Pleading: WE says that he does not owe WT the aforesaid 61s 8d nor any other monies and offers his law, to be made in Easter term 1480. Pledges of law are named. And it is ordered that WE's attorney, Richard P., is to have his master to this court to make his law in the term aforesaid.

Pleading: Peter O. claims that Godfrey S. owes him 40s per a bond. Damages are claimed at 4m. Bond shown in court.

Pleading: GS defends and seeks that the bond and its endorsements be read to the court. The condition on the bond is that if GS should neither practise nor make to be practised through others or by any other name the art of shoemaking within the vill of Westminster, Middlesex, for one year next following the making of the bond, then the bond should be null and void. GS says that he did not work as a shoemaker etc. at Westminster during the year following the bond's making, and so should not have to pay the aforesaid 40s etc.

Pleading: PO says that GS did practise and make to be practised the art of shoemaking at Westminster within the space of one year following the bond's making and so should pay 40s as per the bond. PO seeks inquiry upon the country, and GS seeks likewise. Order to the sheriff of Middlesex to make a jury come in Easter term 1480. Pledges are named for the defendant.

Pleading: Robert G. claims that William R. owes him £13 22d on two bonds, one in £7 6s 8d made on 10 November 1477 and due at the feast of St George (23 April) 1478, and the second in £5 15s 2d, made on 8 August 1478 and due on 19 October 1478. Damages claimed at £10. Bonds shown in court.

Pleading: WR says that he ought not be held to the aforesaid bonds, as on 10 November 1477, in the said parish and ward in London, he made a conditional bond in £7 6s 8d with RG, on the condition that if he made another bond with RG in £5 by the said feast of St George 1478, or paid RG the said £5, then the bond would be void. He also says that on 8 May 1478 he made a second bond, in £5 15s 2d, on the condition that if he or a certain William Warbylton should pay RG 33s 4d before 9 October 1478, then this latter bond should be void. WR says that he is a man of little learning, and that the bonds brought forward in this court were read to him in English as containing these conditions, even though they did not, and thus these bonds, not containing these conditions, are not of his making. Pleading: Robert T. claims that Robert P. owes him 40s as the unpaid residue of a 60s bond. RT acknowledges satisfaction concerning the other 20s of the aforesaid 60s. Damages are claimed at 40s.

Pleading: RP defends, and seeks that the bond and its endorsements be read aloud. The condition on the bond is that if RP should pay RT 40s, in payments of 20s in the feast of Christmas 1459 (25/12/1459) and 20s in the feast of Easter 1460 (13/04/1460), then the bond should be null and void. Upon hearing this RP says that the bond ought not have any force because he paid RT the aforesaid 20s in Christmas 1459 and 20s in Easter 1460, namely at Studham, Bedfordshire.

Pleading: RT says that RP did not pay him the aforesaid 20s in Christmas 1459 and 20s in Easter 1460 and seeks judgment.

Pleading: RP says that he did pay RT the aforesaid 20s in Christmas 1459 and 20s in Easter 1460 at Studham, Bedfordshire, and puts himself upon the country. RT puts himself likewise. Order to the sheriff of Bedfordshire to make a jury come in the octave of the purification of St Mary 1480. pledges are named for the defendant.

Pleading: Joan Morley says that she ought not be held to the bond because she had already made full administration of the goods and chattels of the late Nicholas Morley by the time of the making of the defendants' writ.

Pleading: Robert Lyme and his wife Juliana, also called Juliana Boynton lately of London, widow, claim that William Baldewyn Sen. owes them £40 on a bond made between WB and JL while she was a single woman. RL and JL say that though often requested William Baldewyn Sen. did not pay this money to JL while she was a single woman, nor has William Baldewyn Sen. paid this money to JL and RL since their marriage. Damages are claimed at 20m. Bond shown in court.

Pleading: WB defends and says that the force of the bond ought not hold. He ways that after the time of the bond's making, while JL was still a single woman, a certain indenture was made between himself and JL, at West Ham, Essex, one part of which William Baldewyn Sen. presents to the court. This indenture says that if William Baldewyn Sen. and a certain William Baldewyn Jr. should pay JL £17 in payments of: £3 6s 8d at the Nativity of St John the Baptist 1479, £3 6s 8d at Michaelmas 1479, £3 6s 8d at Christmas 1479, Easter 1480, £13 4d at the Nativity of St John the Baptist 1480 [note this only amounts to £14], then the aforesaid bond shall be null and void. William Baldewyn Sen. says that he paid each of these sums in accordance with the terms of the indenture, namely at West Ham, Essex, and therefore the bond should be null and void.

