To the prior of St. Mary's, Achamyeayrt, and the prior of Seyrkyeran, in the diocese of Ossory, and the archdeacon of Ossory. Mandate to collate and assign to Thady Obryn, priest, of the diocese of Ossory (who was lately dispensed by papal authority on account of illegitimacy, as the son of a priest and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure, after which he was so promoted), the rectory of Rasarayn in the said diocese, of lay patronage, void because Donatus Obryn obtained, by collation made by authority of the ordinary, the parish church of Dalge, called a parcel, (fn. 2) in the said diocese, and also to collate and assign to him the said church of Dalge, void because the said Donatus held it with the said rectory for more than a month against ‘Execrabilis,’ and has since held the said rectory and church, value together not exceeding 10 marks sterling, for between seven and eight years, without papal dispensation or any canonical right, wherefore the said church of Dalge is by the said constitution reserved to the pope, summoning and removing the said Donatus. The pope further dispenses the said Thady to receive and retain the said rectory and church de Lege [sic] together for life, notwithstanding the said defect, etc. Vite etc. (At the end: L. xxx. To the provost of St. Giles's, Edemburg, in the diocese of St. Andrews. Mandate to collate and assign to George Ker, clerk, of the diocese of Glasgow, M.A. (who alleges that he is by both parents of noble birth, and that he was presented to the ordinary for the perpetual vicarage of Linton in the said diocese, on its voidance by the death of Robert Preston extra R.c., by the then abbot and convent of Kelso (de Calco), O.S.B., in the diocese of St. Andrews, the ancient patrons), the said vicarage, value 9l. sterling. The pope further dispenses him to receive and retain with it for life any other benefice, or without it any two other benefices, with cure or otherwise incompatible, even if parish churches, etc., and to resign them, etc. Dignum etc. (At the end: Lta . Mandate to collate and assign to Gerald Barri, clerk, of the diocese of Cloyne (who was lately dispensed by authority of the ordinary on account of illegitimacy, as the son of unmarried parents, to be made a clerk and hold a benefice without cure, and afterwards by papal authority to be promoted to all, even holy and priest's orders, and hold a benefice even if with cure, and who in virtue of the said first dispensation holds, in titulum of a perpetual benefice wont to be assigned to secular clerks, a certain parcel of the tithes of Kyldoynyn in the said diocese, of lay patronage and value 2 marks sterling), a canonry of Cork and the prebend of Kylaspuchmylan therein, value 14 marks sterling, void by the death of Edmund Barri extra R.c. The pope hereby dispenses him to receive and retain them, and any benefices with and without cure compatible therewith and with one another, even if canonries and prebends, etc., and to resign them, etc., notwithstanding the said defect, etc. Vite etc. (At the end: Jo. xxx. To the abbot of Middleton (de Choro Benedicti) in the diocese of Cloyne (Clonen.), the precentor of Cloyne, and Thady Ohurayn, a canon of Ardfert, who is dwelling in the diocese of Cloyne. Mandate, as below. The pope has learned that the perpetual vicarage of Achfada in the diocese of Cloyne has been so long void (because the late Nicholas Sprenseos [sic], when holding it, obtained by canonical collation the perpetual vicarage of Corkachbeg in the said diocese), that its collation has lapsed to the apostolic see, although John Ocuylleayn, priest, under pretext of a collation made to him by the ordinary after the said lapse, has detained it for between seven and eight years, without any title or right. And the recent petition of Gerald Barry, clerk, of the said diocese, contained that if the said vicarage were united for his lifetime to a certain canonry and prebend of the church of Cork, provision of which was recently made to him by letters of the pope (in which he was dispensed on account of illegitimacy, as the son of unmarried parents, to receive and retain them, and any benefices with and without cure compatible therewith and with one another, even if other canonries and prebends, etc., [and to resign them, etc., as in the preceding]), he could in the event of his obtaining them better maintain himself, etc. At the petition, therefore, of the said Gerald, who alleges that he holds, in titulum of a perpetual benefice wont to be assigned to secular clerks, a certain parcel of the tithes of Kylldoynyn in the said diocese, which is of lay patronage, and value 2 marks sterling, and that the value of the said canonry and prebend does not exceed 14 marks sterling, the pope hereby orders the above three, if they find the facts to be as stated, to unite the said vicarage, value 6 marks sterling, to the said canonry and prebend for the lifetime of the said Gerald. To the prior of St. Tierney's (sancti Tigernacii), Achamicayrt, (fn. 4) and the prior of Sayerkeran, in the diocese of Ossory, and the archdeacon of Ossory. Mandate, as below. The pope has learned that the rectory of St. Rinicus [sic], Achabo, and that of St. Finlinus, Borduyl, in the diocese of Ossory, which latter is of lay patronage, have been so long void that their collation has lapsed to the apostolic see, although John Obergyn, priest, has detained the said rectory of Archabo [sic] for between two and three years, under pretext of an acceptance and provision in virtue of letters expectative made after the said lapse, and although Keruallus Machee, priest, has detained the said rectory of Borduyl for between