Granted, returnable at octave of Martinmas 1470. Sheriff of Essex said writ arrived too late, jury in respite to quindene of Hilary 1471.

Pleading: Thomas Fyler states that on 20 November 1465, William Tufte forcibly broke his close at Little Baddow, cut and carried away 40 ash trees and 2 carts of underwood worth 100s, and destroyed his growing grass worth 100s with his beasts. This was against the peace, and to his damage of £10.

Pleading: WT denies force and arms and acting against the peace. Parties on country. Concerning the rest, WT states that TF ought not maintain his action, as before the time of the supposed trespass TF was seised of a close called 'Le Downe' with other lands called 'Bassetys Deynes' in Little Baddow in his demesne as of fee, this being the place of which the site of the alleged trespass was a parcel, and thus seised he demised this property, together with 40 cows, to a certain Richard Marchall, at an annual rent of 20m. By virtue of this RM was in possession, and WT, as servant of RM and on his orders, entered the close, cut the trees and pastured his animals, as seemed right.

Pleading: TF states that the property concerned in the plea was 12 acres of wood called 'Fylerswode', formerly called 'Bassetys Wode' in Little Baddow, and is different from the close called 'Le Downe' and the other lands mentioned by WT.

Pleading: William Bonfey states that on 28 August 1467, in London, Robert Hydyngham made a bond with him in £26, payable at All Saints then next, but has not paid, to his damage of £10. He shows the bond in court.

Pleading: RH states that WB ought not have his action, as after the making of the bond, namely on 29 August 1467, in London, by a sealed document which RH shows in court, WB agreed that if RH and a certain Robert Sharp should deliver to WB before All Saints then next an engraved and covered silver bowl, 12 silver spoons and a powder box which, amongst other items, were placed with one Nicholas Sharp as a pledge by John Olney for 50m, as well as all other items given as pledge by JO to NS for another £14, then this £26 bond would have no effect; otherwise it would remain in force. RH states that after the making of the bond, namely on [omitted], in the parish of St Bartholomew, Broad Street ward in London, he and Robert Sharp offered WB the bowl, spoons and box, as well as a covered glass bowl, 2 silver cruets, a silver bell called a 'sacryngbell', a silver 'kiss of peace' called a 'paxbrede', and two bowls called 'nottes', which comprised all the goods placed with NS by JO before the making of the bond for the said £14. However, WB refused to accept these from them. RH states that the bond mentioned in the plea and this agreement are one and the same, and not different, and seeks judgment.

Pleading: WB, protesting that these items were not all the items pledged to NS by JO, states that he ought not cease his suit, since after the agreement but before the said feast of All Saints, RH told him that he would send the goods to him according to the terms of the agreement, but RH and RS did not offer them to him as they claimed.

Pleading: Thomas Torold was summoned to answer Walter Reynell on a plea that he render to him a certain basket ('calathum') containing charters and other documents which he unjustly detains. WR states that Elizabeth Malston, daughter and heir of Robert Malston, was seised of manors of Malston and East Ogwell in Devon, and 10 messuages, 2 cottages, 2½ acres of land in the parish of Launcells in Cornwall, in her demsene as of fee, and had possession of this basket and charters pertaining to that property. She then enfeoffed them to William Styghill in perpetuity, who in turn enfeoffed John de Monte Acuto in perpetuity. JM then granted them to WS and his heirs, and he was seised in his demesne as of fee tail. After, Elizabeth delivered the basket and charters to one Ralph Shyllyngford, to the use of WS and his heirs, to be delivered to WS on request. WS then died seised, and the property passed to his daughter and heir Margaret, who entered and was seised. She then died, and the property passed to WR as son and heir, and he entered and was seised, and still is seised. However, RS lost the basket and charters, which came into the possession of John Colyford, former prior St John's Hospital, Exeter ('priory of St John the Baptist within the eastern gate of Exeter'), and on 3 November 1464, at Westminster, delivered them to TT for safe-keeping, to deliver them to the rightful holders. However, TT has refused to deliver them to WR, despite requests, to his damage of 500m.

