11 Sixtus IV.

De Vacantibus.

1480
(recte
1481[–2].)
10 Kal. April.
(23 March.)
St. Peter's, Rome.
(f. 23r.)
To the abbot of St. Mary's, Abbeygormacan (Via noua), and the priors of St. Mary's, Clontuasgertomane, and St. Catherine's, Achruymomane, in the diocese of Clonfert. Mandate to collate and assign to Maurice Otressay, a canon of Clonfert, who is in his twenty-fourth year, the perpetual vicarage of Kyllaemarbolga in the diocese of Clonfert, value 3 marks sterling, so long void that its collation has lapsed to the apostolic see, although William Otressay, priest, of the said diocese, who is to be summoned and removed has detained it for some years, without any title or right; notwithstanding that he holds a canonry and prebend of Clonfert, value 20 marks sterling. The pope hereby dispenses him to receive and retain the said vicarage, notwithstanding the said defect of age, etc., and not to be bound for a year to have himself promoted to any holy order on account of the said vicarage or other benefice with cure or requiring holy orders, whilst studying letters at an university. Vite etc. (At the end: N. xx. Quarto Non. Aprilis anno undecimo. Garilliati.) [3½ pp. –]
1481.
3 Kal. Dec.
(29 Nov.)
St. Peter's, Rome.
(f. 84r.)
To the abbots of St. John the Evangelist's, Gill Abbey alias St. Finbar's Cave (s. J. E. de Antro sancti Fymbarrij), and Tracton (de Arbo [sic] tractu), in the diocese of Cork, and the treasurer of Cork. Mandate, as below. The pope has been informed by Thady Ocuyll, priest, of the diocese of Ross, that Dermit Osuylyuayn, priest, made a bargain with a certain clerk that if the latter would induce the bishop of Cork to make collation to the said Dermit of the perpetual vicarage of Ryllerochayn [sic] in the diocese of Cork, he would give him a certain sum of money or other things annually, after which the said bishop, perhaps in ignorance thereof, made de facto collation and provision of the said vicarage to the said Dermit, who under pretext thereof took possession of it, and has detained it for between five and six years, thereby incurring sentences of excommunication, etc. The said collation and provision being therefore without force, and the said vicarage being still void, the pope hereby orders the above three, if the said Thady will accuse the said Dermit before them, to summon him, and if they find the foregoing to be true, to declare the said collation and provision to have been and to be null and void, and remove the said Dermit, and in that event to collate and assign the said vicarage, value 10 marks sterling, to the said Thady. Vite etc. (At the end: P. xv. Decimooctauo Kal. Januarii anno undecimo. Delius, pro A. de Petra.) [2½ pp.]
Id. Dec.

Collation and provision to him, who is in his twenty-fourth year, of the deanery of Tuam, a major elective dignity with cure, value 20 marks sterling, void by the death extra R.c. of Milerus de Burgo, and reserved under the pope's late reservation of all major dignities, void and to be void; with dispensation to receive and retain it, notwithstanding the said defect of age, etc. Vite etc.
Concurrent mandate to the bishop of Pistoja, and the abbots of St. John the Evangelist's, Gill Abbey alias St. Finbar's Cave (de Antro sancti Fimbarri), and Holy Trinity, Ballintober (de Fonte sancti Patricii), in the dioceses of Cork and Tuam. Hodie dilecto filio Waltero Premussen. (At the end: P. xiii. xi. Nono Kal. Januarii anno undecimo. de Varris.) [3½ pp.—]
Ibid.
(f. 111v.)
To the prior of St. Thomas the Martyr's, Ballybeg (de Botonia), in the diocese of Cloyne. Mandate to collate and assign to Dermit Oflayn, priest, of the diocese of Cloyne, if found fit, the perpetual vicarage of Clonmyn in the said diocese, value 8 marks sterling, the commenda of which, held by papal grant and dispensation by Cornelius, abbot of St. John the Evangelist's, Gill Abbey alias St. Finbar's Cave (de Antro sancti Fimbarri), O.S.A., in the diocese of Cork, has this day been resigned to the pope by the said abbot, so that the said vicarage is void in the same way as before the said commenda was granted; notwithstanding that the pope has this day ordered to be united to the said vicarage for the lifetime of the said Dermit the vicarage of Roschyn in the said diocese, value 2 marks sterling, so long void that its collation has lapsed to the apostolic see. Dignum etc. (At the end: M. xii. Decimo octauo Kal. Februarii anno undecimo. Bonattus, pro A. de Petra.) [2½ pp.]