twenty and thirty years, both of them without any title or right. And the recent petition of John Machostigin, clerk, of the said diocese, contained that if the said rectory of Borduyl were united to that of Achabo for his lifetime he could, in the event of his obtaining them, better maintain himself, etc. At the petition, therefore, of the said John, who is in or about his twenty-fourth year, and is of noble birth, the pope hereby orders the above three, if they find the facts to be as stated, to unite the said rectory of Borduyl to that of Achabo, value 12 and 30 marks sterling, respectively, for his life, summoning and removing the said John Obergyn and Keruallus, and moreover to collate and assign to him the said rectory of Achabo and the said annex. To John Barri, a canon of Cork. Mandate to collate and assign to Maurice Stondondum [sic], dean of Cork, the parish church of St. Mary, Kalyykouuac [sic], in the diocese of Cork, of lay patronage and value 16 marks sterling, so long void (because Odo Okalyauy, rector thereof, obtained the perpetual vicarage of Insmacnel in the same diocese, by a collation made by authority of the ordinary), that its collation has lapsed to the apostolic see, although the said Odo has detained it for between four and five years, without any fresh title and without any right, the said Odo being summoned and removed. The said Maurice is hereby dispensed to retain with it for life the said deanery, a major elective dignity with cure. Dignum etc. (At the end: L. xxviii. Quarto Id. To the dean of Segorbe (Segobrien.), and Charles Macmaginiss, a canon of Clogher, and the official of the same. Mandate, as below. The recent petition of Nemeas Ochayr, priest, (fn. 5) of the diocese of Clogher, contained that on the voidance of the perpetual vicarage of the parish church of St. Romandus, Achalurcayre, in the said diocese, by the death of Thomas Ochayr (fn. 6)extra R.c., and its having been so long void that its collation had lapsed to the apostolic see, Octavianus del (?) Palatio, clerk, of Florence, papal nuncio in those parts, in virtue of a special faculty which he alleged that he had from the said see, collated and assigned the said vicarage to Patrick Maglachalayn, priest, of the said diocese; that afterwards, upon the resignation by the said Patrick to the said nuncio of all his right in or to the said vicarage, without having had possession, the said nuncio admitted the said resignation, and made collation and provision of the said vicarage to the said Nemeas, who had been dispensed by papal authority on account of illegitimacy, as the son of unmarried parents, to be promoted to all, even holy orders and hold a benefice even if with cure; and that in virtue of the said latter collation and provision he obtained possession. The said Nemeas doubting whether the said collation and provision hold good, and the pope having learned that the said vicarage is still void as above, he hereby orders the above three to collate and assign it to him, value 6 marks sterling. Mandate to collate and assign to Thomas Ohelahy, clerk, of the diocese of Cloyne (Clonen.), a canonry of Cloyne and the prebend of Downachmor therein, value 14 marks sterling, so long void that their collation has lapsed to the apostolic see, and that there is no certain knowledge of the way of their voidance, although Donatus Ohelahy, priest, who is to be summoned and removed, has detained them for between two and three years, without any title or right, from fear of whose power the said Thomas cannot safely meet him in the city or diocese of Cloyne. To Bernard Magunssinan and Edmund Ohanrrathaid and Donald Makassaid, canons of Clogher. Mandate, as below. The pope has been informed by Magonius Ohultacan (recte Ohuleacan), clerk, of the diocese of Clogher, that on the voidance of the perpetual vicarage of Macayrenacruce in the said diocese, Matthew Macdiarmada, priest, of the said diocese, made a bargain with Donald, clerk, of the same diocese, (fn. 7) a member of the household of the then bishop of Clogher, to the effect that if the said Donald would get the said bishop to make collation and provision of the said vicarage to the said Matthew he would give him half its fruits yearly (which he afterwards did for several years), thereby incurring simony and deprivation, etc.; and that at the instance of the said Donald the said bishop, perhaps in ignorance of the said bargaining, made collation and provision to the said Matthew, under pretext of which he obtained possession, and has held it for between six and seven years. The said vicarage being therefore still void as above, the pope hereby orders the above three, if the said Magonius will accuse the said Matthew before them, to summon the latter, and if they find the foregoing to be true. to declare the said collation and provision null and void, and remove the said Matthew, and in that event to collate and assign the said vicarage, value 6 marks sterling, to the said Magonius. Mandate to collate and assign to William Omerayd, (fn. 9) clerk, of the diocese of Killaloe (who was lately dispensed by papal authority on account of illegitimacy, as the son of a priest and an unmarried woman, to be promoted to all, even holy and priest's orders and hold a benefice even if with cure), the chancellorship of Killaloe, a non-major dignity with cure. value 10 marks sterling, so long void that there is no certain knowledge of the way of its voidance, and that its collation has lapsed to the apostolic see, although Patrick Okark, clerk, of the said diocese, has detained it for between one and two years, without any title, the said Patrick being summoned and removed.
