To the dean of Kildare (Daren.). Mandate, as below. The recent petition of Kervallus Ycolghan, priest, of the diocese of Kildare, contained that on the [perpetual] vicarage of Gessyleyt alias Rylleye, in the said diocese, of lay patronage, becoming void by the resignation of the late William Ycolghan, by proctor, to Paul II (to which pope Edmund Oduyud, clerk, of the said diocese, to whom the said pope had granted provision of the said vicarage, on its voidance as above, gave up the said grant, without the letters thereof having been drawn up), the said pope ordered provision to be made to the said Kervallus, dispensing him on account of illegitimacy, as the son of a priest and an unmarried or a married woman, to receive and retain it; that, before obtaining possession of the said vicarage, he made a bargain with Maurus Omaena, clerk, of the said diocese, who alleged that he had a right to it, to the effect that if the latter did not molest him he would pay him a sum of money, after which he obtained possession, and has with consent of the patron detained it for between four and five years, even after beating in self-defence, with a little bloodshed, a certain priest of the said diocese, who was aiding another claimant to the vicarage; and that he has meanwhile had himself promoted to all, even holy and priest's orders, and ministered therein, but not in contempt of the Keys. The pope, therefore, hereby orders the above dean to absolve Kervallus from the crime of simony and violence and from sentences of excommunication, etc., incurred therefor, enjoining a salutary penance, rehabilitate him, dispense him on account of irregularity, and dispense him to minister in his orders, and thereafter to collate and assign to him the said vicarage, value 12 marks sterling. The pope further dispenses him to resign it as often [sic] as he pleases, (fn. 3) and hold instead another similar or dissimilar benefice. Confirmation, at the recent petition of the abbot and convent of the monastery of Theukesbury. O.S.B., in the diocese of Worcester, of the appropriation to the said monastery by John, bishop of Worcester, of the priory of Derhurst, of the said order and in the said diocese, conventual, with cure of souls, dependent on no monastery or regular place, and of the patronage of the kings of England. The pope exemplifies: (i). The letters of John, bishop of Worcester, drawn up in the form of a public instrument, in two pieces of parchment, and attested by Robert Enkbarow, clerk, of the diocese of Worcester, notary public by papal authority, in the year 1469, indiction 2, the 5th year of Paul II, June 29, in the chapel within the bishop's manor of Northewyk (fn. 6) by the city of Worcester, in the presence of the following witnesses: master Thomas Balsall, S.T.P., master William Mogiis, M.A., archdeacon of Stafford and Anglesey, John Gower, esquire, literate, and Richard Clent, literate, of the dioceses of Worcester and Exeter. (fn. 7) The said bishop recapitulates the letters patent of king Edward IV, dated at Westminster, 25 July anno 7 [1467], and granting in frank almoin from the preceding 3 June to John Galeys, abbot, and the convent of the monastery of St. Mary, Teukesbury, the said priory of Derhurst, with its manors of Derhurst, Hawe, Wolston, Okynton, Culne St. Denis, Welneford, Preston, and Compton, in the county of Gloucester, and More and Teynton, in the county of Oxford, rents of salt-pans in le Wyche, in the county of Worcester, and all lands, etc., and the churches of Derhurst and Okynton with their annexed chapels, lately appropriated to the said priory, with all demesne lands, etc., the statute of mortmain notwithstanding [Cal. Pat. Rolls, 1467–77, p. 66]; and in accordance therewith, and at the petition of the abbot and convent of the said monastery of Teukesbury, and of their proctor, William Vance, I.U.B., appropriates in perpetuity the said priory of Derhurst with its said manors, etc., to the said monastery, to the honour of God and the Assumption of the Blessed Virgin Mary, in whose honour the said monastery is founded and dedicated; (fn. 8) ordains that there shall be in the said priory one religious in priest's orders, being a monk of the said monastery, who shall be prior or warden of the said priory, appointed and removeable at the will and pleasure of the abbot, (fn. 9) and four other monks and a secular priest to celebrate masses and other divine offices in the said priory daily for ever, which secular priest shall administer the sacraments and sacramentals to the parishioners of the parish church of Derhurst; that the said prior or warden and monks and secular priest shall pray and celebrate for the good estate of king Edward and queen Elizabeth, and for their souls after death, and for the souls of Richard, late earl of York, the king's father, etc. [as named in the above-mentioned letters patent]; that they shall receive competent maintenance from the said abbot and convent; that they and their successors, and their servants, etc., shall be subject etc. to the said bishop and his successors, who shall have and exercise all ordinary jurisdiction and correction over them as hitherto and at present exercised in the said monastery and over its abbot and convent and servants, etc., that the said bishop and his successors shall have and exercise all ordinary jurisdiction, visitation and correction over the said parish church of Derhurst and all churches, etc. in the diocese of Worcester, appropriated, etc., to the said priory, and over their vicars, chaplains and parishioners, as hitherto had and exercised by him and his predecessors, etc., provided always that whenever he or his successors shall actually visit the said monastery, the said prior or warden and monks shall come to the said monastery, and submit themselves to visitation, like the other brethren of the said monastery; and that by way of indemnity the abbot and convent shall pay yearly at Michaelmas to the said bishop and his successors 20s., to the