Pleading: The same TT was also summoned to answer Andrew Hillersdon on same charge. He states that John Fortescu was formerly in possession of the said basket and charters, relating to 40 messuages, 2 water mills, 1000 acres of land with appurtenances in Malston, East Ogwell, Frogmore, Sandhill, Ellacombe and Allington in Devon, namely a charter by which Walter de Halslade, parson of East Ogwell, and John Wodeman granted to Robert de Malston all these lands, as all the messuages, mills, lands, tenements, rents and services in Malston and East Ogwell, with the advowson of the church, and at Frogmore in the manor of Charleton, as well as at Sandhill and Ellacombe in the manor of North Bovey, and by which WH and JW also granted to RM all the rents and services which Robert Skytta of Nutcombe owed them for lands and tenements which he held of them at Nutcombe, and which Thomas in the Combe owed them for his lands and tenements in Malston, and which Martin atte Wode owed them for lands at 'Hydyswyll' in the manor of Allington, to hold for life of the chief lord of the fee, and after the death of RM all these messuages, etc, were to descend to a certain Robert, son and heir of Thomas de Leighyngcote and the heirs of his body. If this Robert were to die without issue, all this property, etc was to pass to Ralph de Shillyngford and the heirs of his body, and if he too died without issue, they should pass to John de Prall and the heirs of his body, and if he too died without heirs, to Thomas de Grymston and the heirs of his body, and then to the rightful heirs of RM. RM then died, and the others all died without heirs of their body, and thus the property reverted to AH as kinsman and heir of Thomas de Grymston, namely son of William, son of Robert, son of Elizabeth, daughter of TG. Then, on 29 September 1459, at Exeter, John Fortescu delivered this basket containing this and all the other charters to John Colyford, prior of St John's hospital, Exeter, for safe-keeping, and on 3 November 1464, at Westminster, JC delivered them to TT, for him to deliver to the rightful owner or owners. However, TT has refused to hand them over, despite requests, to his damage of 500m.

Pleading: John Marcaunte states that on 28 November in Michaelmas term 1467, at Westminster, he appeared in person before the Barons of the Exchequer and by a bill sought against Thomas Dalamare, former sheriff of Wiltshire, then present in that court rendering his account by James Bartelot, his attorney, that TD pay him £9 18s which he owed and detained from him. He states that on 20 November 1462, in the parish of St Nicholas Olave, Queenhithe ward, London, TD bought from him one bay-coloured horse, two shields, one saddle and one baselard, all for £9 18s, payable on request. However, TD did not pay him this or any part of it, despite many requests, to his damage of 10m. TD, by his attorney, sought to hear the bill, and it was read to him. Having heard this, he said he was not advised to respond, and sought licence to imparl to the octave of Hilary, which was granted. On that day, JM came in person, TD by attorney; JM sought a response, TD said that he did not owe this or any money as claimed; parties placed on country, sheriff of London to have jury of that parish and ward at Westminster on Monday 1 February then next. On that day, parties came as before, sheriffs of London, Thomas Stalbroke and Humphrey Hayford, returned the writ and a jury panel, but the jurors did not come. Sheriff to distrain the jurors to be there on Monday 15 February next, or be before Richard Illyngworth, chief Baron of the Exchequer, at St Martin le Grand on Friday 12 February. On 15 February, parties came, chief baron sent record with a writ of distraint and the jury panel, with this endorsement, namely that on 12 February, together with John Wodeman, JM came before him in person, and TD by Bartelot, and the sheriffs returned the writ and jury panel. Some of the jurors came, but others did not. Sheriff to distrain them to be before Illyngworth on Saturday 20 February, or at St Martin le Grand on Friday 19 February. On Saturday 20, parties came to hear judgment, Chief Baron sent record that on 19 February, jury came, said that TD did owe JM the £9 18s as claimed. Damages assigned at 46s 8d, costs at 40s. Barons ordered that JM should recover his debt and damages, which amounted in total to £14 4s 8d. However, TD has not paid this, to his damage of 20m.