Ibid.
(f. 114v.)
To the dean of Tuam, and Edmund de Stoncona [sic] and Thady Omungoayn, canons of the same. Mandate to collate and assign to Cornelius Oconcranayd, clerk, of the diocese of Tuam, the perpetual vicarage of Cilcoryn alias de Corcomio in the said diocese, value 5 marks sterling, so long void that its collation has lapsed to the apostolic see, although Thomas Macbrissym, priest, of the said diocese, has detained it for several years since the said lapse, without any title or right, the said Thomas being summoned and removed. Vite etc. (At the end: P. Gratis pro deo. Quarto Kal. Februarii anno undecimo. de Varris.) [2⅓ pp.]
5 Kal. Oct.
(26 Sept.)
Bracelano.
(f. 185r.)
To Alexander Simonis, perpetual vicar of Banchretenre [sic] in the diocese of Aberdeen. Collation and provision of the said vicarage of Ba[n]chretenre, value 8l. sterling, void at the apostolic see, and therefore ipso facto reserved to the pope, by the resignation to him of Stephen Angel (?), by his proctor Giles Boys, precentor of Moray; whether it be void as above, or by the resignation of Patrick Boys, or in any other way, etc. Vite etc.
Concurrent mandate to the provost of Bremen, and the officials of Dunblane and Brechin (Vrchinen. [sic]). Hodie dilecto filio Alexandro. (fn. 2) (At the end: N. xii. x. Decimo septimo Kal. Novembris anno undecimo. Garilliati.) [2⅓ pp.]

(20 Oct.)
St. Peter's, Rome.
(f. 254v.)
To the abbot of St. Mary's Jerpoint (de Jeriponte), in the diocese of Ossory. Mandate, as below. The pope lately (upon learning that the monastery of St. Mary, Leix (de Lege dei), O. Cist., in the diocese of Leighlin, was void by the death of Patrick extra R.c., although John Flemyn, a monk, detained it under pretext of a provision by the present abbot of Baltinglass (de Valle salutis), of the said order and diocese, the father-abbot of Leix, made after it had been so long void that its collation had lapsed to the apostolic see, and without any other title or right; and that the said John had ruled and administered it for some months, but less than a year), ordered the abbot of St. Mary's, Kilcooly (de Aruicampo), of the said order, in the diocese of Cashel, to summon the said John and others concerned, and make provision of the said monastery to Maurice Ylechalur alias Yhustyn, a monk thereof, who from fear of the power of the said John could not safely meet him in the city or diocese of Leighlin, the pope's letters stating that its value did not exceed 10 marks sterling. At the recent petition of William Ymorra, a monk of the said monastery of Leix, containing that its value at the time of the said letters amounted, and still amounts, to 16 marks sterling, wherefore the said letters are surreptitious, and that William, abbot of the said monastery of St. Mary, after summoning the said John and others concerned, has made de facto provision to the said Maurice, who under pretext thereof has taken possession of the rule etc., and has excreised it for some time, the pope, inasmuch as if the facts be as stated the said letters are surreptitious, and the said monastery still void as above, hereby orders the above abbot of Jerpoint to summon the said Maurice and others concerned, and if he find the said letters surreptitious, to declare them and the said provision null and void, and in that event, and if he find fit the said William, who has made his profession of the said order, and is a priest and of lawful age, and who from fear of the power of the said Maurice cannot safely meet him in the said city or diocese, to make provision to him of the said monastery, value not exceeding 24 marks sterling; notwithstanding that he holds in commendam by papal grant and dispensation the perpetual vicarage of the parish church of Clonncchan and the perpetual vicarage of the parish church of Clonnethe, in the said diocese of Leighlin, value 12 and 6 marks sterling, respectively. The pope further dispenses him to retain them in commendam with the said monastery (fn. 3) for life, and grants that he may be blessed by any catholic bishop in communion with the apostolic see. Solicite considerationis indagine. [3 pp.]
Prid. Kal. Oct.
(30 Sept.)
Braeciano.
(f. 320r.)