Pleading: RL and JL say that neither William Baldewyn Sen. nor William Baldewyn Jr. paid them any sum of money, of the sums of money specified in the indenture. RL and JL say that neither William Baldewyn Sen. nor William Baldewyn Jr. paid JL the aforesaid £3 6s 8d due in the feast of the Nativity of St John the Baptist 1479, and so the bond ought to be enforced.

Pleading: William Baldewyn Sen. says that he did pay JL the £6 6s 8d due in the feast of the Nativity of St John the Baptist 1479, at West Ham, Essex, and puts himself upon the country, and RL and JL put themselves likewise. Order to the sheriff of Essex to make a jury come in Easter term 1479. Pledges named for the defendant.

Pleading: Cecily N., Duchess of York, claims that Thomas C. has not rendered reasonable account concerning the time which he acted as her receiver of monies in Devon, namely for one whole year next following 16/10/1476. Duchess CN claims that during this time TC received on her behalf: 8m at West Raddon (Devon) by the hands of Robert R.; 100s at Goodrington (Devon) by the hands of the same RR; and 100s at Beaworthy (Devon) per the hands of the same RR. Duchess CN claims damages of £20.

Pleading: TC says that he never acted as Duchess CN's receiver and puts himself upon the country, and Duchess CN puts herself likewise. Order to the sheriff of Devon o make a jury come in Easter term 1480.

Pleading: John Pelham claims that John Lyon and John Daweberd, executors of the will of Richard Sprotford, owe him £20 per a bond made between John Pelham himself and the late RS. Damages are claimed at 100s.

Pleading: JL and JD defend and seek to hear the bond. The bond, made on 01/02/1473, is read and says that a certain Richard Norys, John Turpyn, and the late Richard Norys obliged themselves to be held to John Pelham in £20, payable in Easter 1473 (18/04/1473). Upon hearing this JL and JD say that the bond is not of the late RS's making, and they say that they have fully administered all of the goods and chattels which belonged to the late RS, and that they had already done so by the time of the making of John Pelham's original writ.

Pleading: John Pelham says that on the day of his original writ's making, on 04/04/1479, JL and JD had in their possession goods and chattels of the late RS sufficient to cover the debt, namely at Bassingbourn, Cambridgeshire. John Pelham seeks inquiry upon the country, and the executors, JL and JD, seek likewise. Order to the sheriff of Cambridgeshire to make a jury come in Easter term 1480.

Pleading: JJ asks to hear the bond and its endorsement. And the condition on the bond is that 'if the within obliged Roger [no surname given] and JJ should pay to RS £11 in payments of: 40s in the feast of Easter 1473 (18/04/1473); 40s in the feast of the nativity of St John the Baptist 1473 (24/06/1473); 46s 8d in the feast of Easter 1474 (10/04/1474); 46s 8d in the feast of Easter 1475 (26/03/1475); and 46s 8d in the feast of Easter 1476 (14/04/1476); then the bond should be null and void. And, if JJ should default on any payment, in part or in whole, then the bond should come into force. Upon hearing this JJ says that the force of the bond should not hold because he made each of these payments to RS in keeping with the conditions on the bond, namely at London in the parish of St Giles without Cripplegate, Cripplegate Ward.

Pleading: RS says that the bond should be in force because JJ, as much as a certain Roger [surname left blank] were obliged to him in the aforesaid bond, and neither of them paid him any sum of the aforesaid moneys specified in the bond's conditions at the aforesaid feasts. RS says that neither JJ nor Roger paid him the 40s due in the feast of Easter 1473 (18/04/1473), and seeks judgement.

Pleading: JJ says that he paid RS the 40s payment of Easter 1473, at London in the parish and ward aforesaid, and puts himself upon the country, and RS puts himself likewise. Order to the sheriff of London to make a jury come I Easter term 1480.

Postea text: postea 2 - The case is respited as far as the quindene of St John the Baptist 1480 (late in Trinity term 1480) unless first heard at the assize of St Martin le Grand before chief justice Thomas Bryan on 04/07/1480.

Postea text: postea 3 - To this day ( the quindene of St John the Baptist 1480) comes plaintiff RS, and chief justice TB sends record of the case as heard at the assize of St Martin le Grand on 04/07/1480 before the aforesaid chief justice, and associate justice Thomas W. To that assize went plaintiff RS, but defendant JJ did not appear and so a jury was taken against him per default. At that assize, a just said on oath that the aforesaid 'Roger' and JJ did not pay RS the aforesaid 40s which were due in the feast of Easter 1473. Therefore RS is to recover the aforesaid debt [of £20 on the bond] plus damages of 13s 4d and costs of 26s 8d. JJ is in mercy.