prior and chapter of Worcester 20s., and to the archdeacon of Gloucester 6s. 8d. The said bishop's letters exemplify: (a). The above-mentioned letters patent of Edward IV. (b). The letters of the abbot and convent of Teukesbury, sealed with their common seal, and dated in their chapter-house of Teukesbury, 21 April, 1468, recapitulating the said king's letters patent granting them in frank almoin, for the purpose of appropriation to their said monastery, the advowson of the alien priory of Derhurst, with the manors of Derhurst, Hawe, etc. [as above], and appointing master William Vance, I.U.B., as their proctor, with power to appear for them before John, bishop, and the prior and chapter of Worcester and the archdeacon of Gloucester, for the prosecution of the said appropriation, etc., and with power to sue for confirmation thereof in the apostolic court, or elsewhere, etc. (ii). The letters of prior Thomas and the chapter or convent of the cathedral church of St. Mary, Worcester, consenting to the said appropriation, sealed with their common seal, and dated in their chapter-house at Worcester, 1 May, 1469; (iii). To the abbot of St. Mary's, Newry (de Viridi ligno), in the diocese of Dromore, and John Osiaguil (? recte Ofraguil) and John Onustendih, canons of Dromore. Mandate, as below. The pope has been informed by Oliver Valche, a monk of Down, O.S.B., that Thomas Brecnai, prior of the said church, made a bargain with the late Thomas Maure alias Muclach (?), then prior, that if the said Thomas Maure [would receive] the said Thomas Brecnai [as a monk of the said church, and would resign the said priory in his favour], he would give up to him for life certain places etc. belonging to the said priory, which he did; and that after the said bargain the said Thomas Maure received the said Thomas Brecnai as a monk of the said church, and subsequently freely resigned the said priory to the late Thomas, bishop of Down, (fn. 10) who, perhaps in ignorance of the said bargain, admitted the resignation, and confirmed in the said priory the said Thomas Brecnay, who had been elected thereto by the said Thomas Maure alone; and that under pretext of the said election and confirmation the said Thomas Brecnay took possession of the said priory, and has detained it for about ten years, taking the fruits, thereby incurring simony and the sentences of excommunication etc. promulgated against simoniacs. The said election and confirmation being therefore without force, the pope hereby orders the above three, if the said Oliver (who is by both parents of noble race, and was born of a lawful marriage, and who has made his profession of the said order, (fn. 11) and who from fear of the said Thomas Brecnai cannot safely meet him in the city and diocese of Down), will accuse the said Thomas Brecnay before them, to summon the latter and others concerned, and if they find the foregoing to be true, to decree the said election and confirmation and their consequences null and void, and remove the said Thomas Brecnai, and in that event to collate and assign the said priory, elective and with cure, value not exceeding 30 marks sterling, to the said Oliver, whether it be void as above, or by the death of the said Thomas Moure [sic] extraR.c., or by his (fn. 12) free resignation, or whether it be void in any other way, etc. Religionis zelus, vite etc. (At the end: F. xx. To the bishop of Derry, the abbot of St. Mary's de Vtburim (fn. 14) in the diocese of Connor, and the archdeacon of Connor. Mandate, as below. The recent petition of Nellanus Onel, prior of St. Mary's, Muccumur, of the order of St. Victor, in the diocese of Connor, contained that on the priorship of the said monastery, a conventual dignity, becoming void by the death of Robert Macgilheinan extra R.c., after Paul II's reservation to his collation of all conventual priories, void and to be void, and after the said pope's aggravation of the sentences promulgated against simoniacs, the said Nellanus, who was then a secular clerk and in minor orders only, and who had been dispensed by papal authority on account of illegitimacy, as the son of unmarried parents, to be promoted to all, even holy orders and hold a benefice even with cure, made a bargain with the ordinary that if he would make him collation and provision of the said priory he would give him a certain sum of money; that after the said bargain the said ordinary made the said collation and provision, and gave him the regular habit, without his having made any other profession, or his having obtained any other dispensation on account of the said defect, and that under pretext thereof he took possession of the said priory, and has detained it for about eight years, taking the fruits; and that, after wearing the habit for some time, he has often put it off and engaged in secular business, (fn. 15) thereby incurring simony and apostasy, and the sentences of excommunication etc., therefor; and that, whilst under the said sentences etc., he had himself promoted to subdeacon's orders, and, thus promoted, has taken part in divine offices, thereby contracting irregularity. At his said petition, therefore, the pope (to whose gift the said priory, not having been disposed of by the said pope, remains reserved), hereby orders the above three to absolve him, after he has made his profession to them, from simony and apostasy and excommunication incurred therefor, and the said other sentences, etc., enjoining a salutary penance, etc., rehabilitate him, dispense him on account of irregularity incurred, and dispense him to minister in the said orders, and in the event of their so doing, to collate and assign to him the said priory, elective and with cure, dependent on no other regular place, and value not exceeding 12 marks sterling. The pope hereby specially dispenses him to receive and retain it, and resign it, as often as (fn. 16) he pleases, and to be promoted to priest's orders, notwithstanding the said defect of birth, etc. Solet sedes apostolica.
