was null, the said pope for certain reasons gave a commission to the above-named auditor, if he found to be true what was alleged in the said commission, etc., to admit the said bishop to prosecute the said appeal, hear the said cause and do justice; (fn. 7) and that the said auditor, proceeding lawfully, etc., admitted the said bishop to the prosecution of the appeal lodged by him from the said last sentence, and is said to have proceeded, short of a conclusion. Seeing that, as the said petition added, the said wardenship is a principal dignity in the said church of Manchester (de Mancestria), that the said bishop has no right in or to it, that it is also alleged that the said Ralph has no right in or to it, and that it is still void by the said resignation, the pope hereby, holding the state of the cause to be expressed by these presents, orders the above auditor, if by the event of the suit he find that the said Ralph also has no right in or to the said wardenship, to grant it, a non-elective principal dignity with cure, value not exceeding 40l. sterling, in commendam to the said bishop for life, and induct him, after first receiving from him the usual oath of fealty according to the form enclosed, etc. Personam venerabilis fratris nostri Johannis. [5⅓ pp. See Reg. Lat. DCCXXI, f. 185v., above, p. 308. See also ‘Bothe’ in Index of Cal. Papal Lett. XI.]

To the chancellor of Armagh. Mandate, as below. The recent petition of the perpetual beneficiaries in the church of Armagh, called the Culdees (Coledei), contained that archbishop John lately appropriated in perpetuity to the college of the said beneficiaries, with the consent of the dean and chapter, the rectory of the parish church of Dompnachmor in the diocese of Armagh, then void by the resignation to the said archbishop of John Olucharean; that Thady Odougale, clerk, falsely alleging that provision had been made to him of the said rectory by papal authority, obtained letters to certain judges against the said beneficiaries, under pretext of which he caused them to be cited before the said judges, who wrongfully proceeding, promulgated an unjust definitive sentence in favour of the said Thady and against the said beneficiaries, from which the latter appealed to the apostolic see; that, the cause of the appeal having been committed to no one, the said Thady, seeing that he had no right in or to the said rectory, has given up the prosecution of the suit, and has confessed before witnesses that he has no such right, and has ceded such right, if any. The pope, therefore, hereby orders the above chancellor to summon Thady and others concerned, admit the said cession, if found lawful, and confirm the said appropriation, and in the event of his so doing, and pro potiori cautela, to appropriate in perpetuity by papal authority the said rectory (which has cure of souls, wont to be exercised by the perpetual vicar of the said parish church), (fn. 8) to the said college, value 12 and 24 marks sterling, respectively.