Pleading: Thomas W. claims that on 11 April 1476 John B., together with John F., assaulted him with force and arms at London, seizing and carrying off his goods and chattels to the value of 6m. The goods taken were namely: one red 'elaundem' (?), one primer, one book of predestinations, another book of orations, one gold ring and six ounces of broken silver. Damages are claimed at 40m.

Pleading: JB denies force and arms, and taking the goods and chattels of TW. Concerning this JB puts himself upon the country, and TW puts himself likewise. As regards the supposed assault, JB says that at London on the day aforesaid it was in fact TW who assaulted him, and that he simply defended himself.

Pleading: TW reiterates his claim that he was the victim of an assault by JB and seeks inquiry upon the country, and JB seeks likewise. Order to the sheriff of London to make a jury come in Easter term 1480. Pledges are named for the defendant.

The cloth which RM bought was, namely: 12 yards of cloth called Holland Cloth; 2 yards of fustian called 'Holmys' (this probebly refers to fustian of Ulm, Germany, a centre of production), and ten yards of buckram. [Note: The two sums, for the sale and loan, add up to slightly more than the supposed debt. In the manuscript, the sum for he supposed loan is written in as a later interlineation and so probably is in error.] Damages are claimed at 4m

Pleading: [Further information drawn from CP40/872 rot.334 - Easter 1480] WH says that at the time of the bond's making he was a lay man of little learning and so the contents of this bond were explained to him in plain English to contain the conditions that: if WH, prior to Christmas 1474, should deliver to CL and RL four woollen broad-cloths each containing 24 yards in length with criniled borders [of] agreed quality and colour [as] four cloths of two penny hue (quator pannos laneos continentes videlicet quemlibet eorum viginti et quatuor virgas in longitudine cum crunled listes concordates bonitate et colore quatuor pannis de two peny hewe) which the said WH lately delivered to Galeoto Centuriono; or if not delivering these cloths to CL and RL should instead pay to CL and RL £12 in Christmas 1474 and also deliver to them four similar cloths in the following Christmas (1475); or, if JH should pay to CL and RL £12 in each Christmas thereafter until he should deliver four similar cloths or payment of £12 sterling in exoneration of WH himself concerning the said £60; then the sum of £60 specified in the bond should in delivery on the cloths of payment of moneys be null and void. WH says that believing the bond to contain these conditions he sealed it and delivered it to CL and RL. WH says that if the bond does not contain these conditions then it is not of his making and puts himself upon the country, and the plaintiffs, CL and RL, put themselves likewise. And upon this CL and RL say that they are aliens, and that WH is indigenous [English], and therefore, in accordance with the statute they seek to have a jury as much of aliens as of indigenous [English] persons. Pleading: Richard W. is in mercy for many defaults. RW was summoned to respond to John G. in a plea that, whereas JG had entered into a bond, for £17, payable to a certain John W. and William B at a certain feast named within the same bond, and long before the feast on which the £17 bond was due, RW assumed responsibility to pay this £17 to JW and WB at Exeter, and to recover the bond from them, thus exonerating JG of the said debt of £17. However, RW did not pay this money to JW and WB, or recover the bond, which then led to various legal actions by JW and WB against RW for the recovery of the aforesaid £17, to the trouble of RW and his damage of £40. In this manner, JG comes by his attorney John K., and defendant RW comes by his attorney Richard D., and day is given between the parties at the octave of the Purification 1480.

Pleading: William Gournay states that on 25 June 1476, in London, Edward Clerk made a bond with him in 100s, payable at Michaelmas then next. The bond, sealed by EC and presented to the court by WG, recites how John Bumpsted brought a plea of trespass [against EC] in the pie-powder court of Thomas, prior of the cathedral priory of Holy Trinity, Norwich, at 6 o'clock on 10 June 1476, before the prior's steward William Yelverton. As a result, he recovered damages and costs of £25 13s 4d, and after that judgement was rendered, according to the custom of the same court, execution of the verdict was placed in the custody of the keeper of the prior's prison. At the instance of one John Garbald, EC made this bond of 100s with WG for the discharge of this debt of £25 13s 4d. However, he has not paid, to his damage of 5m.

