To the justices of the Bench. Writ of supersedeas in respect of
the execution of a judgment in favour of Walter abbot of St. Peter
Gloucestre, and the taking of an inquisition concerning collusion, and
order by a judgment to affirm all that was before the council determined
as hereinafter mentioned, and to cause the same to be enrolled as of
record, and the act before the council made containing the tenors
of certain indentures, writings, endorsement and examinations, which
the king is sending under seal; as the said abbot lately sued before
the justices against Hugh Drewe parson of Coberleye, John Aston
warden of Beauvale chantry and Robert Mody of Eldrisfelde for six
messuages, two carucates of land, 14 acres of meadow, 3 acres of wood
and 9s. 1¼d. of rent in Brokworth co. Gloucester, against Richard
Wotton and Elizabeth his wife for two messuages, 44 acres of land and
1 acre of meadow there, against John Russell and Emma his wife
for a messuage and 24 acres of land there, against William Gabbe and
Isabel his wife for a messuage and 12 acres of land there, against
Roger Bouer and Elizabeth his wife for two messuages and 32 acres
of land there, and against John Bouer and Christina his wife for a
messuage and 22 acres of land there which, as the abbot pretended,
John sometime abbot his predecessor gave to Walter de Gloucestre
knight and Hawise his wife and to the heirs of the said Walter's body,
and which ought to revert to the plaintiff for that Walter de Gloucestre
died without issue; and process being continued until the defendants
made default after default, so that the plaintiff had judgment to
recover against them by their default, and execution was stayed
until inquisition should be made whether there was any fraud between
the parties contrary to the statute, order was thereupon given by
writ de judicio to the sheriff of Gloucestre to cause twelve knights
and other free men of the venue to come before the justices at a day
named in order to acknowledge upon oath what right the plaintiff
has in the premises, and what abbot his predecessor was thereof
seised, and meantime to take the same into the king's hand so that
neither of the parties should meddle therein, and to answer at the
exchequer for the issues thereof, and that inquisition yet remains
to be taken as the king has learned; and information being taken
and deliberation had touching the matter before the council for
saving the king harmless and for his interest, it seems to the council
that the abbot's pretended gift in fee tail was expressly made in fee
simple, and so the plaintiff's title upon his recovery by writ of formedon
is untrue, and that the bonds and indentures thereupon made and
before the council produced, by examination of the plaintiff taken
by command of the king before John Hulle and Hugh Huls justices
of assize in Gloucestershire and sent before the council, and of Richard
Ruyhale one of the plaintiff's counsel in the matter taken upon his
oath before the council, contain express collusion, and therefore it
is by the council determined that the plaintiff shall be altogether
barred from execution of the said judgment, that the justices before
whom it was rendered shall affirm all that is by the council determined,
and cause the same and the said act to be enrolled, making no
further inquisition concerning collusion, inasmuch as it is before the
council clearly proved and declared, and that writs of supersedeas be
made in respect of execution of the said judgment and taking the
said inquisition, and other writs needful for the affirmation and enrolment aforesaid. By C. |
