To the archdeacon and the chancellor of Lismore, and Maurice Stak, a canon of the same. Mandate, as below. It was set forth to Paul II by Edmund Stapulton alias Archier, clerk, of the diocese of Cashel, that on its being suggested to the said pope by William, bishop of Emly, that the fruits, etc., of his episcopal mensa were too slight for his maintenance, the said pope, circumvented thereby, granted him in commendam for life the priory of St. Mary, Kells (de Kenlis), O.S.A., in the diocese of Ossory, which had been so long void that its collation had lapsed to the apostolic see; that the fruits etc. of the said mensa were quite sufficient for the said bishop to keep up his episcopal state etc., and that on account of the said commenda divine worship in the said priory was neglected. The said pope, therefore, seeing that if this were so his said letters were surreptitious, ordered certain judges to summon the said bishop and others concerned, and if they found the facts to be as stated, to decree and declare the said letters (under pretext of which the said bishop had detained the said priory for about five years, as he still does) null and void, and remove him, and in that event to cause the said Edmund (who was lately dispensed by authority of the ordinary on account of illegitimacy, as the son of a canon of the said order in priest's orders and an unmarried woman, to be promoted to minor orders and hold a benefice without cure, after which he was made a clerk) to be received as a canon of the said monastery, give him the regular habit, and receive his profession, and thereupon to collate and assign to him the said priory, conventual, with cure, elective, and value not exceeding 100 marks sterling. The recent petition of the said Edmund to the present pope contained that although he procured proceedings of execution of the said letters, he was by the power of the said bishop and his adherents, and by intimidation, (fn. 2) forced to cede to the ordinary his right in or to the said priory, after receiving a sum of money for his expenses in the expedition of the said letters, etc. The pope, therefore, hereby orders the above three to summon the said bishop and others concerned, and if they find to be true what is alleged in regard to the said fear and violence, and that it was on account thereof that the said Edmund made the said cession, to restore and replace him in his pristine right, decree and declare that the said letters have held and do hold good, and proceed to execute them, as if they had been directed to them. To the abbot of Holy Cross, Wocturlawayn, in the diocese of Cashel, and William Omeachayr and Adam Ohyffyrnayn, canons of Cashel. Mandate, as below. The recent petition of John, archbishop of Cashel, contained that there are very many benefices in the diocese of Cashel belonging to divers religious places, exempt and non-exempt, especially to the prior and convent of the house of St. John without the new gate of Dublin, of the Hospital of St. John of Jerusalem, which benefices are wont to be let to farm or yearly pension to useless persons, even laymen, to the prejudice of the said places and of the churches of the diocese; and added that if the said benefices were leased for life under an honest yearly cess to the said archbishop (who cannot decently maintain himself, etc., on account of the slenderness of the fruits etc. of the archiepiscopal mensa, the yearly value of which does not exceed 60 marks sterling), it would be to his relief, and would also obviate the dissensions and scandals which sometimes arise on account of the foregoing. The pope, therefore, hereby orders the above three, if they find the facts to be as stated, and if the master of the said Hospital consent, to grant the fruits etc. of each of the said benefices to the said archbishop for life under the wonted yearly cess. To William Marschall, priest, of the diocese of Glasgow. Grant, as below. His recent petition contained that a dispute arose between him and Walter Dowglas, priest, and Alan Cony[n]ghame, clerk, of the diocese of Glasgow, about the perpetual vicarage of Galston in the said diocese, of which the said Alan holds possession; that at the instance of the said Alan Paul II committed the cause, although not lawfully devolved to the Roman court, to Master Anthony de Grassis, chaplain of the present, as of the said pope, and an auditor of causes of the apostolic palace, who by a definitive sentence adjudged the vicarage to the said Walter, from which the said William and Alan appealed [to the apostolic see]; and that, the cause being still pending, the said William has this day for the sake of peace and concord given up to the pope the said suit and all right in or to the said vicarage by his proctor, William Marschall, clerk, of the said diocese. The pope, therefore, hereby grants him a yearly pension for life of 10l. of the usual money of Scotland, equal to 15 gold ducats of the Camera, from the fruits etc. of the said vicarage, value not exceeding 38l. of like money, to be paid, on obtaining possession, by the said Walter, (who has consented by his proctor, Alexander Rate, clerk, of the diocese of St. Andrews) and by his successors, half at St. John Baptist's and half at Christmas; with sanctions for non-payment. Mandate to collate and assign to David Ocormachayn, priest, of the diocese of Lismore (who was lately dispensed by papal authority on account of illegitimacy, as the son of a priest and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure, after which he had himself so promoted and obtained the parish church of St. Mary, Newcastle (de Novocastro), in the said diocese, which he afterwards resigned) the perpetual vicarage of St. Mary's, Kykonayn [sic], in the said diocese, with cure and value 9 marks sterling, so long void that its collation has lapsed to the apostolic see, although Donald Olhacnayn [sic], who is to be summoned and removed, has without any title detained it for between about eighteen and twenty years, from fear of whose power the said David cannot safely meet him in the city and diocese of Lismore. David is hereby specially dispensed to receive and retain the said vicarage and any other compatible benefices, and to resign all, simply or for exchange, as often as he pleases, notwithstanding the said defect, etc. Vite etc. (At the end: A. xxx.
