Memorandum of delivery to John Stud as attorney of a writ of scire facias under pain of 40l. for omission, dated 27 Nov., to the sheriff of Yorkshire ordering the appearance in Chancery on the octave of Hilary next of Thomas Legh master of arts to show why letters patent of the abbot and convent of St. Mary's, York, conferring upon him a certain pension, should not be revoked and annulled and the said pension with arrears be granted to Thomas Bladsmyth, a gentleman of the king's chapel; inasmuch as the present abbot Robert, by reason of his new creation to fill the vacancy caused by the translation of the late abbot William formerly bishop of Carlisle to the bishopric of Durham, was bound to pay this pension to one of the king's clerks until he could be provided with a competent ecclesiastical benefice; and immediately after the said translation Bladsmyth obtained letters under the king's sign manual, Signet and Privy Seal nominating him to the pension and delivered the writ of Privy Seal to a certain Chancery clerk to compose writs thereon to the new abbot and his convent for the conferment of the pension after restitution of temporalities and having obtained such writs sealed with the Great Seal delivered them immediately after the restitution; but Legh, not being unaware of this but craftily contriving to annul Bladsmyth's promotion by sinister information and guileful suggestion, surreptitiously obtained from the king other letters under his sign manual and Privy Seal, which emanated unadvisedly, and procured the direction to the abbot and convent of writs made long before the restitution of temporalities to the present abbot and thus obtained from them the said letters patent craftily and unjustly against the form and course of Chancery to the grievous damage of Bladsmyth, who has therefore petitioned the king that they be annulled.
