After hearing Counsel this Day, at the Bar, upon the Petition of Thomas Pride Esquire, Son and Heir of Elizabeth Monk, Daughter and Heir of Thomas Monk, Eldest Brother of George late Duke of Albemarle; as also Counsel for the Earl of Bathe and the Earl of Montagu, in Answer thereunto; the Earl of Bathe and Earl of Montagu having voluntarily consented to wave their Privilege, in any Suit at Law or in Equity, begun, or to be begun, by the Petitioner, touching any Part of the Estate of the said late Duke of Albemarle:

The House agreed thereunto.

And it is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the former Order of this House, wherein the Petitioner is ordered to answer to the Appeal of the Earl of Montagu and others therein mentioned, shall be, and is hereby, discharged.

After hearing Counsel this Day at the Bar, upon the Petition of the Corporation and Societies of the City of London, of and for the Mines Royal, and also of the Mineral and Battery Works, against the Bill, intituled, "An Act to prevent Disputes and Controversies concerning Royal Mines."

Marshall versus Paxton, in Error.

Whereas, by virtue of Their Majesties Writ of Error returnable in Parliament, a Record of the Court of King's Bench was brought into this House, the Second Day of this Instant January, wherein Judgement is entered for Nicholas Paxton, against Gilbert Marshall; and whereas this Day was appointed for hearing the Errors argued thereupon; Counsel appearing for the Defendant, but no Counsel for the Plaintiff, in the said Writ of Error:

It is this Day ORDERED and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the Record wherein Judgement is entered for Nicholas Paxton, against Gilbert Marshall, shall be remitted; and that the Judgement therein given for the said Nicholas Paxton shall be, and is hereby, affirmed: And it is further ORDERED, That the said Gilbert Marshall shall pay, or cause to be paid, unto the said Nicholas Paxton, the Sum of Forty Pounds, for his Costs in defending the said Writ of Error in this House.

The Tenor of which Judgement, to be affixed to the Record, is as followeth; (videlicet,)

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That this House will hear the Cause wherein the Lady Brooke is Appellant, and Sir Rob't Brooke Respondent, on Wednesday the Seventh Day of February next, at Ten of the Clock in the Forenoon.