Pleading: John Shukburgh says that the force of the aforesaid bonds ought not hold because after the time of their making plaintiff John Carpenter issued him a receipt of payment for the same £40 specified in the aforesaid bond, namely at Westminster, Middlesex. John Shukburgh presents this receipt to the court. It was given at Westminster on 04/04/1474 by John Carpenter, who by the same receipt acknowledged himself to have received and had by the day of the making of the same receipt, £100 from a certain Thomas Risby as payment of five bonds which were made on 24/01/1462, and of which the final payment was to have been made in Christmas then preceding (25/12/1473 - the wording is 'Natalic domini tunc ult', this final word could be either ultima [last] referring to the Christmas before the making of he receipt, or ultra [beyond/in the future] referring to the Christmas after the making of the bonds) to John Carpenter and others, concerning which same £100 the same John Carpenter acknowledged himself to be paid (fatebatur se fore solviter), so that TR and his heirs were made quit by the same receipt. John Shukburgh says that the two bonds, for £40, on which he is being sued in this present suit are two of the five bonds mentioned in the above receipt, pertaining to £40 of the £100 mentioned in the same receipt, and so seeks judgement.

Pleading: John Carpenter says that the aforesaid acquittance (receipt) is not of his making and seeks inquiry upon the country, and John Shukburgh seeks likewise. Pleading: Thomas H., Hugh H., Robert A., and William H., administrators of the goods and chattels of Gilbert P. who died intestate, claim that Simon L. owes them £8 on three bonds which were made between SL and the late GP. The plaintiffs say that all three of these bonds were made at London in the parish of St Nicholas Shambles, Farringdon ward within. The first of these bonds, in 60s was made on 11/04/1476 and due on 10/05/1476. The second of these bonds, in £ 10s, was made on 20/11/1476 and due in Easter 1477 (06/04/1477). The third of these bonds, in 30s, was made on 02/04/1477 and die in the Pentecost 1477 (25/05/1477). Plaintiffs TH, HH, RA, and WH say that SL did not pay this £8 to the late GP during his lifetime, nor has he paid it to them, as GP's administrators, since they were granted administration of GP's goods and chattels by archbishop of Canterbury Thomas B. at Knole ('Knolle'), Kent. Damages are claimed at 10m. Bonds shown to the court, as well as letters of administration.

Pleading: SL says that the administrators ought not continue their case against him because after the making of the aforesaid bonds, at London (parish and ward left blank) on 04/06/1477, the late GP issued him a receipt acknowledging 'payment of £27 13s 4d in part payment of the mature sum (matoris summae), concerning which £27 13s 4d the said SL was to be quit.'

Pleading: Prior Gilbert S. claims that William W. owes him £20 by way of a certain indenture made at London on 07/04/1472 by which the same prior and convent of the hospital of Elsing Spital granted to WW, at farm, all of the hospital's tenements in the parish of St Augustine by St Paul's, London, which lie between: the hospital's tenement then inhabited and held at farm from the same hospital by John W. on the western part; the tenement then inhabited by Thomas B. on the eastern part; the king's street called 'Watling Street' on the southern part; and one 'place of land' belonging to the hospital on the northern part. Prior GS says that, by this indenture, this property was granted to WW at farm from the feast of Easter 1471 (14/04/1471) for 25 years. In return, WW was to pay to the prior and convent of the hospital an annual rent of 46s 8d in equal portions at the principal annual terms in London (presumably Christmas, Easter, nativity of St John, and Michaelmas). During this period WW was to maintain the property and keep it in good repair, empty the latrines, and make all necessary repairs to the pavement of the king's street at his own expense; excepting to the same prior and his successors whatever should be necessary towards wind and rain (contra ventum et pluviam), namely in roofing and plaster, and the lead gutters. During the period of this farm, WW was not to sell, demise, or alienate any part of the said property without the licence of the said prior etc. The prior etc. retained, by the said indenture, right of distraint in any part of the property should the whole or any part of the rent due at any term fall more than 8 days in arrears. And should any part of the rent due in any term fall more than 15 days in arrears, then the prior retained the right to re-enter the same property etc. And to the fulfilling and observing of all and singular agreements, grants, and payments aforesaid on the part of WW, the same WW obliged himself and his heirs to the said prior in £20. Prior GS says that after the demise at farm of the aforesaid property to WW, under the terms aforesaid, WW later and without the prior's licence, on 13/12/1477 at London in the parish and ward aforesaid, demised the aforesaid tenement with appurtenances to a certain Richard B. for the remainder of the aforesaid farm. Hence, by breaking the terms of the original farm, WW obliged himself to prior GS in the said £20. Damages are claimed at 10m.
