5 Sixtus IV.

De Beneficiis Vacantibus.

1475[–6].
Prid. Non. Feb.
(4 Feb.)
St. Peter's, Rome.
(f. 80r.)
To Eugenius Macholan, Cornelius Ocyunayd, and Cornelius Odalay, canons of Cloyne (Clonen.). Mandate, as below. The pope has been informed by Hobertus Dyluyn, clerk, of the diocese of Meath (Minden., recte Miden.), that Rory Magruairc, prior of the priory of St. John Baptist, Cilleamduy, of the hospital of St. John of Jerusalem, has dilapidated and alienated the moveables of the said priory. The pope therefore orders the above three, if Hobertus (who is by both parents of noble birth and is in his twenty-second year, and who from fear of the said Rory has no hope of obtaining justice in the city and diocese of Meath) will accuse Rory before them, to summon the latter, and if they find the foregoing to be true, to deprive and remove him, and in that event to cause Hobertus to be received as a brother of the said hospital [of St. John of Jerusalem] and the regular habit to be given to him, etc., and receive his regular profession, and thereupon to collate and assign to him the said priory, which is conventual (fn. 2) and is sometimes collated by the ordinaries of the place, has cure, and the value of whose fruits, etc. does not exceed 24 marks sterling. The pope hereby dispenses him to receive and retain it, notwithstanding the said defect of age, etc. Apostolice sedis copiosa benignitas.) [2⅓ pp.]

S. Maria Maggiore.
Rome.
(f. 172v.)
To William ap John (Johannis), a canon of Llandaff. Mandate, as below. The recent petition of Thomas ap Morris (Mauritii), a canon of the priory of St. John the Evangelist de Kermerdyl [sic], O.S.A., in the diocese of St. Davids, contained that after Pius II had ordered that all who without canonical dispensation should have themselves promoted to any of the holy orders before the lawful age should be ipso jure suspended from the exercise of the same, and should, if during such suspension they ministered in the same orders, eo ipso incur irregularity, etc.; and that after Paul II had confirmed all sentences of excommunication, suspension etc. promulgated by his predecessors against simoniacs, the said Thomas (who is illegitimate, being the son of the late Maurice Wintyr, then a secular priest, afterwards prior of the said priory, and an unmarried woman), had himself in ignorance of the law promoted in his nineteenth year to all the said orders and ministered therein, even in the office of the altar; and that subsequently, on the voidance of the said priory (which is conventual and elective and has cure) by the free resignation of the said Maurice to the ordinary extra R.c., the convent elected as prior the said Thomas, then in his twenty-first year, without his having obtained any dispensation on account of the said defects of birth and age, and that he consented to the election and had it confirmed by authority of the ordinary, paying for such confirmation 6l. of the money of those parts, according to custom (fn. 3); and that under pretext of such election and confirmation he detained it for between four and five years, and administered it, taking the fruits etc., which he converted to the utility of the said priory, reserving only his food and clothing, thereby incurring simony and the said sentences etc. therefor. At the said petition, which added that he afterwards resigned the said priory, the pope hereby orders the above canon to absolve him from the said simony and sentences etc., enjoining a salutary penance, dispense him on account of irregularity, and dispense him to minister in his said orders, even in the office of the altar, and to receive and retain any mutually compatible benefices of the said order, of any number and kind, and rehabilitate him. Apostolice sedis indefessa clementia. [21/5 pp.]

Mandate to collate and assign to Thady Ohanygayn, clerk, of the diocese of Cashel, a canonry of Cashel and the prebend of Kyllardyn therein, value 8 marks sterling, so long void that there is no certain knowledge of the mode of voidance and that its collation has lapsed to the apostolic see, although Thomas Cor, priest, of the diocese of Wat[er]ford, from fear of whose power the said Thady cannot safely meet him in the city and diocese of Cashel, has detained possession for between six months and two years, without any title; summoning and removing the said Thomas. Dignum etc. (At the end: P. xx. Qui[n]todecimo Kal. Julii anno quinto. de Varris.) [1½ pp.]

(f. 189v.)
To the dean of Kildare (Daren.), and Charles Odwud and William Haren, canons of the same. Mandate to collate and assign to Malachy Ohaelayn, clerk, of the diocese of Kildare (who notwithstanding his illegitimacy, as the son of unmarried parents, has been made a clerk) the perpetual vicarage of the parish church of Rathvinghayn in the said diocese, of lay patronage and value 12 marks sterling, void at the apostolic see [and therefore reserved to the pope] by the resignation of Gilbert Yhaelayn, made to the pope by Maurice Ocolghan, priest, of the said diocese, substituted as proctor by Malmora [sic] Ohaelayn, clerk, of the said diocese, proctor of the said Gilbert. The pope hereby dispenses him to be promoted to all even holy orders and receive and retain the said vicarage, and to resign it, simply or for exchange, when he pleases, notwithstanding the said defect of birth, etc. Vite etc. (At the end: N. xxvi. Quarto Kal. Septembris anno sexto. Garilliati.) [2 pp. +]

St. Peter's, Rome.
(f. 202r.)
To the archdeacon of Cashel. Mandate, as below. The recent petition of Gilasius Okaelly, priest, of the diocese of Killaloe (Laonien.), contained that on the voidance of the perpetual vicarage of the parish church of Kyllarda in the said diocese by the death of Matthew Ykaelly extra R.c., Matthew, bishop of Killaloe, made collation and provision of it to the said Gilasius, who was then holding inter alia a certain perpetual portion with cure in the church of St. Senan, In[i]sgayd, in the said diocese, and that in virtue of the said collation and provision he obtained possession of the said vicarage, and, without any dispensation, detained it and the said portion for more than a month against ‘Execrabilis,’ and, after the lapse of the said month, for between five and eight months, as he does at present, but without taking any fruits from them. The said portion being therefore void by the obtaining of the said vicarage, and the vicarage being void by the said constitution and reserved to the pope under his general reservation of all benefices void by ‘Execrabilis,’ the pope hereby rehabilitates the said Gilasius, etc., and orders the above archdeacon to collate and assign to him the said portion and vicarage, value 2 and 5 marks sterling, respectively. The pope further dispenses him to receive and retain them. Sedes apostolica, pia mater. (At the end: Jo. xxx. Quinto Idus Marcii anno quinto. Gerona.) [2½ pp.]
