Richard duke of York, to Thomas Thorp late one of the barons of the exchequer. Receipt and acquittance in chancery at Northampton in the quinzaine of St. Hilary for 200l. and 200 marks, paid on 31 January, 34 Henry VI, reciting a petition whereby the duke shewed, in the parliament holden at Westminster 9 July, 33 Henry VI, that Thomas Thorp endetted to him in 210l. delivered for seuerte an obligacion annexed made in the names of the said Thomas and William Benyngton of Weltamstowe co. Essex gentilman, and that trustyng of the trouth and worshipp to be stablisshed of presumpcion in personez called the office of any baron, and the hounour that belongeth thereunto to have be a trewe obligacion unseyned in the name of the seid William, he accepted the same, the whiche by the seid William nor by his will assent or knowledge, as nowe is proved, was never made, and prayed that by auctorite of parlement that uppon shewyng of the obligacion unto the chaunceller he should have execucion of the body of the seid Thomas by writte oute of chauncerye, as yf he had bounden hym self in a statute of the staple, and that all londes and tenementes wherof the said Thomas was sole seased, or wherof any other were seased to his use may be executed, and after extent made be by the sheriff delivered to the duke, his executours and assignes, unto the tyme they nowe have resceyved the somme aforeseid with damages and costes, and reciting (French) the assent of the commons and the king's fiat; reciting also a certificate of 21 November, 34 Henry VI, by Henry Frowyk mayor of the staple of Westminster deputed to receive recognisances of debt therein, addressed to Thomas archbishop of Canterbury and papal legate the chancellor (Latin text follows) of a statute staple in 200 marks payable on the feast of Allhallows 1455, dated 26 July, 32 Henry VI, and made by Thomas Thorp to the duke, with prayer that he be compelled to pay that sum which was then unpaid.
