Mandate to absolve from excommunication incurred, enjoining a salutary penance, and to dispense, after temporary separation, John Gwyn, layman, and Joan Gamage, mulier, of his diocese, (who contracted marriage, not in ignorance that they were related in the third and triple fourth degrees of affinity), to remain in the said marriage, notwithstanding the said impediments of affinity, and also the fact that the said Joan was godmother to a daughter of the said John by another wife; decreeing past offspring, if any, and future offspring legitimate. To Roger Rotherham, archdeacon of Rochester (Roffen.), doctor of civil law (legum). Dispensation, as below. Paul II dispensed him to receive and retain for life with the parish church of Fecknam in the diocese of Norwich one other benefice, or without the said church any two other benefices, with cure or otherwise incompatible, even if parish churches, etc., or dignities etc., and to resign them, simply or for exchange, as often as he pleased [Cal. Papal Lett., XII, p. 799]. The pope now dispenses him, who has resigned Fecknam, and has in virtue of the said dispensation obtained the archdeaconry of Rochester, which is a major dignity, and the archdeaconry of Chester in the church of Coventry and Lichfield, which is a non-major dignity, to receive and retain for life with the said archdeaconries, or with such other two incompatible benefices, any third benefice with cure or otherwise incompatible, even if a parish church, etc., or a dignity, etc., and to resign it, simply or for exchange, as often as he pleases; provided that of such three incompatible benefices not more than two be parish churches or perpetual vicarages. To the archdeacon and the precentor of Ross, and Anasius [sic] Odonnamayn, a canon of the same. Mandate, as below. The pope lately ordered provision to be made to John Roche, rector of St. Mary's, Standon, in the diocese of Cork, of the precentorship of Cork, void by the death of Donatus Oriwerdayn extra R.c., the pope's letters stating that, as the said John alleged, the fruits etc. of the said precentorship did not exceed an annual value of 20 marks sterling. The recent petition of Cornelius Ymurchu, clerk, of the said diocese, contained that he and a certain companion of his, both of whom were then clerks, after an exchange of insults came to blows, even to bloodshed (fn. 6); that the said Cornelius, being under a sentence of excommunication therefor, has often taken part in masses and other divine offices, but not in contempt of the Keys; and that the said fruits etc. are worth more than as stated, although not more than 30 marks sterling. The pope, therefore, hereby orders the above three, the said Cornelius being unable, from fear of the said John, to meet him in the city or diocese of Cork, to absolve him from the said excess and sentence, enjoining a salutary penance, dispense him on account of irregularity and rehabilitate him, and in the event of their so doing to summon the said John and others concerned, and, if they find the said letters surreptitious by reason of the said misstatement, to declare them null and void, and in that event to collate and assign the said precentorship, a non-major nonelective dignity, to the said Cornelius, inducting him, etc. Apostolice sedis indefessa clementia.