To Master Anthony de Grassis, a papal chaplain and auditor. Mandate, as below. The recent petition of William Oliphant, clerk, of the diocese of Dunkeld, M.A., contained that, a dispute having arisen between him and Alexander Vaus and Giles Boyes and James Kynnard and John Fresel, clerks, about the precentorship (super cantoria) of Moray, which on its voidance by the death of Thomas Vaus extra R.c. the said William claimed under a collation and provision made to him by papal authority, which claim the said Alexander, Giles, James and John opposed, the pope committed the several causes and counter-causes, at the said John's instance, to Master John Prioris, a papal chaplain and auditor, and afterwards to the above Master Anthony, the latter of whom is said to have proceeded, short of a conclusion. The said petition adding that it is alleged that none of the said parties has a right to the said precentorship, the pope hereby orders the said Master Anthony, if he find this to be the case, to collate and assign the said precentorship, a non-major dignity with cure, value 76l. sterling, to the said William, who is by both parents of noble birth; even if it be reserved because, as is alleged, the said Thomas when holding it was an acolyte of the apostolic see and a continual commensal member of the household of William, bishop of Ostia, the pope's chamberlain, etc., and notwithstanding that the said William holds a canonry and prebend of Brechin, called a ‘pensionaria,’ (fn. 4) and the chapel of St. Mary, Forgu[n]dlby (?), in the diocese of Dunkeld, without cure, the value of each of which does not exceed 10 marks sterling. Nobilitas generis, litterarum etc. (M. xxii. Quarto Kal. Martii anno undecimo. Bonattus, pro A. de Petra.) [3¾ pp.]
1481[–2].
5 Id. Feb.
(9 Feb.)
St. Peter's, Rome.
(f. 325r.)
To the abbot of the monastery of SS. Coanus and Broganus, Mothel (de Motalia), in the diocese of Lismore. Mandate to collate and assign to Maurice [son] of Gerald de Geraldinis, a canon of Lismore, who alleges that he is by both parents of a noble race of earls, and that he is in or about his seventeenth year, the treasurership of Lismore, a non-major, non-elective dignity with cure, value 30 marks sterling, so long void (because John Prindrigast, after obtaining it by canonical collation, held it, even after being lawfully monished, for more than a year without having himself promoted to the priesthood), that its collation has lapsed to the apostolic see, although the said John has detained it for between five and seven years after the said year, without having acquired any fresh title and without dispensation, summoning and removing the said John. The pope hereby dispenses the said Maurice to receive and retain it for life, notwithstanding the said defect, etc., and requires him to resign his canonry and prebend of the said church as soon as he obtains possession of the said treasurership. Dignum etc. (At the end: M. xxii. Septimo Idus Martii anno undecimo. Bonattus, pro A. de Petra.) [2¾ pp.]
3 Non. March.
(5 March.)
St. Peter's, Rome.
(f. 327r.)
To the dean of Clonfert, and Maurice Otressay and Cornelius Ochenay, canons of the same. Mandate, as below. The pope has learned that a canonry of Clonfert and the prebend called [the prebend] of Kyllaiayn [sic] therein, and the perpetual vicarage of Ligmolasy, and a perpetual benefice, without cure, called a rectory in the church of Kyllmolonog, and another in the church of Magunacclay, in the diocese of Clonfert, both of which benefices are of lay patronage, (fn. 5) have been so long void that their collation has lapsed to the apostolic see, although Maurice Ocormacayn, priest, detains the said canonry and prebend, and William Obrogay [sic], an Augustinian canon, the said vicarage, and John Ocormacayn, clerk, of the said diocese (who is illegitimate, being the son of a priest and an unmarried woman), the said benefices, respectively, all of them without any title or right. The pope, therefore, relaxing the oath which Thady Olorchan, clerk, of the said diocese, who is in his twenty-third year, lately swore (after being, at the instance, as is believed, of the said Maurice, William, and John, captured and compelled by lay power) not to try to obtain the said canonry and prebend, vicarage and benefices, hereby orders the above three to summon the said Maurice, William, and John, and to collate and assign the said canonry and prebend, vicarage and benefices (which are without cure), value altogether not exceeding 9 marks sterling, (fn. 6) to the said Thady, removing the said Maurice, William, and John. The pope further dispenses him to receive and retain the said vicarage, notwithstanding the said defect of age, etc. Vite etc. (At the end: M. xxii. Septimo Id. Martii anno undecimo. Bonattus, pro A. de Petra.) [3 pp.—]
