Thomas Courteney earl of Devon, to William archbishop of York, William bishop of Winchester the chancellor, John bishop of Hereford, John earl of Shrewsbury, John Fortescu knight chief justice appointed to hold pleas before the king, Walter Moyle one of the justices of the Common Bench, William Beef serjeant at law, Simon Melbourn esquire and Thomas Wylywrought. Recognisance for 5,000 marks, to be levied etc. in Devon.
Condition, that the erle within five yere paye all dettes and dutees due by Thomas late erle of Devonshire his fader to any person thought resonable by the archbisshop, bisshop, the tresorer and John Fortescu, and yif any of theym dye by advyse of thoo that over leven, of which the archbisshop, chauncellor, bisshop, erle and other, beyng executoures unto the late erle, yif they hadde take uppon theym the administracion, shulde have bene charged; also that the nowe erle within five yere paie all money, dettes and duytees for whiche any other is bounde for the late erle, or doo entrete and conclude with all thoo persones to whom suche dette is dewe, makyng theym surete as agreed, or fully discharge the executoures, or yif the executoures or any of theym make acquitaunce to any person of any dette or dewte belongyng unto the late erle, or relesse any accion, suet or execucion that may perteyne to theym as executoures withoute the assent of the nowe erle or his executoures, or doo any thyng in prejudice of any dette etc. unto theym perteyning withoute the assent of the same erle or his executoures, or the executoures atte the costes and labour of the nowe erle att alle tymes by hym required commense not suche accions and sutes as shall perteyne unto theym and shall bene advysed by the nowe erle and his executoures, and aswell the accions and suytes as execucions theruppon hadde pursue not as advysed, or the executoures all the sommes recovered after execucion hadde in goodely haste yeve not unto the nowe erle or his executoures, or lette wilfully the nowe erle or his executoures pesibly to have and enjoye all dettez, godez and catallez etc. belongyng to the late erle, or atte all tymes resonable as required relesse not by dedez unto suche as shall bene advysed by the same erle or his executoures all dettes, accions, execucions, demaundez etc. that may perteyne unto them by reson of any dette etc. due to the late erle or of any other mater or cause betwene the late erle or any other person. Condition, that the nowe erle of Devonshire before Ester next do to be made to Herry broder to the erle a sure astate of londes to the yerely value of 200 mark over all reprises, to him and his heires males of his body, the remaindre of 40li. thereof to the heires of the same Harry ys body, that within four wookes after Seynt Michell next he make to the said Harry a graunte of all maners, londes etc. the whiche the late erle or any other with hym hadde to his use which were or bith Richard Talbotes, to him and his haires males of his body after the dethe of the saide Richard, or elles within a yere make to the said Harry and to his heires males of his body a sure astate of londes of lyke value, to take effect after the dethe of Richard Talbot, and pay him 50 marc in the fest of the Nativitee of oure Lord next or within three wokes, that he paie unto John Courtenay broder unto Harry 40li. yerely duryng three yere, and within a moneth folowyng make to him and his heires males of his body a sure estate of londes to the yerely value of 100li. over all reprises, that within three yere he marye Jane oon of the doughters of the late earle by advise of the said archbisshopp etc. or suche of hame as shall over levyn, or els paie unto her for her maryage 1,000li. or suche lesse summe as he shall entrete hir or her husbande, and yn lyke wyse shall marye Elizabeth suster unto Jane before she be of the age of eighteen yere, yif she leve so longe, or paie unto hir or him that she shalbe maried to 1,000 marc or suche a lesse summe as he shall entrete ham.
